'Banned' from a website by
Tommo
I heard a story recently about someone being 'banned' from using or
viewing a Company's website. This individual is not an employee of the
company, and the website is not one through which goods can be
purchased; articles posted etc. In effect it is the same as banning me
from viewing, say, the BBC News website.
My question to throw open to the group:
1. Is this possible? It isn't the same as...

Hello,
The following cases are referred to by some Inland Revenue literature.
I have obtained copies of the references but not being a lawyer, I
find them heavy reading. Can anyone explain these cases in layman's
terms to me?
To me, they look like findings that are specific to the facts of each...

Dispute with Holiday Company by
psychman
Hi folks
The wife and I took a cruise. Owing to mechanical problems one destination
out of five was omitted. I wrote to the company, who offered £346 in 'travel
credit' as compensation, to be used before end 12/07. Trouble is I don't
want to use them again. They are not ABTA members. What is my best way, if
indeed any, to get them to make a cash offer. Small Claim? and if so, for
how much?...

Copyright Licensing by
Mike
I received a letter today saying a poem, which my daughter (aged 12)
wrote at school, has been "chosen for publication in a book
representing the best of the pupils' work". The letter is from a
Vanity Publisher and I suspect it has been sent to every pupil's
parents. The letter asks our permission to publish our daughter's
work and offers us an opportunity to order copies of the book...

Not having a TV license by
GB
Someone told me that being caught not having a TV licence is a civil matter
and would not go on a criminal record. He then talked about 'coming up
before the magistrates' and 'civil offence' (which sounds like an oxymoron
to me). I disagreed and siad it is a criminal offence. Can someone provide a
definitive answer, please?
(My apologies for not googling first, as this has probably come up...

Responsibility for wrongly delivered goods by
GB
Once again, someone has delivered stuff to my office which is actually
intended for a shop the other side of London. The addresses are very
similar.
This time the goods consist of 3 very large and heavy cardboard boxes. The
tenants upstairs and with the best of intentions took delivery, but the
boxes are now cluttering up my office. The shop is closed at the moment,
presumably so the owner...

When is a contract not a contract? by
Cranky
Hi
My in-laws have been tenants for the last 40-odd years. For 35 years of
that they were private tenants, but the property was bought by a large
financial institution, though the tenancy was transferred and they kept
a 'protected status.' The rent has stood at (an admittedly ludicrous)
£50pw for some time.
They've been faultless tenants in the whole time, never a late payment,
or problem that...

Notice of Issue by
redwood
I've issued a claim against a Council to recover £60 costs (long story
involving an invalid PCN). The claim & particulars were issued in court
on 12/12/06 and I received the Notice to Owner saying that the claim was
posted 14/12/06 and will be deemed served on the 16/12/06. It says the
defendant has until 02/01/07 to reply.
I don't know how long council's shut down over the xmas & new year...

Lodger Evicted with no notice by
craig.armitage@yahoo.co.uk
I rented a room from a distant relative. She rents the flat from a
letting agents. I moved in on a Sunday night and we verbally agreed the
deal. I pay 120 quid a week, I get my room plus use of bathroom,
lounge, TV, kitchen, fridge etc. and electricity and council tax are
paid for. (She never mentioned phone bills so as is normal I expected
to pay for these) Anyway a pretty standard lodging...

Car Insurance by
Kathy Tring
I am concerned about the status of a neighbour's car insurance.
He has an old N reg banger which he has insured. He also has the use
of a more recent higher power BMW which he drives more than the
banger. ( I do not think that the BMW is specifically insured for him
to drive - in fact I think there is no insurance on the vehicle at all
as he has been pulled by the police on an insurance...

Spammer signing me up for mailing lists by
Martin
(site soon to be published - over the weekend)
Thanks to everyone who replied to my post 8 months ago regarding whether
I could publish a website right away before a court case, I took your
advice and kept my head down.
Let's take a hypothetical case for now.
Say I take a UK spammer to court and win nominal damages.

Depositing wills/codicils at the High Court by
Daytona
I was intrigued to see that you can deposit wills and codicils direct
with the High Court for £15. Given my personal experience of the pain
and suspicion that can arise when a will can't be located or there is
the suspicion that a will has been superceeded, is filing the will at
the HC a sensible thing to do ? If the system works correctly would
any unknowing executors/administrators be...

Summons: a query by
RM
It's like this:
I received a summons not very long ago (date of court hearing
5/1/2007). The summons was dated 2/11/2006, but it wasn't delivered
until 2/12/2006 with a handwritten instance of my house number in large
letters on the front; I didn't get it until 6/1/2007. The summons came
from Manchester, but somehow got a Chester postmark dated 1/12/2006 -
my hypothesis is that it got...

Give up your licence and we won't prosecute. by
Alasdair
I heard a story this evening which rather surprised me. A woman was
caught by the police for driving while over the drink drive limit. The
police apparently told her that they would not push for prosecution if
she surrendered her driving licence. She did and was not prosecuted.
Is there any legal basis for this type of agreement? If so, how long
does she have to wait before she can appy to...

Selling an item left for repair by
Harris Tweadie
Just over a year ago someone left an item to be repaired at the shop I work
at. About six months ago he came in and asked how much he owed, I told him
the price and I haven't seen him since. He was given an estimate before he
left the item. I had to pay out for the repair and need to recoup the costs.
How long do I need to wait before I can sell it?

Offer and Acceptance by
The Todal
Maybe this is a bit specialised, but it is still interesting. Consider this
scenario: a claimant is pursuing a claim for personal injury, worth quite a
lot of money. Defendant makes a settlement offer. The trial date is very
close.
Claimant's solicitor asks defendant's solicitor: are you willing to increase
your offer? The answer is no.
Claimant's solicitor sends a fax to defendant's...

New law re ageism by
JanieB
This is a follow up to a previous thread. Until I can post to usenet
I'm stuck with Google
I have got a job. I was told it was Temp-Perm. But the job has been
advertised externally. Only after I had been there a couple of days.
As it is a privately owned company there is no rule as to a job having
to be advertised outside the company. I have to say that the chap I
will be covering in the...
