Dispute with dentist by tonyjeffs
My dentist, P, is by far the best I've ever had. He does a minimal amount of work on my teeth, and does it well. Three months ago I lost a filling. P put in a temporary one as an emergency measure and set an appointment to replace it. He unfortunately became ill, and had to cancel two appointments. I finally visited to have the temporary filling replaced on the 29th Sept. The receptionist said...

Voluntary DNA samples by GeorgiePorgiePuddingAndPie
I have been asked by the police to supply on a voluntary basis 'familial DNA'. Over 20 years ago my father was interviewed along with loads of other people at his workplace about a murder. The police appear to have reopened the the case and because my father died years ago, I have been asked to supply the sample to 'eliminate' him. The policeman who spoke to me said it would not go on the...

Procedure for obtaining default judgment. by pnlend@yahoo.co.uk
I am the claimant and I managed to get the defense stroke out. I should like to obtain a default judgment by filling a request on the relevant practice form, pursuant the judge order. I understand this form is N225. My question is where do I insert the damages on this form.Should I add them up to the 'Amount of claim...' or use a separate sheet of paper? Many thanks for your help.

Leasehold management company by GB
I hold a long lease on a flat in N London. The leaseholders bought the freehold last year and took over management. There are around 100 flats in the block. There is a lot of urgent work to be done, possibly costing £7,500. A meeting of leaseholders was held, and it was agreed to raise only £750, and only about two-thirds of leaseholders have actually paid up. In the meantime, the block is...

does this youth have all the rights? by gormand53@yahoo.co.uk
This is mainly a rant, but also partly a request for any ideas anyone here might have. For two years now, I've been harassed by this youth who must now be 13 years old. I can't avoid him, due to the route I must take home. All the time, he pushes the boundaries to see just how far he can go with me. For example, yesterday evening, as soon as he saw me, he picked up a stone and hit me with it....

Turkey of a Washer Dryer - Trading Standards? by Neil Kay
Bought Hotpoint WD860 Washer Dryer March 2006 Dryer section broke March 2007 and Hotpoint/Indesit fixed it under warranty. Dryer section broke again July 2007 – engineering call-out confirmed via their Web site but no engineer turned up. Chased several times – pushed from pillar to post on phone and gave up. Lived with no dryer since then. As an aside, if you Google for WD860 problems, lots...

Executor Not Doing Duty? by ap088
My father wrote a will out appointing my brother as the Executor of the estate. The estate was to be split three ways between myself and my other two siblings. Whilst I got my share of the estate my other brother (not the Executor) decided he did not want his share at the time and asked the brother who is the Executor of the will to look after it. Now my brother is wanting his share from the...

Utmost good faith domain by Fergus O'Rourke
Sorry for the delay in reacting to the correspondence here, but I have been away for a while. Apologies for the ad. to all of those offended. As I went about my business, far way from Usenet, I do recall a slight ripple of anxiety that I might have posted to this newsgroup inappropriately, but it got drowned in the press of other concerns. I really am upset to have broken the rules so...

Computer company disabling a system remotely when contract not paid by Rob S
A hypothetical situation: A supplier of computer software threatens to remotely access a client's system and disable their accounts management software unless the client pays the ongoing support contract (the contents of which aren't available). This company have remote access for normal support purposes only. The software itself doesn't rely on remote access, or the support contact. Is the...

Sentencing as a deterrent by Steve Firth
Something that the judiciary, politicians and the press seem to agree on is that part of the purpose of the sentence handed down for criminal offences is to prevent others from comitting the same crime. If this is true, why is it so difficult to find out what cases come before courts and what the sentences handed down were? Shouldn't each court publish the names of the guilty, their crime...

employee problems by Mac[_3_]
Hi I run a small business and have an employee who has told lies about a situation where I had to send them home for being unable to do their job. They said that I had swore at them and they walked out, even though I have 2 witnesses to say otherwise. Would this be classed as serious misconduct and do I have the right to dismiss them?

Carphone Warehouse by rob499@hotmail.com
I'm posting this for a friend (yeah, I know, but this time it's true). She took delivery of a phone from Carphone Warehouse in January 2006. The phone was activated in early February 2006 on a monthly contract with a minimum of 12 months. She took out options for a text package and itemised billing at the same time. In February 2007 she was transferred to another tariff, with a £100 cashback....

Help with small claim please by Small Claim
I'll try to keep as many irrelevant details out of this as possible. I contracted with a customer in November last year to do some specialised modifications to an engineering component of his. When it arrived I spotted a fault with it which although not connected with my intended works made it unusable for him anyway unless it could be fixed which wasn't something I did in house. Long story...

Item ordered online missing, but proof of delivery signed by Adam[_4_]
I ordered a mobile phone from an Amazon marketplace retailer on 8/9/08. Proof of delivery was signed on 11/9/08 - certainly not by me or my household. I have asked the neighbours and they deny receiving any package. Clearly the only way this could have happened is if the postman knocked on the neighbour's doors given that none of my household were in and got a signature from them instead. A...

Shoddy work: what do I claim? by PHILIP WAGSTAFF
Double glazing we had installed has not been carried out to our satisfaction. I detailed our complaints over the phone the day after installation in July. At my request the company's inspector took a look. We've never seen his report but he told us he agreed with us and identified items we'd missed, but nothing's happened since. The DG firm now say they've given the original installation team...

Parking or not? by turtill@defmap.com
I have to rest if I drive any distance and so I have a van which I can lay down in. Yesterday in Camden I was resting in my van with the curtains drawn and when I resurfaced I discovered a parking ticket had been put under my windscreen wiper saying I had been parked from 9am to 9-25am and I had a fixed penalty notice penalty. I was displaying my blue badge but not the clock and the parking...
