Is this legal? by

On the one hand, it seems to be the guy's own home, where, presumably,
he can do what he likes - on the other, he's running a business and
its in that capacity that the discrimination occurs

Restraint of trade? Constructive dismissal? Help! by
LaoFuZhi
Apologies if this sort of thing has been posed before; I'm new to the NG.
Apologies too for the complexity and length of my post.
I am, based in Scotland and, by trade, a video programme producer and
photographer. I've worked in that profession for many years and for the last
ten or so on a freelance basis under a trade name. In May 2001 I was offered
the opportunity to lecture part-time on a...

Age Discrimination by
Alasdair Baxter
Does anyone in this newsgroup know when age discrimination is to be
abolished in the UK? Will it be abolished all on one date or is it to
be abolished piecemeal? I can see lots of older people wanting to
become apprentices and firms being forced to hire them!

Payment to Charity by Public Sector Body by
D.A.L.
I'm trying to find some legal guidance or even some legislation which states
that a public organisation (council or hospital say), cannot make payments
(or donations) to charitable organisations, except those made in the normal
course of business for the supply of goods and/or services. Can anybody
help in pushing me in the right direction?

Do tram drivers need a PCV (formerly PSV) driving licence? by
Alasdair Baxter
Since trams have no tax discs or number plates, I just wonder whether
their drivers have to take nationally recognised driving tests and get
PCV (formerly PSV) driving licences?
Also do trams have third party insurance and can their drivers be
convicted of road traffic offences like "drunk in charge of a tram"?

Electric Fence by
The TERMinator
The horses have eaten every plant within reach over the boundary
Since I don't want to start legal proceedings against them, I will
simply proceed to replant and to take steps to stop the horses eating my
garden. The options would appear to be "barbed tape" (aka razor wire) or
an electric fence.
Are there any legal implications I should be aware of with either
approach? Do I need...

No waiting sign - height above ground? by
Connected
I recently got a parking fine.
I *genuinely* didn't realise that there were restrictions on parking in that
road (no yellow lines). There was only one "No Waiting" sign that I hadn't
seen 'cos it had slipped down and around the lampost. I have scoured the
DFT's website and have come across all sorts of regulations regarding road
signs, but nowhere does it state how high above ground level the...

Debt /Divorce Question - Help me PLease. by
Mr Wiffy
This is a lengthy scenario, so please bear with me.
My wife and I separated last year, and our divorce became final In December
2003. It became quite messy at one stage, for reasons I wont go into, and
there were obviously various financial matters to be resolved at that time.
During the divorce proceedings, we were both sent a letter from My ex wife's
parents, regarding some money they...

I run a small business which supplies a continuing weekly service to other
businesses (ie they get the same service each week). We take credit card
details from customers and process the payments on a monthly basis.
A customer has asked us not to take the money from her card but send her an
invoice and she will send a cheque by return. If she doesn't pay up, can I

probate value affected by neighbour's planning application by

Considering the probate valuation of a house. The deceased's garden
alone is too small to allow a commercially viable development so the
probate valuation is based on the absence of such a development.
But suppose the neighbour of the deceased applies for planning
permission to build on a combined plot comprising the bottom of his
garden and also the bottom of the garden of the deceased. Would...

Trespass? by

Hi
I need clarification.
If your personal property is fenced or walled off i.e. back garden.
Can people climb over the wall and enter your garden to reclaim footballs
without committing a offence?
This concerns a elderly neighbour who is continually harassed by two local
boys who kick footballs into her garden, damaging her green house and

Banks' punishment for overdue paymenst by

Primary schools admission - offer of school by

We are looking for a primary school for our daughter but have not been
offered a place at our three nearest schools. We visited the next nearest
school and were "unimpressed". We have been offered a place at this school
despite never having indicated any preference for this.
Does rejecting this place in any way weaken our position and what, if
anything, can we do to avoid such weakening?
FYI,...

One of our neighbours has right of access over a corner of our land to

a different route to the back of their plot, if a 'single

A few months ago, they put a gate in the fence that is across the back

Third Party Lay Helpers in legal proceedings? by
Pat Winstanley
(This is personal curiosity, sparked by, but NOT directly related to,
the specific matter/people in the "strike out costs" thread).
1. What is the difference between a "Mackenzie Friend" and a "Litigant
Friend"?
2. Are either the MF or LF specifically recognised by law (and if so, by
right or by request or neither/both)?
3. Can any defendant/claimant require that the courts allow/deny these
