Claiming back costs/expenses for invalid PCN by fred
In July while on holiday I was issued a parking ticket (PCN) by the council but the PCN did not comply with mandatory requirements of the 1991 Road Traffic Act and was therefore invalid and unenforceable. To cut a long story short, many letters passed and the Council refused to back down and only cancelled the PCN at the last moment, stating "technical issues" as the reason for...

Is ex wife's mortgage transferable? by john boyle
In message , Postman Pat writes Currently I am paying a £100k mortgage on my ex wife's house, current value about £1M. 18 years to run. The mortgage payment is described in the Consent Order (yes, I did have a CO drafted properly) as spousal maintenance, so if she remarries I stop paying the mortgage. It was a...

Consumer vs retailer and credit card company by Tx2

Buying flat in London by Ruth Hughson
I live in Scotland so am not acquainted with English law. Flat for sale in London - put in offer which was accepted - got a survey done which said there was a bit of damp around one of the windows. In Scotland it is the responsibility of the present owner to have this attended to either by having the work carried out or alternatively having a survey done paid for by the present owner and...

Bankruptcy - recovering hidden property by Richard
Someone who owes me a reasonable amount of money, (which he currently has available), is telling me that he owes someone else £100,000+/- and that they are making him bankrupt, although he hasnt actually been made bankrupt yet. He received this money last Wednesday but tells me that, because he has received some papers regarding the bankruptcy petition, he cannot give me the money. Some 12...

I sometimes have to access pornography at work! by Tx2
I am a system admin in a large 'organisation' where most of the users are under 18. We have certain rules in place regarding internet access; the usual 'suspects' are not to be accessed such as porn, drug culture, terrorism and so on. I have this policy as part of my contract of employment. However, in the course of my administrating this network, certain web sites which have been accessed...

Disclosure rules by Mouse
wrote: Hello, What are the rules of disclosure? I know both parties must exchange documents no later than seven days before a trial, but what happens if one party objects to certain evidence being included? It seems to me that if you could object, then everyone would object to everything and no evidence would be submitted. Thanks.

On Thu, 19 Oct 2006 19:26:44 +0100, John Smith put finger to keyboard and typed: I recently bought some goods for 240 pounds which arrived faulty. SOGA: Excessive time for repairing item. by Mark
Hello, My TV had a fault and was sent away for repair. It is 3.5 years old and is covered by a 5 year extended warranty. It was an expensive set when new. It was away for about 6 weeks (I was originally told 1-2 weeks). Do I have any case for compensation? The remote control was also broken and that was returned unrepaired. I had to pay a "collection" fee as the warranty was parts and...

Neighbour plans extension on previously subsided land by S.C.
I have learnt from word of mouth of a mutual friend that my neighbour is planning an extension of their building on land that has had subsidence problems in the past. If any work is to proceed, I would like to obtain written assurances from a structural engineer that the extension would not exacerbate the subsidence problem. Furthermore, I would like some insurance against subsidence damage...

Stabbing someone four times is not attempted murder. Visiting someone's home and turning on the oven and four gas rings in an attempt to poison someone is not attempted murder. Putting a gloved finger into someone's mouth is attempted murder. http://news.bbc.co.uk/1/hi/uk/6050920.stm

Fireworks by Tx2
As the first of the 'November 5th' fireworks are let off in the garden adjoining my property this evening (and other bangs have been heard from further afield), I was wondering what (if any) regulations are in force over the letting off or possession of fireworks etc this time round? Much as I would like to see domestic sales banned, I doubt they will, so do any more recent regulations cover...

can anyone advise me please? After Divorce - is my ex entitled to personal property? by Max
Hi My divorce was finalised a few months ago and now my ex-wife says she would like some of her things which she left behind - she didn't specify what exactly she was after. We didn't part on good terms (due to her behaviour) and I said that she can't have anything, since she had plenty of time to take anything she wanted before she'd moved out and since she didn't ask for anything after she'd...

Final Pay From Employer by Bouffont
Hi All, I left my job under very "interesting" circumstances (long story short I was bullied out of a job). I recieved my final pay cheque and they had deducted 2 days pay. When I enquired as to why this was there they informed me that it was a mixup and that I was owed that back those days + 13 extra days I had remaining on from my holiday pay.
