Original of Will Missing - only copy. by Sla#s
The original of a will of has gone missing. The solicitors only have a copy and say the original was put in the deceased's bank 25 years ago - the problem is we don't know which bank. I have been offered two opposing opinions. One says the probate office will take the position that the will stands (after a lengthy verification process). The other position is that the probate office could assume...

Securing a debt against a family member by Simon Finnigan
Hi all, just after a bit of advice on securing a debt against a family member. Putting a charge on a house is not an option, the best asset is a valuable camper van worth considerably more than the sum to be owed. The person giving the money would rather not become the owner of the van for various insurance based reasons (having it in their name would add considerably to the insurance...

Car Insurance Fraudulant Claim against me by oakleys
Back in November, yes November, I had a walking pace motor vehicle accident at a roundabout. The driver started to move off on a clear road and suddenly braked. Luckily I was only crawling forward bu the cars touched. We pulled to the side of the road and I noticed that here was already considerable damage to the rear of the other vehicle. I took a photo using my mobile and the guy who got out of...

Bailiff query by bbtrout@live.co.uk
Hi all, A friend of a relative is in debt and has been given notice that bailiffs will visit her house to seize goods. She has asked my relative to look after some items, mainly electrical goods - TV, stereo, microwave etc. I gather from Googling that this is not unlawful, but is a bad idea because the bailiff will simply return at a later date.

Wills - sensible to have two originals to be safe? by david
My parents are going to the solicitor to sign wills drawn up for both of them. They've done this before years ago and solicitor kept the signed wills in his safe. What I'm thinking is supposing solicitor lost wills e.g. clerk forgot to put them in safe, or was burgled and mistakenly didn't tell us etc. There would be no record of them, no spare ones. I know it's unlikely anything like that...

Council Tax Threats? by RayL[_2_]
Hi :-) I have just received a letter from my local Council tax office. I have had a liability order against me on 5 Aug 08. Normally I pay 3 months upfront, but due to an error I made in my schedule I inadvertently went overdue by a month. I sent a cheque for a further 3 months(+ or -) along with an explanation. -I am currently paid up until end of September-.

Help required with Website purchase by mustafacatflap@googlemail.com
Can someone offer advice please? I am a sole trader, operating in the service industry, and for five years I have had a website, which was html based, and which I produced myself, from one of those ‘build-it-yourself’ software kits, Webstudio4 actually. It didn’t set Google on fire but it was producing about three hundred hits a week, which certainly kept me busy. My site has a lot of text on...

Is a landlord allowed to do this? by Mike Harrison
A landlord has a flat for rent. The rent for a new tenant who is working full time would be £400 pcm. (This could be considered the market rate rent for the flat.) However, the rent for a new tenant on Housing Benefit is £450 pcm. This is because the rate of Local Housing Allowance applicable to that property is £450 pcm. The landlord refuses to accept Housing Benefit tenants on a lower rent.

Finding out someone's criminal history. by mrzippy111@gmail.com
An individual who is romantically interested in one of my friends was arrested earlier this year. I know that a hearing (before trial) was held recently. I do not know what he was charged with although he is on bail. Is there a way of finding out? I realise in America such information would be public but not, I suspect, here. It may be that at this hearing the prosecution decided not...

Claims to an estate after the death of.... by racleborg
My mother died recently and in her will left the income of her estate (approx £40,000 per year) to my father and on his death the capital of the estate is to be shared equally between myself and my 2 brothers. My father has announced that he is to remarry. My question is. Will my future mother-in-law be entitled to claim from my mothers estate after my father's death. Many thanks for your time

Car Advice by Tom
My car had been in a garage for six months undergoing repairs. The car is worth approx £4000 in working order and I have had a repair bill for over £5000 which I am refusing to pay. Do I have a case for not paying because the garage have caused unneccessary damage to the car (new cylinder head required after garage inspection) and done work that was not required etc etc etc. The car was working...

copyright damages claim by Ian & Hilda Dedic
HI I'm new here, but I'd like to find out where I stand. I've just had a claim for damages issued against me (as the bill payer)for a driving game they claim I downloaded via my broadband connection. I do not know if this actually happened or not (it may be another underage member of my household) I certainly haven't downloaded anything of that nature.

Can anyone tell me the options for sentencing that a magistrate would have if someone was found guilty of Aggravated Criminal Damage and Racially Motivated Aggravated Crminal Damage. This person has a record for assaults against the Police and has recently come off a suspended sentence. smithy

Rented properties, compulsory requirements by Mark BR[_2_]
I rent out a house that the agent keeps telling me I must have this certificate and that certificate - but I can't always find the legal basis of their assertion. I know I must have a gas certificate each year, But do I have to have an electrical certificate every 5 years? Now they tell me I must have an Energy Assessment Certificate before I re-let the property - is this true?

Is the ownership of this house legally transferred? by tonyjeffs
After correctly completing the 3 appropriate forms to transfer ownership of a second house from one family member to another, we sent them to the Land Registry. They returned them explaining that they needed those involved to visit with identification before they could act. (This is reassuring, because last time we did this, they didn't ask for identification, and I worried that it might be an...
