Letter of claim - p2p
Announcement: Software to assist subjects of Topware P2P action.
Each victim in this case has been accused of stealing one particular
computer file over P2P networks. It is only fair that victims should
have the opportunity to independently assess whether such an act has
occurred before either settling or allowing the case to proceed.
I propose to offer a free, individual and confidential service to each
victim, that will identify the possibility that this file exists.
This service will utilise a specialised search program that you are
able to run on your own machine. This will search based on the hash
(or digital DNA) of the file, and will show you clearly whether or not
you may have a problem.
If there are enough requests for such a service, development of the
software shall begin immediately.
Brief description of proposed softwa
1) Verify whether or not the file is present, or whether there is any
evidence of it's existence at a prior point in time. This verification
will be independent of the actual filename used.
2) It will not search for any video files, and will not be persusing
directory listings. This means if there are any other files that may
be an issue, then the program won't know about them. This is important
because I believe that the software company may have deliberately
targetted those people who are likely to have potentially illegal
material.
3) The program will proove the existence or non-existence of this file
on your computer. Note that the fact the file exists on your PC is not
conclusive evidence of a breach on your part.
In order for this program to work, I will need to establish the Hash
of the file in question. This will mean either specific co-operation
from the software developer, or assistance from any of you that may
actually still have this file.
*Note: This program will be provided free on a no win, no fee basis.
That is, my services will be paid for out of costs awarded against the
company if they take you to court and lose. If they don't proceed with
any action, then you don't pay. If my help scares them off, then
everybody is happy.
Having provided this service, I am then willing to make myself
available to act in any legal proceedings in order to give evidence as
to any findings.
Final Caveat: Remember I am not a lawyer, but a computer forensic
specialist. I can give evidence at court as to facts, but cannot
provide legal advice.
