Inheritance Tax conundrum by
Frank Booth Snr
Apologies if this has been posted twice, but the first attempt did not show
up on my newsreader.
My mother, who died 3 months ago, lent a considerable sum of money over 7
years ago to a Discretionary Trust as the settlor. Apart from the Trust Deed
being drawn up, there was also a Loan Agreement, signed by my mother, who
was also a Trustee, and another Trustee, both of them now deceased....

My last two posts have been rejected for being OT for a legal group
(see 13187 & 13243). Are these really off topic for a legal ng when
they ask a legal question that has attracted post on ukl?
Post 13187 was not rejected as OT. It quoted a lengthy news report without

Assault at work by
Simon Finnigan
Hi,
just got back from work after an "interesting" night, to say the least. A
female member of staff refused entry to a group of ladies, including a few
children. On of the ladies pushed her hard in her chest, and a bruise has
already developed on the staff members chest. A number of members of staff
where abused verbally by this woman, there was another member of staff
present when the woman...

travel costs to court hearing by
Derek Hornby
(please, only serious and sensible replies to this)
Hi all
If a defendant needs to attend a court hearing, can travel costs be claimed
back off the court?
If not then what happens if one can't afford the cost?

Deadlocked juries? by
Demetrius Zeluff
Can UK juries be 'deadlocked'?
I ask because CNN report this case:
http://edition.cnn.com/2004/LAW/06/28/video.rape.trial/index.html
and I'm curious about what would have happened in a UK court.

Insurance Brokers...... by

Can anybody point me toward specific UK case law or online information

legal responsibility of Insurance Brokers for the financial security of the

public?
I am a so-called 'expert' in Insurance and Reinsurance and obviously I have
my own commercial eperience and opinions but finding anything meaningful on

Parent V Parent re MMR for child by
Pat Winstanley
Does the English law actually state that a mother has more rights than a
father (or vice versa) regarding which can assent to or reject the MMR
jab for their mutual child?
Is is different depending upon whether or not the parents were ever
married and/or the child is shown by DNA analysis to be (most likely)
the offspring of them both or not?
IOW, is it the law that supposedly discriminates...

House Prices by
Geoff P
Sale price of a house was quoted in the Registers of Scotland as £156,000.
But Estate Agent involved in sale informed me that the sale price was
£180,000. Does this mean that the final price could in fact be different
from the officially registered price. Or is it the Estate Agent telling
porky pies.

New report condemns solicitors' failures

The Law Society risks losing its powers to regulate solicitors as
a report out today reveals it has failed to meet all but one of six government
targets for dealing with complaints against the profession.
The society's performance on key targets is worse than its record the previous

From the July 2004 issue. I can well believe that this is a representative
sample of opinion, and that the Law Society has been too complacent for too
long.
The number of complaints about solicitors is still too high. We look at
where the problems lie.

Sale of Goods - 6 months by
Rob S
Hi,
Can someone point me towards the legislation (preferably in layman's terms) that
states it is up to the shop to prove that an item wasn't faulty, should it fail
within the first 6 months?
Many thanks

Flawed "investigation" by university by
Martin Nicholson
I serve on the appeals panel at a local university. I have served on
this panel for many years without being particularly overburdened with
work or controversial cases.
However one current case is causing me concern. In brief the student
was the sole white student in a house and has complained about a
prolonged campaign of harassment by the male overseas students sharing
with her.

Crown court summons ... by

Imagine the situation (and this has just happened) ...
Serious and somewhat complex case coming up for trial at the crown court -

Defence have had properly served primary and secondary disclosure quite some
time ago and had more than sufficient time to review the material and make
applications based on it's contents
The week before the trial...

Pensions and mandatory retirement age for women. by
Juggs
I have a couple of colleagues who are women. It is written into their
contract that they must retire at 60 unless it is agreed otherwise by
their manager (I am putting this in general terms).
Both of these colleagues are nearing sixty - one is two years off, and
the other is four years away. Both are healthy and in full possession
of their mental facilities. If you met either of them, you...

Just been stopped in my car for entering a bus lane and then... by
Nige
Earlier today, after sitting in a queue of traffic for over an hour, I
very foolishly pulled out into a bus lane about fifty yards before it
ended, coming up to a roundabout where the traffic again became two
lanes. As (my) luck would have it, one of the cars in the queue was a
police car and having seen me enter the bus lane, immediately pulled out
and came up behind me.
Like most drivers in...

Procedure for appeal by
Alasdair Baxter
Could someone please advise me what the procedure is to lodge an
appeal to the Court of Appeal (Criminal Division)? It is not an
appeal against conviction or sentence but against a Crown Court
Judge's refusal of an application to lift reporting restrictions under
section 4 (2) of the Contempt of Court Act, 1981.
