Deportation of terrorists to the US by
Scott
The authorisation of to use torture has taken a step closer to Bush, as the
following extract from todays FT shows. The question for ulm is how does
this affect the deportation of Hamza? Can any terrorist (real or suspected)
be deported to the US in the light of the real and credible likelihood...

County Court problem by
The TERMinator
There is no need for a Witness Statement to be either sealed, or time
stamped. When serving witness statements one simply sends it direct to one's
opponent. Witness Statements should only be filed with the Court if ordered;
in any event they will usually form part of the trial bundle, and that
bundle is, of course, eventually filed with the Court.

Terms and conditions by
R D S
Hi,
I have a T&C for my small business but its an amateurish hash up.
I could do with something a tad more proffessional, should i just copy those
of somebody in a similar business and change as appropriate, or is there
somewhere on the web i can find docs i can alter to suit my needs or should
i employ a proffessional.
It a wholesale spectacle business if it matters, account customers, supply

Pension scheme rules by
Gary
My wife has been informed that her final salary pension scheme is being
wound up, and that the replacement will be the setup whereby it becomes
a personal pension and the company contributes as well as the employee.
Can they change the pension scheme in this way without authority? She
can't remember if she signed anything to say this was okay, but even if
she did, she certainly didn't receive...

Length of Order ("sentence") by
Bloomin Heck
I have come across the ECHR case of LUORDO v. ITALY and BOTTARO v.
ITALY 17.7.2003.
Quote;
Article 6 § 1 of the Convention, relied on in the Luordo v.
Italy case
The Court considered that this complaint was to be examined
from the standpoint of the right of access to a court. It noted
that from the time of the bankruptcy order it fell to the trustee
in bankruptcy to represent the bankrupt in the...

Old School Photo by
Alasdair Baxter
I have an old school photograph which was taken with a panning camera
resulting in a very long narrow strip.
I tried Jessops and Boots to get a copy made but they refused on the
ground that it was copyright.
Fair enough, but this was taken about fifty years ago and there's no
photographer's name on the print so I don't know how to set about
getting copyright clearance. Even if the photographer...

ISPs and records. by
Plompetta
Does anyone know the current situation regarding ISPs being compelled to
record websites visited and e-mail headers sent.
For example:
Has any ISP implemented such a system yet?
What details would be stored (I know e-mail content is not included)?
When will the ISPs be forced to do this, if they do not voluntarily agree?

Deed of variation question by
daveh
Hi--Can anyone help me with advice re the legal device called a "deed of
variation", for altering the terms of a will? A relative recently died and
left a share of his estate to be administered as a trust, to provide regular
income for one of his (grown-up) children. Both the execution of the will
and the administration of the eventual trust are in the hands of the same
firm of solicitors. The...

Continuing authority on debit/credit cards by
Alasdair Baxter
It's well known that if a person sets up a continuing authority of a
credit card, he cannot later terminate it without the co-operation of
the payee. What is the legal basis for this rule and does the same
rule apply to debit cards?

On Ebay a bidder with private feedback and a fair few negs/neutrals hidden

Just got this 'Q from Ebay member' - copied and pasted verbatim, headed
"Legal Action":

Is it "reasonable" (as per Art. 61.) for a Case started in December

Sorry if this has been asked before, but me and my boyfriend was talking

directional currant but that was stopped years ago as they had to keep
putting more into the wires. With the...

Implications of this ? by
Bloomin Heck
This is part of a recent ECHR ruling;
31. It considers that permitting the applicant to represent himself in
proceedings against a legal practitioner did not afford him access to a
court under conditions that would secure him the effective enjoyment of
equality of arms that is inherent in the concept of a fair trial (see,
mutatis mutandis, Airey, judgment cited above, § 24).

"Debt enforcement agency" - book club bullying tactics by
Fatso
Earlier this year I took advantage of an offer from a "book club". The offer
gave me a number of titles at a very low price and did not oblige me to buy
anything else from the book club in the future, only to remain on their
mailing list, which was fair enough.
A couple of months after receiving the intro' offer books I received an
invoice for twenty odd quid for some book that I'd not ordered...
