Validity of Agreement without a date by Ken
Just realised that one of our customers has signed the necessary agreement but never entered the date in the relevant space. When opening the post our staff wrote in the 'date received' in our office. Just worried that the customer may say invalid as no date. Any thoughts on this? Ken

Do Agreements that need signing esssentially need witnesses by Ken
I have been looking through some old agreements and it seems some have been signed by the Seller and the Buyer but in front of a Witness who have also signed and stated their address (the witness). But later ones seem to have only the signature of the Seller and the Buyer - no Witness. In my mind I had thought Seller and Buyer only but now wonder if there is any need to get a Witness...

Responsibility for cost of fixing water leak in leasehold property with shared supply (England) by Mouse
I'd be grateful for any advice as to where I stand here - my google skills have failed me. I live in a flat (in England) which is part of a block with six flats in it. The six flats share a water supply. The flats are leasehold, and the freehold is owned by a management company. I am a tenant with an assured shorthold tenancy. (Unfortunately, a dozy tenant who can't find her copy of the...

Statute of limitations on housing benefit fraud by TrentSC[_2_]
I'm trying to get a handle on a potential issue which a friend is going through. It appears that there might have been a degree of fraud, but this was some time ago. Quite separate from whether the council might pursue a case after a time, what's the official line in terms of the statute of limitations on cases such as this? Cheers.

Compensation for overrunning bathroom fitting by friendsofderek@googlemail.com
Hi, I've just finished a marathon battle with B&Q to get a new bathroom installed and fitted. Its taken an extra 6 weeks ( all of which I've been without a shower, 4 of which I was without an upstairs toilet) and I've ended up doing some of the remedial work myself. The work was initially botched really badly and the toilet, basin and worktop had to be replaced and refitted ( in some cases more...

Changing Your Name/Identify: Data Protection? by bob80109@googlemail.com
Hi, Back when I was a teenager, I carried out a rather comical joke that actually got me on television and in the media all across the world. I have grown up alot since then, and the profession I'm trying to get into is a really serious one. Unfortunately, what I didn't realise as a teenager, was that information sticks: I became littered across the Internet and really want the whole thing...

Insurance / potential flood risk by Colin Wilson
Curious what the implications might be of this, although it's hard to know where to start... I've lived in the same house for 19 years, and had never known of any flooding to be prevalent until a building was erected a few years ago right across a road that used to act as a run-off. It's a large building, about 150-200 yards in length, curving around a bend - at which point the other road...

Council playing ping-pong with summons by Dan Green
Recently my local council issued me a court summons over unpaid Council Tax which I did not owe. At the last minute, outside the courtroom doors, their Council worker admitted the tax was not due (unfortunately I do not have a recording of this) and withdrew the summons. I had to take a day off work and commute back into that city by rail to attend the court. I have the withdrawal in writing....

Death, property and debt by Todd
A member of the family has died leaving a number of debts and had no life insurance on the property whose name it was in. He also left no will. He has a wife and children. The mortgage was interest only and from what I can see, the current resale value of the house is about the same amount as the outstanding mortgage. We haven't been able to find any details of any other investment vehicle...

Vehicle Ownership by The Mod
Hi, althouh my question is regarding vehicle registration and ownership, I think this is more of a legal question than one for a motoring group. I am disabled and have disabled road tax exemption. Now you are allowed to use your exemption on a car that doesn’t belong to you, provided it is for your sole use. I am getting a car, that will belong to a private trust and it will be the trust’s car...

Inaccurate news articles about me by Dan Green
Recently I had the privilege (?) of having a plight I was undergoing with my Council published in at least one newspaper in two stories (run up/follow through) over the course of a month. A third story will be published next week with the conclusion of my little saga. The first two stories already have factual inaccuracies and some media glamourising when the reality was a bit more mundane. The...

Grievence proceedure timescale? by Curious
I listed my grievances in writing, then forwarded it to my employer with a request for a grievence meeting several weeks ago. The meeting was agreed, took place and all that occurred was that details of my grievances were taken note of. No answers, just notes taken duplicating those already provided by me in writing. The very brief meeting closed, with a promise to quickly seek more...

What are the long-term repercussions of a fixed penality notice for theft? by Nige
Several years ago, my son was given a fixed penalty notice after attempting to leave a store with goods on his trolley which hadn't been paid for. It wasn't exactly shop lifting, but it seems he did know he hadn't been charged for something and tried to leave the shop without paying for it. A security guard stopped him, called the police, and my son - largely out of embarrassment - admitted to...

Compensation likely? by Cork Soaker[_2_]
A local wine bar ran by a well-known company always has promotional stand outside of the bar entrance. A friend of mine fell over one of these, fell onto a glass and cut the tendons in his arm. 1. He was drunk, very very drunk and in no fit state, but the bar were responsible for serving him alcohol. 2. He had a glass in his hand from the bar, but he shouldn't have been outside with the...

My rights to have interview - possible discrimination (Employment Law) by Chris Darkfire
Hi I hope someone with more knowledge than me can offer some suggestions or advice as to my rights below or whether I have no option but to put up with it. Apologies for the length but hard to explain in brief. Until recently I was employed (for five years) at a senior level as an 'Alpha' & 'Beta' Manager for a medium sized company - what Alpha

Estate Agent Fee query by neilpike@compuserve.com
Selling our house at the moment - standard single agent stuff. Should we pay the estate agents fees for the following situation? Friends have made us an offer, which beats all the ones we've had so far via the estate agents (we've had a few in the 4-5 weeks we've done of the 8 week estate agent contract). The friends did not come via the estate agents and I have verbally told the estate...

npower gas sculpting by Roland Perry
It seems that many people are in dispute with npower about their gas bills, and no, Energywatch and Ofgem do not appear to be showing any signs of helping (helping the 'many people' - my complaint is in its early days). As it happens, I noticed the problem independently (on my Final bill on leaving npower, dated 12th March), and have now got to the point of npower telling me (on Friday)...

Tesco - Libel - The Guardian by judith
Interesting article : http://www.guardian.co.uk/business/2008/may/03/tesco.medialaw In February the Guardian published two articles about Tesco's tax practices. At the heart of the story was Tesco's stated desire to realise up to £5bn by cashing in on the rise in value of its massive UK property portfolio through sale and leaseback schemes - while maintaining control of the stores. Five weeks...

Neighbour built fence on our land by Invisible Man
Hello We bought our current house 18 months ago. It is evident that a neighbour has had a fence built partly on our fairly small garden. As the fence goes down the garden it moves across our boundary for about 15 feet to butt on to the end of our garage which is at the bottom of our garden. It should go to the side of our garage. The concrete used to support the post bridges the damp proof...
