Parking Problem - Council Help? by The Starman
In the cul-de-sac where I live the amount of car owners has rapidly increased and now it's dificult to find a parking place and resident car owners are virtually prisoners in their homes as if you leave your parking space it will not be there when you get back! Also this complication is having a big affect on people, family and friends visiting anyone as there is nowhere to park. There could...

Street Crime UK - PACE by TimB
Just watching Street Crime UK, and noticed an officer threaten to arrest a guy for swearing. Fair enough. The lad then refuses to identify himself, and is arrested. However, the officer simply says "You're under arrest" before 3-4 officers converge on him to bundle him into the van. He is never given the proper caution. Does this make the arrest invalid? What difference does that "you do not...

Knives by a@b.invalid
The CPS guidelines on knife crime http://www.cps.gov.uk/legal/section12/chapter_c.html#07 state that "a butterknife, with no cutting edge and no point is a bladed article; (Booker v DPP 169J.P. 368, DC);" I've drawn a blank attempting to find any more information on this

Road/property boundary by pat
There used to be a ditch outside my property which ran the length of the road. This ditch was filled in many years ago. My neighbour has an evergreen hedge which has, over the years layered itself outwards, extending probably six to eight feet over where the ditch used to be. I started complaining some years ago, when the road visibility began to deteriorate. I have complained every year...

New builds - builders delaying by GB
This is not an issue for me personally, but I keep coming across people who have paid a deposit to buy a new-build but the builders keep delaying actually building the property. From the builder's point of view, say this is a block of 20 flats and they have sold 2, they clearly don't want to finish the block in today's market until they have nearly all the flats sold. Otherwise, they have to...

Employer Acceptable User Policy/Email disciplinary - help please? by bluefizz@zoom.co.uk
Hi I have been asked by a colleague to act as a 'friend' at a disciplinary hearing. I have never done this before. The colleague is not a union member. I understand the colleague received an email deemed unacceptable by the employer. The colleague has only forwarded it to his own home email address to himself and to no one else. I have yet to see the email but I understand it consists of a...

landlord neglecting building maintenance. by Karen Davies
I'm on the management committee of a tiny charity that employs 1 full time and three part time workers, plus numerous volunteers. Their services are used by 20 or so people a day, and a creche is provided for service user's offspring as needed. The charity rents a Victorian terrace, complete with basement and extension, from a private landlord. The roof on the extension has been leaking for...

Claming costs against local authority by J B
I have recently won a case against my Local Authority at a Valuation Tribunal after they ruled that Council Tax sought by my LA was not lawfully due. The case had caused me much hassle and I had to take two days off work to self-represent myself on two separate occasions (apart from travel expenses). Can I begin small claims proceedings against my LA for the costs incurred?

Intellectual capital question by Angus[_3_]
Hello I am a software developer in a fairly specialist area. About five years ago a friend of a friend had a business and we talked about applying my specialist software to his industry. Anyway, I adapted a prototype which could at least be demonbstrated and after showing to a few potential customers his company thought that there was potential in this area. The idea being to sell...

Help needed to interpret my business premises licence by Mark[_10_]
Hello, I am trying to figure out what the following phrase in my licence to occupy means. “the Standard Hours” means between the hours of 9.00am and 9.00pm, Mondays to Fridays (inclusive), between 10.00am and 6.00pm at weekends excluding public and other holidays and such additional times as may permit from time to time;

S.O.S Life is hell due to my neighbour's illegal gas installation AND NO ONE WILL HELP by Alexandra
Sorry this post is so long but please read it and try to help me as I am absolutely Desperate and have no where else to turn. Some years ago my neighbour made holes into a party wall dividing their property with mine and installed two gas flues to drain gas fumes from boilers they were installing at ground level - directly into my courtyard. This work was carried out without my permission and...

Warranty claim rejected due to "Liquid Damage" exclusion by m_sbuilders@btconnect.com
Nice little scam the mobile phone suppliers have going. My son's Samsung E900 developed a fault after 5 months. Phoned Phones4U...went through a well rehearsed ( no doubt scripted) conversation where the caveats were explained in detail. I agreed to go ahead and was sent a pre-paid envelope with yet more explanation on caveats. Sent the phone off, phoned them 2 weeks later for a status check. "...

Human Rights Act by alan.holmes
I live about 5 miles from Heathrow, and every few minutes a very noisy machine passes directly over my home travelling west, it uses my chimney as a beacon. The noise is indescribable, and wherever you are in the garden or the house it is impossible to carry out any conversation at all, and it is becoming very tiresome. So, can I invoke the HRA to make the beggars take off occasionally in...

Builder problems by Gurjit
Hi, I am end the end of my tether with my problems with my builder. I shall try to summarise as concisely as possible. He was recommended to me by someone I trust - he had done a lot of work for him and he came across very professional and personable so I hired him. A lot of communication was done over email including estimates, banter about the scope of works etc so though we didn't have one...

Drivers responsible for passengers actions? by judith
Drivers responsible for passengers actions? There is a spat in uk.rec.cycling regarding the law when a passenger in a car opens a door on a cyclist. It is stated by some that the driver has committed an offence contrary to Road Vehicles (Construction and Use) Regulations 1986 Regulation 105 if a passenger does such a thing - and that the driver is legally responsible and may be prosecuted.

How are crimes described on CRB returns? by pseudoanon
Ann has several (say less than five) convictions for shoplifting, the most recent being three years ago. All times the total goods stolen were less than £250. Bob has one conviction for 'public urination' from 30 years ago. (eg, the chap from BC R4 'You and Yours') How would these convictions be described on the forms returned by the CRB people?

Injunctions - how to get? by pseudoanon
Ann says that Bob (her father) sexually abused her, but this has never gone to court or to the police. Ann's mother has only just found out about the allegations. Bob continues to make contact by telephone, email, and post. Bob also gets Beth (his wife, Ann's mother) to ask Ann to get in touch. Ann has asked Bob to stop making contact. Ann has told Beth not to mention Bob.
