ay1000
Greetings Law Banters
I am new to this forum and find it really help full.
Though I am not legally trained I know thing or two about the law and understand were I stand.
Recently my application to file Statutory Declaration out of time has been refused by Court Officer sitting at Northampton County Court. But......he has made a great mistake because the evidence presented by the opposing...

unlawful arrest, or not by
mark_doherty@yahoo.co.uk
I was accused, by a member of the public (MOTP), of something I did
not do (and can prove using video evidence)
It occurred at a train station.
Importantly the MOTP subsequently made a statement to the police (BTP)
where he gave no details of an inditable offence (IO) in the first
place (or when he mad the accusations to me and to the train staff).
From what I have read I believe that an IO is a...

Motor cycles speeding on camera by
Lord Lucan
This has intrigued me for some time: Forward facing (usually mobile) speeding cameras must have difficulty identifying motorcycle riders as there is no requirement for number plates on the front of a M/bike.
I have queried this with police authorities, but their reply is always; not relevent to a specific offence in which I have been involved and so they cannot comment!! (Seems something is being...

Motorcycle catergory missing from license by
Lord Lucan
I past my motorcycle test in 1967! Car test came later. Eventually a little red license was received. This was 'converted' in 1976 and it appears the catergory A (motorcycle entitlement) was left off. I continued to drive motorcycles on and off for years, but recently found my license was not complete! Several expensive phone calls to DVLA (and DSA, Traffic Area Commissioners ....) revealed...

Police leaks (or otherwise) by
a@b.invalid
A couple of new story's this week that together caught my attention.
The first is that the National DNA database samples are being sold to
private companies for purposes only very loosely related to solving crime:
http://www.telegraph.co.uk/news/newstopics/politics/lawandorder/2459976/Millions-of-profiles-from-DNA-database-passed-to-private-firms.html
and the second is Panorama's somewhat...

Breach of Promise? by
actu_8
For approximately 1 year, I have been supplying professional services on an occasional but regular basis to an organisation either free of charge or at significantly reduced rates in response to their assertion that they are in a precarious financial position. This arrangement has been on the implicit understanding that I would obtain business from them should funds become available, being their...

Quad bikes by
s_pickle2001@yahoo.com
What are rules relating to quad bikes, e.g., licence, insurance, tax
etc? I have seen a number of them driving around on the roads in the
city without licence plates.

Dropped kerb legalities by
Mad King Soup
Hi
Picture this: a semi-detached house on a corner. The house has no
front garden and faces road A (a major dualled A road), but the back
garden runs down alongside a cul-de-sac, road B, and backs on to my
property on Road B.
One half of the semi is broken into two flats. The second half has
recently been modified to nominally make it one property, although it
is multiple occupancy.

Electrical Goods by
Don Aitken
Is there any guidance as to how long electrical goods can be expected
to last? A while ago I bought a CD player from a High Street store. It
worked perfectly for a couple of months, then gave up. Since it was
cheap (£20) I just disposed of it and bought a similar one at a
similar price from a different shop (Woolworths, this time). This one
has now also stopped working; I have had it just over...

Thanks for any assistence.
IANAL, but this case exercises features of contract and consumer law so
nicely that I think you may have a career ahead of you writing law
exams.

Train Fare - Summons ... with a twist by
100
This isn't a clear-cut fair-avoidance case, so please read it through. I was stopped onboard a train on May 14th, and asked to show my ticket. I showed my (valid) ticket to the inspector. He asked me for my Young Persons card. I looked through my bag, but couldn't find it.
He took a statement from me, because I did not have £20 or my Y-P card.
The ticket was refused by the inspector, and...

Consumer rights | New BMW by
mike
Last year I bought a new car, I wanted to make sure I got the right
one so I test drove every engine configuration within a certain model
range. This is BMW, a German manufacturer of a so-called prestige
motor car and I wanted the best power to MPG ratio (compromise), I
told the dealers many times that a diesel would be no good as my wife
hates the sound they make. Test drove all the petrol ones,...

Shared roof problem by
David J
A friend has a problem with a rainwater leak.
The house, built in the 1950s, is an ex-council house and was bought
about 3 years ago from the original LA tenant who had used his option
to purchase.
It is semi-detached, but a separate outbuilding that was once used as
a coal-shed/store is co-joined to the neighbour on the other side.
This is a single brick walled building with a dividing wall,...

Fraud or not? by
Staffbull[_2_]
I have purchased an item off ebay, it arrived and was defective beyond
use. I agreed with the seller for a refund on condition he received
the item back, I have sent the item back, and now no contact
whatsoever and no refund!
Paypal say they can do nothing! great lot of good that is,
Question is, should I call the Police? has an offence been commited?
is it a type of fraud?

Taking Court Action - Timescale by
judith
I recently had a holiday - the room was not what I had paid extra for.
I wrote to the company and said that I thought they were in breach off
Sale of Goods Act - explained fully why - and asked for a refund of
£90 (the extra) out of a total of a thousand
I did not mention taking Court action - I said I expected a timely
response - no deadline given
After 9 days not hearing from them I sent...

Withholding Evidence by
alexb123
How serious an offense is this? What laws are covered here if committed?
If an Expert Witness (Single joint) withholds disclosing full test results for a test conducted for his legal report and then further ignores requests for these results, how serious is this?

I have admitted theft from employer by
stucknow
Around a week ago I went to my employer to tell them I stole £40,000 from them over last couple of years and have been balancing the accounts ever since, nobody had a clue.
They called the police and I admitted exactly the same to them. I am now on bail for 11 weeks.
I am due to get married on saturday and my fiance, who also had no idea is standing by me, I have a son and have no previous. I...

Building Reg by
mrsukyankee
We have had an offer accepted on a house. It is listed as 3 bedroom with a rear extension. In doing the searchs, our solicitor has discovered that the extension and loft conversion (the 3rd bedroom) which were supposedly built in 1998 have not gotten either planning permission or building regs (these were 'pending'). We are not concerned with the planning permission.
My questions is (which...
