Right of Access to Rear of Property by Keith
Hi My son and his fiancee are in the process of buying their first house. The property is one of the middle 2 of a block of 4 terraced houses built around 80 years ago. Originally the 4 properties were occupied by the builder and by his sons/daughters and clearly no thought was given when the deeds were drawn up to potential problems in the future regarding access to the rear of the 2 middle...

Does UK Govt have general immunity re cost impact of legislation (aviation) by Cynic

Barclaycard's new policy by Alasdair Baxter
I've just had my barclaycard statement for August 2005. I notice that they have done away with giving Nectar points on card purchases and are offering free travel insurance instead -- that is, unless you're over 65 years of age which I suspect a very large percentage of their customers is. Surely this is very unfair especially in the modern climate of anti discrimination. I understand that...

Companies Act 1985 by Alasdair Baxter
Please, can anyone tell me if the full text of the Companies Act 1985 is available anywhere online? I've tried Googling but can only find extracts from it. -- Alasdair

Pedestrian or Cyclist? by Bongman
Hi all This subject has been bugging me and a colleague for quite some time: When a pedestrian either walks out in front of a cyclist, or is walking on a designated cycle track, who is at fault if the pedestrian is hit? Is it a criminal offence? The highway code seems to suggest it would be the pedestrian in the wrong, but what if the cyclist doesn't attempt to avoid the collision? Or the

Where did the £15,000 come from? by Alasdair Baxter
According to press reports yesterday, the Metropolitan Police paid a sum of £15,000 to the de Menezes family for the repatriation and burial of Jean Charles' remains. Does the Met have a "Mistakes Fund" to cover such eventualities? -- Alasdair.

capital gains tax on land by Adrian Brentnall
Hi All Wonder if anybody knows about capital gains tax ? We have a bungalow with some land - part of which is a paddock. Our next-door neighbour has expressed an interest in buying the paddock - but somebody (? maybe an estate agent ?) suggested that selling the land separately from the property would incur CGT. Is this true - and how much are we looking at (say on a sale of £25k). Thanks in...

Stroppy student by squibble@wibble.com
Fortunately, this isn't my problem, but I'm curious about the legal position. An undergraduate student by distance learning at a uk university has had an essay marked down partly because it is significantly over the word count (and partly because it's not a very good essay). This is the third time the student has been so penalised, by two different markers. All the other essays by this student...

Conservatory guarantee (again) by bigbrian
I posted on this issue before, but the probloem went away so there was never any need to act on it. Its becoming increasingly apparent that there is now such a need Basically, I had a conservatory built last autumn, and its apparent that the built-in heating unit is unacceptably noisy. Since its installed in a custom sized hole in the brickwork, rejecting it for a new unit would involve...

How to ensure wife inherits all estate by Julian
I owned my house outright when I was married three years ago. I had a chat with my solicitor, who told me that it would be quite expensive to change the Land Registry records to add my wife as joint owner, and it really wasn't necessary because the value of my estate was such that she would receive it all anyway, even without a will. He was happy to do the work and make a will for me if I wanted,...

Can a private letter from employer to employee be defamatory? by dikvee@gmail.com
Hi all, I was recently told that my 6 monthly probationary period of employment would not be renewed. I asked for clarification of the reasons and was given a letter stating the employers "key concerns". I am aware that I have no case for unfair dismissal. I feel I deserve a retraction of the letter. What I need to know is; can a letter between employer and employee be classed as libelous? If...

Online advertising income - register as self employed. by loftx
Hi All, I read today that you must register self employment with the Government regardless of how much you earn. I was just wondering exactly what constitutes as self employment - I make money through my website in three ways: I display banner advertising on my website through Google Adsense. I also sell advertising space to companies in my field. I receive donations via paypal.

VAT on software by Alasdair Baxter
I was interested in buying a malware removal program which was quoted at, say, $25 on the American publishers' website. The software would be delivered by download from the American site. As I was going through the payment procedure, it asked what country I lived in. When I put in UK, a charge for VAT was added. If I entered Afghanistan, there was no charge. Two questions arise immediately....

Employers Duty Of Care to Employee - Defamation by Sixties Man
Does an employer have a duty of care towards an employee covering acts of alleged defamation? An employee is claiming that his employers must pay legal fees for him to pursue a case against a third party, who allegedly made defamatory statements against him in his professional capacity.

Parish council meeting by Chris Street
A local village which I drive through on my daily commute is holding a parish council meeting regarding proposed speed humps on the road. Firstly even though I don't live within the parish can I attend this meeting? Secondly is it possible to obtain information from the police/council about the traffic levels and accident rates/speeding rates on said road at all? From what has been said it...
