A Crime vs Patient Confidentiality by
BobC
"A friend" who works for in the medical profession told me about a
patient who arrived for an appointment. He asked for his name, but as
he was foreign couldn't understand it, so asked him to spell it. In
response he offered his driving licence to copy it from.
But on seeing the licence, the picture was nothing like the person
presenting it. In fact not even the same skin colour!
I said "Well I...

Credit card accounts and continuous authorisations. by
Adam Funk
According to a recent article in The Guardian, Nationwide's credit
card customers are all getting replacement cards with new account
numbers, and customers who pay subscriptions with their cards
...will have to tell each of these companies their new number. They
will also have to change details on any bank accounts used to pay
credit card bills each month - including those with...

Negligence - assessable damages? by
H
Can anyone help me what the term 'assessable damages' can include in
relation to a negligence claim concerning a 14 yr old boy with learning
difficulties.
Could the term include expenses incurred by the parents, e.g. Home tuition
and home cleaning costs (incurred by the need for his constant
1-to-1supervision) while child is unable to attend school?
Would it make a difference who paid, i.e....

Indemnity Undertaking by
Dumpedon
I posted this on the other forum by mistake so my apologies if you have already read this on there.
Eleven years ago I was a director of an IFA company. We were in a network who took the commissions we were due and paid us out after taking their cut. Many of the commissions were on indemnity terms whereby we were paid the first 4 years commission up front but there would be a clawback of...

Legality of email v paper correspondence. by
Invisible Man[_2_]
I am having correspondence with my employers whilst I am off sick.
Hopefully not but could end up at an employment tribunal.
I tend to use email but they tend to send the main stuff on paper.
Is email accepted as readily as paper by courts and tribunals?

Dangerous Dogs Act 1991 by
5 Wheels
A persons puppy was attacked and injured pretty badly by 2 unleashed and
unmuzzled Rottweilers in a public place.
The police are reluctant to bring charges as to quote, ' The Dangerous
Dogs Act 1991 states that it is only dangerously out of control when a
dog attacks a PERSON'.
Reading the act this seems correct but this surely can't mean that no
offence is committed when 2 Rottweilers off...

Bus lanes and ambulances by
Adam[_4_]
Whilst at dinner tonight, someone raised the matter of their daughter
pulling over the side to a bus lane to give way to an ambulance with
sirens on. The daughter then got a fine with a camera picture of their
car, which unfortunately did not have an ambulance in the picture.
Unable to confirm her story of an ambulance causing her to pull over
to the bus lane, she paid up the fine.
For future...

Employer Acceptable User Policy/Email disciplinary - help please? by
bluefizz@zoom.co.uk
Hi
I have been asked by a colleague to act as a 'friend' at a
disciplinary hearing. I have never done this before. The colleague is
not a union member. I understand the colleague received an email
deemed unacceptable by the employer. The colleague has only forwarded
it to his own home email address to himself and to no one else. I have
yet to see the email but I understand it consists of a...

Can the police help me trace a thief who bounced a cheque? by
John Doe[_3_]
Hi all,
I was hoping you could help me with this problem:
about 15 months ago my landlord stole my deposit: he gave me a cheque
that bounced. I sought help from lawyers, but they all said it wasn't
worth suing as the amount was relatively small compared to the fees
I'd have incurred.
Now I have changed job and a colleague, lawyer, has offered to help. I
do want to sue the thief who stole my...

Questions about a will by
worrieddaughter
Hi,
My father and step-mother made identical wills - with the first to die leaving everything to the other and the surviving spouse to leave everything split between the children on both sides.
My father died six months ago. My stepsister and I are now executors for my stepmother's will. Unfortunately, I have very good reason to think that my stepmother is planning to change her will.
Firstly,...

Divorce in England (for an Italian couple married in Italy) by
Mario Rossi
Hi all,
I was hoping you could help me understand what would happen if a
couple of Italian citizens, married in Italy (in a city hall: no
religious marriage) but resident in England, were to divorce.
Which court would have jurisdiction: the English one, as both reside
in England, or the Italian one, as they are both Italian citizens? If
there are assets in both countries, would one court have...

Police helping defence by
a@b.invalid
This question is obviously triggered by current events, but I'll try to
keep it hypothetical.
Part of a police constable's job is to investigate crimes, gather and
analyse evidence in the interests of justice.
Not only that but the prosecution has a duty to disclose all relevant
evidence to the defence.
Given those two assertions, I can't see how a police officer revealing

Small claims procedure - can I include a girlfriend? by
Trent SC
I am in dispute with a former colleague to whom I had given some work and
paid in advance. The work was not done and it was necessary to cancel the
commission and place it elsewhere. I am seeking the return of the advance
and intend following the small claims court procedure.
My question is this: for previous projects, I paid the funds into the
defendant's girlfriend's account (he had...

Issues with Social Services - 2nd attempt at posting by
H
A family I know appear to be being very much let down by social services.
The family, a mother and two sons, all have learning difficulties. The older
son has just turned 19, the younger will be 15 in September.
I think the older child has a diagnosis of Cerebral Palsy and though having
no obvious mobility problems clearly has behavioural problems.
The behaviour is so bad that he has wrecked...
