Police not revealing whether they will prosecute in RTA by Daytona
I enquired about whether anyone was being prosecuted after a RTA (I was not involved) and received the following response - "As for any prosecution I cannot say.I am sure if there is one you will read it in the local news as we cannot give this information from this office" Not knowing the procedures - is this reasonable, or am I being given the brush off ?

Limitation Period in Scotland by Tommo
I am trying to find out details of limitation periods for contracts subject to Scottish law. Lest I be accused of not doing my homework, this is what I have been able to establish: - The applicable Act is the Prescription and Limitation (Scotland) Act 1973 - This sets a limit of 5 years from when the innnocent party became aware of the breach, with a long stop of 20 years. So far, so good.

Data Protection? by Debbie
HI, My 23 year old son cancelled an Orange mobile phone contract and took out a new Vodaphone one at a Carphone Warehouse store in August 2006. When he didn't get a bill for 6 weeks, he tried to check his bill by phone and online, and was unable to access his account. It turned out that his phone had been linked to his stepmother's Vodaphone account. She is (let's say) Mrs Belinda Green, date...

Future employment restriction in job contract by Marco
My wife's employment contract has a clause which can be interpreted (the wording is not very clear) as saying that if she leaves the company she cannot work for a competing firm for a period of six months afterwards. Would such a clause be legally enforceable?

Car accident - disclosure by Ste
I have a question regarding disclosure. Briefly I was involved in a car accident back in February, where I was run off the road by a minibus. The driver did stop, but made off without providing his own name or address - he provided only his company's name and address and their insurer's name. Anyway, I was able to contact the insurance company and they were able to trace the driver and get his...

refuse by Paullie
Hi I am looking for some sort of advice. I live in a residential apartment block, with the landlady who lives on the ground floor owning all of the flats in the building. The local authority requires waste to be recycled, so provides us with 3 different sort of bins. According to the local authority, these are +per household+ but we only have 2 bins of each sort outside out premises. This is...

FENSA certificate by Comfortably Numb
My buyer's solicitor has asked for a FENSA certificate for the double glazed windows in my home, I don't have one. The windows were fitted during a council run regeneration scheme in 1999/2000. I have spoken to the people who ran the scheme and they informed me that FENSA certification was not introduced until 2002, surely this certification cannot be granted retrospectively? Can the buyer...

Compensation from Supermarket by Jackie
My husband sustained a leg injury due to slipping on a broken egg in a large local supermarket. I wrote to a Chief Executive of the Company and it is now going to their legal department. This accident happened in August and he is still having physio treatment at our local hospital. It stopped him doing longer car journeys due to the pain whilst driving and he has been in a great deal of pain...

COMMON LAW WIFE - any rights? by duncan@feste.plus.com
I have only recently got to know my younger sister, Jay. She is 41 and I am 50! Our parents split up before Jay was born, my father taking me and my older sister to live with him, leaving our mother to bear and bring up Jay on her own. From there on the children in the two halves of the family partook of their parents' enmity. This had no practical effect till Jay was about 10 as we had no...

County Court/Small Claims by the Omrud
Some questions about what happens when a private individual is sued in the County Court by a business, for a small amount (less than £300). The case relates to a private car park in which a person parked, not noticing the signs which stated that there would be a Penalty Charge of £50 for staying longer than 3 hours, and rising by leaps and bounds if the payment is not made promptly. I...

Insurers by hadley
Hi, looking for any advice or experiences regarding a problem with getting my car fixed after someone ran into the back of me. She has admitted it was all her fault to her insurers (I was stationary at traffic lights and she hit me hard enough to write her own car off. My towbar took the brunt of it so not too much obvious damage to mine). Both of us were fully comp. My car was fine before...

Sat, 11 Nov 2006 15:05:02 uk.legal.moderated Am I right in thinking that, though this act was passed in February, it has still not been brought into force? And that, if it had been, it might have made the Archbishop of York's attack on "illiberal atheists" illegal? http://news.bbc.co.uk/1/hi/uk/6138486.stm

Finders Keepers ? by The Caretaker
Hi, Seen this question asked a couple of times, but this is slightly different to others, I think. Found a bunch of keys, wallet with cash in it and a mobile phone, but absolutely no references to identity anywhere a while ago, and handed them in to Police and told to wait a while. In due course they said no-one claimed the keys phone or money, it was

Will cost's? by Mr S Topp
My wife and myself need to make a will (joint will?) and as we have never before done so we have no idea as to the cost involved. As with other things in life I imagine the cost of the will, will very in price due to its constituent parts but is there anywhere we could get an average cost for a joint will preferably on the net. Thanks Steve Topp
