Fireworks by Tx2
As the first of the 'November 5th' fireworks are let off in the garden adjoining my property this evening (and other bangs have been heard from further afield), I was wondering what (if any) regulations are in force over the letting off or possession of fireworks etc this time round? Much as I would like to see domestic sales banned, I doubt they will, so do any more recent regulations cover...

After Divorce - is my ex entitled to personal property? by Max
Hi My divorce was finalised a few months ago and now my ex-wife says she would like some of her things which she left behind - she didn't specify what exactly she was after. We didn't part on good terms (due to her behaviour) and I said that she can't have anything, since she had plenty of time to take anything she wanted before she'd moved out and since she didn't ask for anything after she'd...

EU lawyers in the UK by Marco
How difficult is it for lawyers (i.e. people with a law degree) from other EU countries to practice law in the UK? What are the possible ways for such a person to start working as a solicitor in the UK? Thanks, Marco

Final Pay From Employer by Bouffont
Hi All, I left my job under very "interesting" circumstances (long story short I was bullied out of a job). I recieved my final pay cheque and they had deducted 2 days pay. When I enquired as to why this was there they informed me that it was a mixup and that I was owed that back those days + 13 extra days I had remaining on from my holiday pay.

£30k charge against the ex-Mayor of Chard for sexual discrimination against Town Clerk by Nick
The former Town Clerk of Chard has been awarded £58k by an employment tribunal for sexual discrimination and victimisation. The ruling includes £30k to be paid by the ex-Mayor who was the actual subject of the complaint. I was unaware that the Employment Tribunal could make a financial "judgement" against an individual officer of an organisation - as opposed to the organisation.

Declaration Notice to Quit is invalid by tia
Hello everyone Does anyone know how to draw up a Declaration to have a Notice to Quit made invalid. I think that is the wording!!! Not even sure if this is the correct procedure!!! We have been fighting this since February this year and we now have to either shut up or take the landlords to Court. Is this something we could draw up ourselves, as the Court fee will be £300 approximately...

House and solicitor problems by a@b.invalid
I don't have much experience with house buying problems, both of mine have gone smoothly, but I'd appreciate views on the following situation bearing in mind I'm not in possession of all the facts. Person A is selling a house. Person B wants to buy it. They both have solicitors SA and SB respectively. B pays SB buy the hour. SA and SB have so far negotiated between them four contract...

Q: Company ID around your neck? by oO
Question: Can an employer force employees into wearing company ID (complete with RFID chip, name and photograph) around their neck at all times? Is not good enough to have this in your wallet? All advice very much appreciated. Thanks in advance.

Misallocation by awarding professional body by Nick
6 months ago I was informed by email with attached certificate that I had been awarded a Level 3 of a professional qualification (there are Levels 1, 2 and 3) which I applied for. I put this in my cv which I have widely circulated to recruitment agencies and sent when applying for jobs. Recently we were informed that the register could be inspected by anyone online to check on the...

Questions regarding house sale. by Comfortably Numb
I received a letter from the solicitor dealing with the sale of my house this morning. In the letter are a few points apparently raised by the buyer's solicitor. The points a 1) Have the neighbours on either side of the property raised any objections or complaints about the telephone cables crossing their property. No, the cables are BT phone lines crossing overhead from a telegraph...

Trademarks - software names by Rob S
Hi, Our company is thinking of naming its new software product. Let's say (hypothetically) to "Quetzalcoatl". I choose this because the name we wish to use is an ancient god. I need to look into whether we are infrigning any trademarks. I have checked on http://www.patent.gov.uk/tm.htm and indeed there are a few trademarks registered to "Quetzalcoatl", one in the relevant software...

Distance selling regulations by Simon Finnigan
Hi all, a nice question for you. I ordered some parts frolm a website, and changed my mind. I requested a refund under the distance selling regulations, and was told "No, we do not offer any refunds". My reply to them stated that they where obliged (as indicated on their own website, which mentions the DSR) to refund me my money upon safe receipt of the returned goods, provided the time...

Advertised prices - VAT by Offsider
A UK company advertises in a UK published magazine a product for sale at £X. I go to their website to order one, and the price is still £X. After entering all my details, credit card number etc, the final confirmation page comes up and the price is now £X plus VAT. Of course I can at this point choose to cancel the sale, but is it still legal for them to advertise the price ex-VAT in this way?...

mergering property titles by Andy
Have bought the house next to mine and knocked the 2 into one larger home. Are there any pros/cons to mergering the titles into one ? Is it _neccesary_? Is it worthwhile ? Are there any drawbacks in doing so ?

German Trademark Help by Stuart A. Bronstein
Does anyone know someone who practices (internet) trademark law in Germany? I have a client (in Scotland if it's relevant) that has a claim against a website with a confusingly similar name. Seems the holders of the domain are located in Germany. I believe the domain servers are elsewhere in Eastern Europe. If you can help or know someone who might, please let me know. You can email me...

alledged racist comment by ukdeejay
Hi I have been suspended from work due to a comment I made to a student. and i'm not sure if it is classed as a racist comment. The student was concerned that he would have to travel through a bad area of town to reach a place of work over the next few months. The class was in high spirits at the time, laughing and joking about thier individual placements. The student concerned is of Asian...
