Application Notice by David Wyn Davies
Strange as it may seem, I'm with the lawyer on this one. A problem with making the law too simple is that it can become a catch-all, irrespective of individual situations. I'd rather have a complicated law that tries to anticipate situations, and thereby restricting the court's powers of interpretation - or at the very least makes it clear to the courts what the law was actually intended to...

Can a company be the promoter on lottery tickets? by Richard White
Hi We have recently got to the point of wanting to print lottery tickets for a charity lottery. The Charity (which is a company limited by guarantee) has been registered with the local authority to conduct lotteries. The local authority (though not its legal staff) advised that the charity as a company could be registered in its own right as the promoter, with other named individuals...

Garden fence by Paul Gray
As far as I am aware, if the fence posts supporting the fence are on your side of the fence, then the fence is your responsibility. If they are on the other side, it is your neighbor who needs to maintain the fence. I am not sure what applies with the fence with the posts in line with the...

Calculating historic property value by jonnypn@gmail.com
Does anyone know if there is an official or accepted way of establishing the value of a property in today's money based on a 1970 valuation figure. The property is located in England. I've looked at various online calculators which give a good idea of the 'ballpark' figure. I now need to understand on what basis a court would determine such a figure. Any help gratefully received. TIA Jonny.

What happens to these little cretins? by Odie Ferrous
Just been reading this article: http://www.sky.com/skynews/article/0,,30000-13353024,00.html "GANG BEAT UP POLICEMAN A policeman has been beaten up by a gang of youths with an iron bar as he tried to arrest one of them." We read about this on what seems to be a regular basis, and we often

warrant for entry by warrant
Imagine that the TVLA get a warrant to enter my home. I wouldn't wish to let them in unless they were accompanied by a police office. Would I be allowed to demand that a police officer be present if the TVLA had a warrant? Would they try to enforce a warrant without an officer being there? In the legislation it says "either alone or in the company of one or more constables", so does that...

the value of travel incentives by The Potterer
Hi For years I've been saving "airmiles" and have enough for a business class trip to the states. The value of the air fare would be about =A34,000. As I'm using the said miles for a business trip ( as a director of a ltd company), could this "perceived" amount of value be legally shown in company accounts?

Call to reform murder by JB
http://news.bbc.co.uk/1/hi/uk/4574661.stm Ken Macdonald QC said "If we are talking about a serious homicide killing with an intention to kill, that should attract a mandatory life sentence" Is he suggesting that people who don't have an intention to kill should also be convicted of murder? It seems to me that's the definition of Manslaughter. This remark seems to be deliberately disingenuous...

A company started featuring my businesses products on its web site. A site with many of my competitors and their products. I complained to the said company who wrote to me and said because I had not said 'no' when they sent an email some weeks previously in which they outlined how they would feature my products this was my approval . Because I hadn't told them 'no' they say they have my...

Recovering Intangible Losses - long by Alistair J Murray
A driver was recently (Tue. 17/05/05) in collision with me due to failing to look before coming out of a side street. He/his insurers accept 100% fault. My rage at his carelessness is unabated. I am paraplegic and as such can only drive a car fitted with hand controls, making car hire less straight forward. I did not hire a car immediately following the accident. My car is an ALPINA B10 V8,...

Executor Disputes by richie_hackett@hotmail.com
Hi all, My nan has recently died and left my Mother and Uncle as the Executors of the will. The main estate is to be split between the 2 Executors with a cash amount to be given to my brother and I. The sum of which could be met by the money in the bank accounts. My mother made an appointment to get the bank accounts closed and get a joint signatuary account opened elsewhere. My mother...

Services provided (wedding video) by Gareth Hardy
We filmed a wedding last year, and the customer is dissatisfied with the finished edit. Despite seeing samples of our work and being told how we work (for example, we don't film people eating) she wants changes to the film that are either impossible (because they deliberately weren't filmed) or rubbish (they won't add anything to the aesthetics of the film, and will take the result a long way...

Manufacturer v distributor? by Jan
Hi I am hoping to set up a website selling other companies's skin care. Some of the products I have sourced are available direct from the manufacturer, whilst others need to be bought via a distributor. Does the purchase of products from one rather than the other through up any legal issues of which I should be aware? Many thanks for any help given Jan
