If she claims certain benefits then she won't have any option but to go to the CSA, at pain of having her benefits reduced. Additionally, is the "asset" yours alone to decide on such a split? The rule of thumb for the CSA is that it is 15% of income for one child, 20% for two and 25% thereafter regardless of the number of children. Of course, in the real world it works out as more than that as by the time an assessment is made arrears will have accrued. Further, your ex may one day meet another man and want to settle down without fully burdening him with the cost of maintaining someone else's child - so any agreement that your ex makes now (to not involve the CSA) can easily be recindered. Any amicable agreement you reach should use those % as a guide since that is what she could expect to get from you if she involved the CSA. -- Robbie |
