Rail fare refund charge by Damot
I bought a return ticket for a short journey that cost £4.40 Later in the day I changed my mind before travelling and asked for a refund. I was told there would be a £4 charge and I would have to fill in a form. Is that really legal? I didn't use their service. I know *why* they didn't want to give me a refund, because I could have travelled without someone checking (which often happens) but it

Power of Attorney. by Fred
My Mother is becoming frail and my sister and I would like to have an enduring power of attorney so that we can do what we feel is best for her. Is it possible for two people to have this "power" or can only one person have it? Are there any "ready made" documents I can download and complete for what sounds like a fairly standard document? Many thanks in advance.

Conveyancing: exchange to completion: time period by bruce phipps
I'm a first time house buyer, located in the North of England. My house purchase is going very smoothly so far -- survey was OK, mortgage offer has been processed OK, seller is not in a chain and can vacate ASAP. We are now coming up to exchange of contracts. What is the usual length of time between exchange of contracts and completion in England? Is 2 weeks OK in my situation? Thanks Bruce

Unadopted Services by LowerO
I have received a letter out of the blue today from a surveyors firm... I have lived in my house for the past 9 years (I am the first occupant). The house was part of a self build project that went into receivership, I bought it from the Receiver. The letter states that there is a sewerage pumping station that services all the houses (12 in total) on the estate, that were part of the self...

Motor insurance/law question by D.M. Procida
We have some friends who think it's OK to have six people in their VW Golf, with one of the children sitting on his mother's lap. Obviously this isn't the greatest of ideas, but if they were to be involved in an accident, what would be the legal consequences? Would the insurance company cover them for injury to the child, or to other passengers? Would the fact that the child was on the mother's...

Top Up TV starter/subscription agreements - enforceable? by Trust No One®
Hi all, I've purchased a Top-up TV starter pack from my local Currys today. The starter pack is basically a _sealed_ DVD style container with an enclosed unactivated viewing card and printed starter pack and subscription agreements. The following terms and conditions are printed on the rear: "By opening this pack you are agreeing to be bound by the enclosed starter

Very unhealthy LU air quality by Advocatus Diaboli
Is there anything we can do to make TFL clean up the air in the underground? Maybe by making them install air scrubbers and cleaning the tunnels? From what I've read, the air may well: give you cancer, cause autoimmune diseases, cause neurodegenerative diseases, ad nauseum. I read a report published at TFLs website (one wonders whether the report has been made more diplomatic...) regarding the...

Problems with Britannia Music by Advocatus Diaboli
Hi all. I've been having problems with Britannia Music (their debt collectors, rather) because I signed up for their "special offer" which signs you up for the dubious priviledge of you having to buy a set number of recordings from them every year. When I signed up for it I was an easily suckered student and didn't bother reading the Terms & Conditions properly...I was just past 18. In my rosy...

Armed police demand to be above accountability? by Steve Walker

DodgyCar Finance by Iain Gordon
My wife bought a car (A) in February this year, part exchanging another (B) from Dealer (C). Car (B) had outstanding finance for which the dealer received a settlement figure. Finance for car (A)was arranged through a different Finance Co. Car(B) was subsequently transferred to another local dealer. We know this because they wrote to us asking if it had been in any accident. Today she went...

Hi - Trouble with g/f by martin
Hi Guys My girlfriend went off with someone else tonight. It's not the first time it's happened. I want to stop her gaining entry into my house (rented, and I am the only one on the lease) in the future. She has some things here, which I am more than happy to let her have. She made it clear that she isn't coming back and has a place to go.

Fox hunting ban to be pushed through by Benedict White
I live in a semi rural area, in that if I walk 30 yards from my house I am in the country side. I do not care for fox hunting, and i am sure I am not alone, but it seems to me that banning fox hunting is wrong. If it is on the basis that killing fox's is wrong, then how are we going to control the fox population? If it is because this method of killing fox's is more cruel than the

Party Wall Act query by bluefizz
I'm intending to have some work done on my existing extention which means demolishing most of it and making it square shaped instead of the current 'L'shape. I've had the plans drawn up and am about to apply for planning permission and building regs. I have been told by the planner that as I am building up to the boundary this project comes under the Party Wall Act. I have researched this as...

Who's a retailer? by D.M. Procida
Previously posted to uk.legal by mistake... We (Apple Juice Ltd, purveyors of top-notch Apple Macintosh services etc) also sell a certain amount of hardware and software to our clients. There's pretty much nothing that we keep in stock, except some very small items which it only makes sense to buy in bulk. Nearly everything we sell is bought to order, and there is no passing trade - anyone...

Parking Ticket for Liquidated Company by kh44
Hi, just got a demand from the council for an unpaid parking ticket addressed to my company. It's a limited compnay and I am about to put it into liquidation. So should I just ignore this letter? Or pay it? Or write to them and say company has gone into liquidation (after it has) and it will not be paying? Thanks David

Leasehold:Freehold Values by womblewilly@hotmail.com
Hi, I was browsing through the list of LVT decisions and I came across a valuation decision, where the LVT used the following guidelines to estimate the increase in value of a property from going from leasehold to freehold. The first column represents the number of years left on the lease. The second column represents the related ratio of freehold to leasehold values: 24.75 50.25% 25.00 ...
