Drivers responsible for passengers actions? by judith
Drivers responsible for passengers actions? There is a spat in uk.rec.cycling regarding the law when a passenger in a car opens a door on a cyclist. It is stated by some that the driver has committed an offence contrary to Road Vehicles (Construction and Use) Regulations 1986 Regulation 105 if a passenger does such a thing - and that the driver is legally responsible and may be prosecuted.

How are crimes described on CRB returns? by pseudoanon
Ann has several (say less than five) convictions for shoplifting, the most recent being three years ago. All times the total goods stolen were less than £250. Bob has one conviction for 'public urination' from 30 years ago. (eg, the chap from BC R4 'You and Yours') How would these convictions be described on the forms returned by the CRB people?

Injunctions - how to get? by pseudoanon
Ann says that Bob (her father) sexually abused her, but this has never gone to court or to the police. Ann's mother has only just found out about the allegations. Bob continues to make contact by telephone, email, and post. Bob also gets Beth (his wife, Ann's mother) to ask Ann to get in touch. Ann has asked Bob to stop making contact. Ann has told Beth not to mention Bob.

CRB checks and LINks by pseudoanon
Local Involvement Networks are taking over the work that used to be done by Patient & Public Involvement forums. Volunteers with PPI forums were CRB checked, and volunteers with LINks have been told that they will need to be CRB checked. PPI forum members had statutory right to "enter and inspect" certain NHS premises, such as hospitals, so a CRB check is understandable. LINks members might...

Data Protection Act & Section 20 by Imageek
Hello I have a question regarding the UK Data Protection Act as it applies to a Section 20 Consultation. Our landlord has commenced a Section 20 Consultation process. The residents board, not representative of our estate, is behind all parts of the proposed work, and in fact are pushing hard for it to kick off. Residents board meetings typically result in dissenters being shouted down. I...

Phone Cashback... by Marcus Fox
May have asked this before, but can't find it. I am hoping to pursue a mobile phone company, Yes Mobiles, http://phones.yes-mobiles.co.uk/ also trading as Express Mobiles, for unpaid cashback. However, I can find no address for Yes Mobiles, and this is further complicated by the fact that there is another company called Yes Mobiles (http://www.yesmobiles.co.uk/) and obviously they have been...

Hello, new user here - would really appreciate some advice Can you please tell me what the maximum penalty that could be imposed for being in contravention of Section 163(3) of the Road Traffic Act 1988 i.e. failing to stop when required to do so by a constable in uniform? Many thanks, Bob

Breach of Contract by keithdixon
I was asked by my employer to move from one location to another. With the move i was asked to provide 24 hr cover whilst i was at work. (i work a 4 on 4 off shift so the cover was 6am start on my first day until 6am on my 5th day) I was also given 12 days to move. I submitted a grievance stating that i could not do this cover as i did not have a house within the new location. Also the requirement...

Motorcycle catergory missing from license by Lord Lucan
I past my motorcycle test in 1967! Car test came later. Eventually a little red license was received. This was 'converted' in 1976 and it appears (according to DVLA) the catergory A (motorcycle entitlement) was left off. I continued to drive motorcycles on and off for years, but recently found my license was not complete! Several expensive phone calls to DVLA (and DSA, Traffic Area...

Nuremberg defence by a@b.invalid
Does a judge have any options if, during the course of a trial, he comes to the conclusion that the evidence suggests that someone else other than the dependents should be on trial? On a similar note I'm curious as to what evidence would convince a jury to acquit people who admit to torturing a man to death. Is there any way for me to find out the evidence presented in a trial? Somewhere...

Police misconduct - inadmissible ? by barrack room lawyer
My question - Can anybody give an example of a breach of the following Acts with regard to the investigation of a complaint against a police officer ? And what the outcome was ? IE - has any Police Force been challenged over using as evidence in a Police Misconduct Hearing, a previous RESOLVED complaint to help prove a later complaint made against an officer. Police Act 1996 / Police Reform...

What is the legal definition of temporary structure / shed by steve@ic24
My brother has built a rather nice elegant wooden shed to store his model aircraft in. He consulted the neighbour who were happy with the shed and its location. However the original owner of the property (who cannot even see the shed from his property) is invoking the covenants on my brother's property that prohibit the building of any permanant structure structure without his consent. He...

Property question. by Mike G[_2_]
Just curious. 2 brothers, A & B, inherit a small bungalow with a fairly large garden. They reduce the size of the garden, and register it as a separate property, with the idea of getting planning to build a small house. A third party C, gets a mortgage and buys the bungalow. Later, C buys the separated piece of land outright from A & B, and with a second mortgage, builds a 2 floor extension...
