Suing someone who dies before judgement can be obtained by dr_who
A company is suing an individual who is married and whose principal (if only asset) is a house held in joint names with the wife. Their plan would appear to be to obtain judgement, and then obtain a charge on the house. Q1. Bearing in mind the house is in joint names, would a charge be granted in respect of a debt owed by just the husband? Assuming that the company would have obtained...

Consumer Protection (Distance Selling) Regulations by elziko
If I cancel a contract under the Consumer Protection (Distance Selling) Regulations and return the goods, can the supplier charge a restocking fee (in my case it will be 5% if I go ahead)? It sounds like they may be able to in 14(5) of: http://www.opsi.gov.uk/si/si2000/20002334.htm where it states:

Bank cheque clearing in the UK by Mick
If a cheque I paid someone for goods was banked, on a Saturday morning in one of the main name banks in the UK, when should it have cleared by enabling the goods to be sent? I am trying to find why the goods have not been received, Thanks, Mick.

3 people buy house as joint tenants and all named on mortgage, with the deed stating the following - ' the purchaser shall hold the said propoerty on TRUST to sell the same with power to postpone....until sale upon themsevles as joint tentants ' - thus we persume joint tenacey of 'equal shares'. Historic news pictures now smudged out by Daytona
I noticed in the ITV lunchtime news that pictures of the 2 alleged bombers coming out of the flat have now been 'smudged' out. The original pictures where widely shown unaltered. What's the point of this ? Also I was surprised to see pictures of Robins Cooks wife leaving the mortuary after identifying her husbands body on Channel 4 news last night. Wasn't there some law/guideline that said that...

Duty of Care? by rads
Good afternoon group. My first post, and having failed to find an FAQ in the archives, I hope my etiquette is acceptable (even if my spelling is not!). My car is having some cosmetic bodywork done under insurance (big insurance company and their preferred nationwide repair agents). Just had a phone call to say that whilst the car has been with them, the engine has developed a "heavy knock"...

credit card authorization by jsmyth1969@gmail.com
Hi there, I realise that car rental companies, hotels and similar types of companies may legally post-add additional charges on credit cards. Is this the same for all businesses? Eg: I buy a bath for =A31000 including fitting. I know that I need to pay 1/2 the amount on delivery, and 1/2 upon fitting (not the same day). So the company asks for the 50% deposit by phone and I give my credit...

Posting Links by jakewc2
Hi, I have just found this group, and just thought I would say Hi, and wondered if somebody might be able to answer me a question. I was wondering if anybody knew where we stand as far as linking URL from one site to another. Are there any laws that I should be aware of? Can a person take legal action against you for linking to their site? Thank you for your help,

insurance broker amends cover after taking payment by Dr Zoidberg
I recently insured a bike with a broker who agreed cover and took payment. 6 days later they phoned up to say that they couldn't now do third party fire and theft , just third party only , and would be refunding the difference. As I didn't want just TPO cover I demanded a full refund and said I would go elsewhere. As an aside they didn't want to do this at first and started coming out with...

Local authority advertising jobs for Internal Applicants Only by BrownIssue
Thank you all for your assistance on my last question. I have another, if I may be so bold. I keep hearing acquaintances telling me of their employer advertising posts internally and marked "Internal applicants only". The employer is a local authority. Apparently, most of the jobs are marked this way. It has been suggested this is not the best way of finding the best person for the job. It...

What is this doing in the courts? by bigbrian
http://www.sky.com/skynews/article/0,,30000-13399061,00.html I have no sympathy wtih idiots who make jokes at airline check in and security desks about having bombs in their luggage. They deserve what they get. But this girl sent a joke text *to her friend*, who then decided off her own bat to tell the police. "communicating false information with intent " - intent to do what, exactly?

Posts with ASCII notation in UKLM by Helen
A number of posts from this group are appearing in my newsreader (OE - I'm sorry!) with pseudo ASCII code in place of end of line and £ signs. An example is the OP by Martin in the 'Trouble with tenant' thread. This happens with only a few posts, does not appear to be thread related, does not happen at all with other groups and has just started in the last few weeks in this group. Does anyone...

help with ownership of a car by qvc
In March my Son advertised his car for sale and thought that he had sold it. The buyer had given him a Bankers Draft and two forms of identity which all turned out be false. Needless to say the address wasn't genuine. The insurance don't want to know as my Son had handed over the keys, the chap who took the car sold it to a dealer next morning with a forged log book before we had found out the...

making a will in anticipation of marriage by Robert
I believe that marriage automatically revokes all previous wills of the couple, so they should make new ones as soon as possible afterwards. I seem to remember that there is a form of words you can use in a will so that it is not revoked by an anticipated marriage, but that the marriage has to be specifically mentioned in the will. IIRC it was called a "will made in anticipation of...

Infested Kitchen? by Richard
Hi, We've recently took delivery of a flat packed kitchen from B&Q which is currently stored in our conservatory. An hour after delivery we noticed a huge wasp-like insect buzzing around the boxes, and a bit of hunting on the Internet brought up this likely candidate: http://www.kendall-bioresearch.co.uk/hymen.htm#horntail Now after reading that I'm a bit concerned that it may have left it's...
