Theft (sort of..) by
Michael Anazapela
I would appreciate some advice on this matter.
A former friend had some items lent to him in his flat. Allegedly, the flat
was broken into and the items stolen along with his own items. I've asked
for the money for the items back, and he's persistently refused to pay,
claiming that he can't afford it, etc etc..usual nonsense in this kind of
affair. What should be my next step? The amount...

Bailiff's Powers - Alleged Council Tax Debt by
Andy
Anthony R. Gold wrote:
As I mentioned before, the presence of the bailiffs means that a judgment
has already been entered. Writing letters to the prevailing party asking
for evidence after the case has been decided is somewhat eccentric.
Unfortunately the decision would be a liability order that was signed
off unchecked as part of a batch.
A likely scenario is that the people in...

Suspicious packages by

Scenario one:
A person takes a suitcase and large rucksack with me on an underground train
in London. The person suddenly realises they're at the tube station they
wanted to leave the train at. In their rush, they manage to leave one of
the items on the train as the doors are closing.
Unbeknown to them, panic sets in on the train that they have just left as it
departs the platform, and the...

Police Incident Reports by
Mike
I posted a couple of weeks ago about a girl and her dog being attacked by a
pack of dogs.
I'm aware of most of the procedures involved in taking action against the
pack's owner but I'm a bit stuck on one bit and could do with some suggestions.
The police attended the incident and interviewed the pack's owner but didn't
take any action against her. For the purpose of a civil claim, the...

Is this libel? by
Tim Woodall
Could the following be libelous?
"I am writing to inform you that by not doing x you are committing an
offence under law. This is a criminal offence. Should I not hear from
you within the next 14 days I would notify the police who will take
further action and could well result in a criminal prosecution before
the Magistrates Court."
Three cases: 1. Would it be libelous if x had been done?

Police - Jury Service?? by
John Smith
Is it true that serving police officers can now sit on juries? I understand
that it has recently been ammended in the 2003 Criminal Justice Bill.
Surely, a serving officer will be inclined to favour the guilty verdict? In
an ideal world we all know that they would take each case on its merits....

Third party insurance payment for loss of wages by
Styx
An RTA in April 2000 caused my wife to be paid aproximately £2,500 by
her (then) employer in sick pay. The third party insurers have already
agreed to repay that sum to her (as a part of the overall compensation)
so that she can re-imburse the employer.
However, her solicitor has told her that she will actually receive that
figure less 25% "deducted for tax" as this is "standard procedure."...

Charge on a property by
Stephen Maudsley
I'm getting to the point of having to go to the small claims court to
reclaim my deposit and damages due to a sewage leak from my previous
landlord. I believe he's planning to sell the property - would it be worth
putting a charge on the property (assuming I win) for the amount owed -
about £800?

Employment law question - right to 'bonus' payment ? by
Chris Squire
About 10 weeks ago, I handed in my notice at work. I was required to
give 12 weeks notice but was entitled to 2 weeks holiday. I was told
(via e-mail) that this gave me a leaving date of 29th July with a last
working day of 15th July (their description of the arrangement), which I
accepted.
Due to a change in plans, I was able to work for an additional 2 weeks,
which was agreed to by my...

What can I do about a noisy neighbour? by
Tricky
Hi
The rented house next door to me has recently been rented to a young
man (yob) who plays loud, thumping music sometimes until 3am.
Please can you give me some advice as to what I can do.
I have twice asked him to turn the music down but this had no effect.
I am not able to knock on the door due to a tall, locked fence and
gate so I have shouted from my back yard up to his open window.

Internatioal Law relating to children by

Is this true?

Overseas data storage by
martin
Hi guys
I've tried googling for this one but came up a bit stuck.
I'd like to ship data onto a server in America for remote backups (this
is business data btw, accounts payroll etc). All the references talk
about Safe Harbour agreements for data processing.
Does anyone know what the situation is regarding just remote stoage? The
data would be periodically zipped up and then encrypted...

Clarification on right-of-way when pulling out of junctions by
Ian Rawlings
Hello all, I live in a small clearing set back from a residential
road. When pulling out onto the road I can't see what's coming more
than about 50 feet in either direction, with the occasional parked car
limiting space on the road. The result is that I have to slowly edge
out onto the road until I can see more of the road, during which time
the bonnet of the vehicle is closing off the space...

Possible defamation on a web-forum by
Jim Crowther
On a web-forum I frequent (yes, I know, I hate them too) there was a
recent "Name and shame" topic about alleged shoddy service provided by a
certain motor-cycle dealer 'X'. 'X' was named in the title of the
thread and in several of the messages, along with the full names of the
individuals who run 'X'.
'X' e-mailed the forum's main Admin, asking for their name to be
removed, not for the posts...

Have you contacted the firm who fitted it to ask them to do what was agreed?
Are they a member of a locksmith professional association? If so, contact
them as well.

About 2 weeks ago, I paid a London locksmith =A32000 for a steel door

time of the sale (2 months before the door was installed).
The brochure said I will get two steel door frames, but when they...

Debt Collection Fees by
sks
We (a Ltd company) owed a courier company money (3K). We told them we would
not be paying while they owed us more in outstanding claims (parcels 'lost'
by them and) than what we owed them. They sent a solicitors letter or three,
and then issued a proceedings in the small claims court for the money. We
decided to pay them anyway as we knew we couldn't legally hold it back (it's
just annoying...
