) gurgled happily, sounding much like
they were saying :
The boy concerned lives with his mother - I am divorced - and he is
much closer to her than to me. However I have to have him at my house
a few times per week otherwise she will bar me having the other one
also, and the other one is fine and we have a very good relationship.

Smacking children by
Fred
I was led to believe that smacking children was virtually outlawed where any
smack leaving a red mark or eventual bruise was a criminal act.
Am I wrong?

A 13 year old child stealing from parents by
Gareth Hardy
I have a serious case of this. Can anyone offer any suggestions?
The way my Dad cured me was to check my pockets after I'd gone to bed, leave
some counted loose change in his jacket pocket, then check again just before
I went to school. He made sure it wasn't because I was being bullied, then
slapped the evidence down in front of me and said "I hope you enjoy it". I
still cringe with the...

A 13 year old child stealing from parents by

You're on a hiding to nothing here, looks like the kid is going down
the wrong way and you're unlikely to alter that, leaves you with two
questions.
1/ how much more stuff are you prepared they steal?
2/ how clear would you like the responsobility gap between yourself and
the inevitable disaster area that this child's life will become?
There is no connection between you refusing to have a...

Can forming a Company significantly reduce personal liability? by
Mike Arnold
Our private road is run as an unincorporated Association, which I understand
has no legal existence of its own. I further understand that liability for
any breaches of the law would fall personally upon those responsible e.g.
committee members who administer the road on behalf of residents.
There is a proposal that we form ourselves into a Company Limited by
Guarantee. Such a Company does have a...

Replaced faulty new item with 'reconditioned'. Legal? by
Kit
Simply: Can a supplier replace a faulty new item with a
'reconditioned' item which had gone faulty for another customer or must
they replace it with new?
More detail:
The hard disk drive in my digital satellite TV box (bought in April)
failed last week. Three days later the engineers came and unable to
fix it they replaced the box. The replacement box was also faulty
(dead modem). They put...

Pension and opting out by
Mike Burton
On Friday I got a letter from my pension company saying that due to an
oversight, they had not opted me out of SERPS. (think it's called something
else now).
I started my current fund in 2000 and requested to be opted out in 2001.
They were unable to do this because of my previous pension scheme, but could
have done so after May2001.
They have said sorry in the letter to me, and have asked if I...

Name and shame by

Someone told me in the pub today that a newspaper had named three
magistrates who bailed a defendant who went on to commit a murder. Does
anyone know which paper, and whether the item is on the Web?

Road Side Drains Liability by

I have two questions:
Background
Near where I live there is a road which is prone to "flood" due to the
road side drains being blocked and not taking off the excess water.
The water will be about 6 inches deep after a heavy downpour - which
is not unusual. I believe the problem being purely down to the fact
that the local authority no longer remove debris/dead...

I wonder if I can get some advice on the following possible marriage split

Could I expect to receive only half of the house we own - or would this
inheritance of her's also be factored in. After all she's been living off

Lettings agent - is this normal practice? by

Would anyone like to comment on the following scenario and how I should
approach the estate agent in the morning?

received confirmation letter that "confirm the acceptance of my offer" and a
further one simply stating that my references were satisfactory and that I
would be hearing from the shortly. Estate agent said that...

on the web (www.flyingdays.co.uk) for Christmas, I paid using Mastercard
The voucher had a 12 months validty and my son was planning on using it in
October, however last week I received a letter from the company which read:

What are "dependent children" by
Nick Atty
Is there an established age, or state of employment, or anything else,
at which children stop being dependent?
For example, if a contract of employment says "we will relocate you,
your partner and any dependent children at our expense" what does it
cover.
Obviously it covers three year olds, living with you, and doesn't cover
40 year olds with their own houses, jobs and families. But where...

how to stop a charity from forming by

I'm part of an organisation that has developed uncomfortable cult-like
attributes. One reason I'm not immediately walking away is because I
know I'd be leaving a lot of vulnerable people behind me. It's trying
to become a registered charity. I'd like to stop it. My guess is I
have to look up on the web how one has to become a charity in the
first place, find out what the procedure is, and then...
