Email Generation and the DPA by
Daz
Whilst I already know the moral answer to this question I am seeking
either advice or at least a link to somewhere that may have already
answered it.
The situation is this, we currently have a list of customers who have
purchased services from us in the past not all of them have email
addresses, in-fact very few of them do. The directors at my company
would like us in the IT department to run...

Non attendance at small claims hearing by
rolleston
I wonder if someone can tell me: if a claimant fails to attend the
final hearing at the Small Claims Court, and if as a consequence
the case is struck out -
a) is there a time limit on any possible resumption of the case?
b) can the defendant's expenses (solicitor's fees) be claimed back?
(The solicitor did not attend the court)
Thanks.

Barrier across road kills by
smicker
The local docks have always been used by all and sundry to walk
around, cycle around or even drive around. Lately they have become an
attractive re-development area and so the dock owners are trying to
stop folks driving along certain stretches of it by having a barrier
across the road (in the loosest sense of the word) lowered at night
time. The barrier is painted red and white but not lit and is...

Private roads by
John Rowland
Hi all,
I've seen a lot of signs recently declaring roads to be private. What does
this mean? Am I allowed to drive down it? If I crash or kill someone, will
the outcome be different to the outcome on a public road?
I have also seen signs, particularly guarding the car parks of small
pretentious blocks of flats, saying "No Turning". Has anyone ever been
prosecuted for turning their car on a...

NIP (Speed cams) - naming the named drivers by
dg
I have read up on the speed cam cases where by the owner does not sign the
NIP form, but...
What is the situation where the vehicle is not a company one, but is
registered to one person but used (exclusively) by a relative who is the
sole additional named driver on the insurance policy?
Does the registered owner name the named driver, but still not sign the NIP
reply? Or name and sign it? Would...

Deeds by
Nervous O'Toole
After over 3 weeks, and cheque for cleared, we still ain't got our
house deeds from the Alliance and Leicester.
We applied for their return before we had engaged a solicitor to '
speed things up' so they would be sent to our home address.
We were informed yesterday that if we had got them sent directly to a
solicitor, they could of been sent the next day, but as we had applied
to have them...

Contract Law by
Ian Snow
Background: a village "recreation association" holds in trust for
parishioners a recreation ground. It is a registered charity.
There has been a slightly acrimonious change of committee members
(trustees).
The main users of the recreation ground are a football club and a
social club. There were links (common officers) between these
organisations and the old committee.

Fake Stan Mould by
Scorer
As I predicted, some idiot has started impersonating Stan Mould.
It really is appalling - The poor chap gets ignominously kicked off
his ISP, then some fool mimics him.
The imposter is posting from AOL, so lets see if he steps over the
line, just as the real Stan Mould did.
The giveaway is that, while the imposter mimics stan's style
reasonably well (meaningless waffle), he isn't boasting, and...

Can you libel in private?? by
TX2
Can I libel, defame (or likewise) someone in a private letter to them?
e.g write a letter to a company, giving my opinion of what I think they
have done to get around an issue, which is potentially illegal under the
sale of goods act even though I can't prove it?
Or does the comment have to be made to a 3rd party which then
subsequently damages the reputation of the party concerned by...

Being spied on in work. by
Adam Owen
Hello there legal peeps.
I work for a retail company. There is a CCTV system installed which is
watched more or less consistantly. There are various signs up in work saying
that the store has CCTV which is used to 'protect our customers, staff and
stock'. After having a disagreement with the bitter and twisted CCTV
operator I have been told by several people that he has been watching me on
the...

Legality of Thermal printed receipts. by
Take a Walk
A lot of places today give receipts for petrol on thermal paper (like fax
paper).
As these effectively self-destruct by fading back to white in as little as
twelve months, a business's proof of expenditure could effectively vanish
well within the period that you are required to retain records for.
Is there anything in law to insist that retailer provide durable reciepts?

Software Updates and Patches / Sale of Goods Act? by
Lara
Hello UK Legal,
What is the law (UK EU) regarding software updates?
I have bought an expensive software product which has numerous faults.
The software manufacturer has fixed a number of these faults with free
updates but not all. The software is useable but not fully as
described in the manual - some functions simply don't work.

Parking ticket - invalid order? by
Bystander
Hence, I believe it's invalid. Does it sound like I've got a case?
And either way, if I do appeal does this put the timescale to pay on hold?
It's £30 within 14 days, £60 within 28 days, and £90 after that, but if
the
timescale isn't put on hold then I doubt I'd get a reply within 14 days.

Towing costs by
Paul from Bristol
My car was nicked last night and the kid who stole it crashed it into a
brick wall when the cops chased him. The car caught fire and is now a write
off and I do not want the ******* back.
The cops have just informed me that I will be liable for the costs of towing
the vehicle away. Have I got a couple of days to sort things myself or am
I obliged to pay for the towing costs?
Thanks in advance.

Fox stole my gardening gloves. by
Large Eddie
Anyone in uk.legal sued the RSPCA?
There is an RSPCA Fox Rescue centre up the road from me and I feel
certain it was an RSPCA fox that stole my gloves. They were brand new
and I think wildlife should learn to behave responsibly not skulk
around at night stealing things.
