Negligence or not ? by
Bloomin Heck
Would appreciate views on this. Action was struck out
whilst claimant was unrepresented. Claimant then
got legal aid and solicitor to issue permission
to appeal notice from County Court (where case was struck
out) to the Court of Appeal. Grounds that were put ,by
solicitor, were
(a) medical grounds that claimant was ill at time of trial
(b) time not given for claimant to obtain...

The moderation in this newsgroup is getting a little odd... by
D.M. Procida
I posted an article about a BBC report which named someone who allegedly
hit someone else, and asked whether there wasn't a risk of libel in that
case. It was rejected as being "off-topic for this newsgroup".
It might have been a stupid question, too stupid to be allowed though,
but I don't see how a question about libel could have been *off-topic*
in this group.

Adducing further evidence on appeal by
Bloomin Heck
Is it possible to adduce further and better evidence
(documents) on an Appeal to show that the decision
made at first instance is factually incorrect ?.
Basically, our representations were'nt made clearly enough
and/or too much notice was taken of waht the other party was
saying and our challenge was not strong enough factually. Can that
be remedied to show an injustice was done ?.
If so does...

Does Section 19 DDA 1995 Catch Volunteers? by
Donna K. Babb
The Disability Discrimination Act casts its net very wide to catch
offenders.
Section 19 deals with the provision of services to the public. Does
this mean that every time anybody offers any service that *could* be
taken up by the general public, they have got to consider all the
implications of the offer being taken up by some cripple ("differently
able person") for whom it was never really...

employment ? by
Lynne W
Hi, I hope you can give me some advice.
I run a small charity. In March this year, we took on our first employee as
a youth club leader. We agreed at interview, that he would be employed for
6 months (i.e. until 30th August), and would only be paid on the weeks he
was attending the club. On 16th April, he informed me he was going to have
an operation the following week, and would be off work...

Attorney General by
Bloomin Heck
Is it usual for the Attorney General tout around trying to
collect evidence to mount a S.42 action ?. By "tout around" I
mean ask a member of the public ,who happens to be a police
officer, to pass his letter around ?.
Thanks

Noise law by
Sim
A new neighbour a few doors away has decided to mow his lawn at 7:00am, this
wakes up the street and causes much tension and stress.
I have shouted over the fence but the neighbour continues to mow his garden.
What further action can I take, is there some legal document I can download
and post it through his post box about noise.
Thanks

Tailgating Cameras, how would this work? by
Jonathan Bryce
Reported at
http://news.bbc.co.uk/1/hi/uk/3742765.stm
A lot of people have the habit of doing an emergency stop anytime they see a
yellow box on a pole, even if they aren't breaking the speed limit at the
time anyway.
There is one particular camera on my way home which is on a 50 mph road, but
everyone seems to feel the need to slow down from about 45 mph to 28 mph,
even though there is a large...

Confiscation of Passports by
martin
Just watched the midday news. It seems that some 2000 football fans have had
their passports confiscated to stop them travelling to football matches.
I would have have thought that this was restricting freedom to travel and
broke EU laws as well as the HRA.
I don't care one way or another about the 'fans', but it seems it could be
the thin end of a very high wedge starting here.
Any thoughts...

Do i now own this? by

I purchased a rather expensive computer desk and cupboard. Invoice was 30
days to pay.
The cupboard arrived marked and I asked the vendor to arrange for it to be
fixed or replaced.
I paid for the desk but not cupboard payment in light of this.
6 months later I received a letter from their accounts dept saying I had an
outstanding balance and can i make payment.
I wrote back advising I was...

Faulty Goods and Consumer Rights by
craig b
We recently bought a car seat from mamas and papas. The seat is only 3
weeks old but after a holiday to Wales now has a burn on the inner
fabric which seems to have been caused by the black strap on the
restaraint heating up sufficiently to burn the fabric.
The car is unmodified and this seems an unusual fault but the burn is
the same width etc as the strap. The weather was sunny but...

New sexual offences Act by
Cynic
Wondering what the general opinion of the group is to the new Act in
general, and specifically the recent case where a person convicted of
downloading child pornography has been prohibited from all contact with
children under 16 under the new provisions. I wonder if this is destined to
become an automatic additional punishment for all future CP cases? Such
prohibition could also be applied in...

How does asubject find out what the law actually is without going to court? by
Demetrius Zeluff
How would a person find out what the law is without going to court,
especially if there is no case law?
I'm thinking about (***but I do not wish to discuss***) the need for a tv
licence for people watching broadcast television services (as defined in
the communications act 2003 and the broadcast act 1990) over a Broadband
connection on a computer not fitted with a tv tuner card.
How would a...

Lost Flight. by
Alasdair Baxter
I booked an Easyjet flight from Glasgow to East Midlands and back over
the Internet. The paperwork I was asked to print out said I had to be
at the airport 30 minutes before the departure time.
I arrived 35 minutes before departure but was refused check-in and the
girl at the desk said that the time was 40 minutes before take-off and
pointed to a notice behind her.
What is the position here?

The campaign group's annual report expressed concerns about alleged human
rights abuses by UK troops in Iraq. It also criticised the holding of 12
suspects under anti-terror laws without charge or trial. The Foreign Office

"Fairford Five" can appeal legality verdict

By Michael Holden
LONDON (Reuters) - A judge has ruled that protesters accused of trying to
sabotage U.S. warplanes before the Iraq war can appeal against a decision
preventing them using the "illegality" of the conflict as a defence.
Last month, judge Justice Grigson said the peace campaigners, dubbed the

I have been asked by some neighbours to write up a petition to our local
council. There is a great need for CCTV in the road where we live. In the
past three months approximately 150 cars have been vandilised. It appears
that it is the same people again and again who are doing the vandilism.
I said that I would draw up a petition, but am unsure of the wording that
should be used. I was also...
