Help with difficult neighbour and restrictive covenants (property) by
Peter Mulloy
I have a neighbour who is complaining because I have friends round (about
once a week), its part of a small church prayer group, she says she finds
this annoying.
She has found the following restrictive covenant which applies to all the
properties on the development as part of a scheme, which I understand are
mutually enforceable
"Nothing shall be done or be permitted to be done upon the...

Fined without hearing by
David J
Actual situation.
An alleged minor road traffic offence. The driver elects not to pay
the Fixed Penalty but go to court to argue the case.
A Summons duly arrives with instructions to the driver that if he
elects to plead Not Guilty he should ignore the hearing date quoted
and await a new date to be advised.
While waiting for this new date, a letter arrives from the court

Asbo madness (again) by
Jo Lonergan
The following Asbo, served on a homeless man, was quoted in an article
in today's Guardian. I'm surprised that any magistrate would have OK'd
such a document (but IANAL).
Who actually decides what the content of an Asbo will be? And who
draws up these things? This one looks like a complete botch-up to me,
(items 4 and 13 seem particularly odd) but again, IANAL.
Is it necessary to list behaviour...

Covenant on Property by
JohnD
Hi All.
I have a covernant on my house giving me access to a courtyard. So do all
the houses round the yard. The most of the yard is part of one property, if
you get the idea. New people in the courtyard are stirring things up by
making demands about this and that to do with parking. I was wondering
which court one would go to if things got realy bad? I was also interested
to know if it was...

Late night music from other tennants by
Mick
Hi all,
I have lived in a Housing Association flat for five years and have been
happy with it up until now.
It is a block of 30 flats, built around 1960 solid 9" walls but no noise
insulation.
The Housing Association, has noise reducing rules, one is that noise should
not be so high it can be herd outside the flat after 23.00.
There is one tenant two floors directly below me that seems to lead...

Treason or not by
Nobody
I see it is reported that Lord Faulkener has stated it highly unlikely
that treason charges could ever be levied against those like Omar Bakri.
Is this because Treason is not appropriate or because the Government
would not have the stomach for it.
Is there a legal reason not to charge treason

Waste water drainage pipes by
Ian Cornish
I live on a hill, and the property behind me (higher up the hill) has a
waste water pipe running through my property. None of my waste water
drains use this pipe. I have an inspection cover/hole on my property.
The house behind me, according to the deeds, was not planned when mine
was planned, but planned soon after. The drain pipes do not appear on
any of the documentation.
Who is responsible...

they were saying :
Would the council be covered if they offered Male Only sessions as
well as Female Only sessions?
Can you imagine the response "Men Only" sessions would get?

Legal definition of (un)authorised by
talltim@hotmail.com
I was reading the 1990 Computer Misuse Act. May time is refers tot the
unauthorised use of computers etc. However it doesn't define the word
unauthorised.
For example
Computer misuse offences
A person is guilty of an offence if-
1.b. the access he intends to secure is unauthorised

The front lawn has been given absolute minimal attention but the rear is =

Is there anything which can be done to address the problem of the overall

Water Supply by
Can anyone assist please?
The story so far...
I live in one of three houses all with a shared drive. This shared drive is
owned by us all.
The external stop cocks for all of our properties (we each have 1 each) are
located on the main road. Apparently the supply then continues along a
public highway (a track/byway) and then turns left onto our private drive.
There is a leak in my supply pipe...

punishment for crime by
Gaz
Questions about difference in juvenile punishments, and adult punishments.
If a juvenile committed a serious crime, such as rape or murder, say he was
fourteen at the time of the offence, and by the time it became uncovered he
was 15, would the punishment be different, if the same crime was not
uncovered until the boy was an adult???
So, boy kills at 14, uncovered at 15, and sentenced,...

Parking query by
Gareth Hardy
This weekend, in Whitby, a whole load of temporary parking restrictions went
up along the sea front and on the one-way system through the pier road. This
was to accommodate the attractions surrounding the regatta that is held
there annually, The restrictions were imposed by virtue of yellow police "No
parking" cones. There was no other warning, advance or otherwise, that such
restrictions would...

Job vacancy - positive discrimination by
Wireless Reader
We recently advertised a job (on-line with the government job centre).
This yielded a good response and we were reviewing all the CV's against
a strict set of criteria so as not to discriminate. Then a few days
later we got an email from a third-party supporting an earlier
application by Mr Y.
It inclued this:-
"I am writing to you on behalf of my client Y who has applied for job X

What's the limit on insurance and MOT when renewing road fund? by
news
Very soon I will be renewing the road fund licence on my car. When I do
this, there will only be a few days of validity left on both the
insurance and the MOT. What is the minimum time that must still exist on
these documents before the Post Office says "They have almost expired,
you will have to renew them before I can issue the road fund licence."

Local Authority Single Status Pay Agreements by
Fat Freddy's Cat
Some of you may be aware or involved in the above.
Basically, I am not a union member and was wondering the legality of the
local authority employer basically imposing a whole new set of terms and
conditions, including pay, that I may not agree with?
Can they do this?
What would it take to challenge it?
By way of background, the local authority I work with has about 20,000
