No win, No fee - Availability for businesses? by Bob McCloud
Question: Are any 'no win, no fee' arrangements, or similar, available to small businesses? Using search engines, nothing relevant was found. Any help and / or guidance would be very much appreciated. Problem: Our comparatively very small company has a problem with very well known,

TUPE or Not TUPE (That is my question.) by 80 H
I'm employed by a small company (200 persons) recently acquired by a large company. (Circa 7,000 persons) We have been told that we will acquire the corporate identity of the new organisation but as our company was acquired, we will not be TUPEd into the new company as we are 'already part of it'. We have been told that our Ts&Cs, cars and pension arrangements will remain unchanged.

Wills/probate/public record by A Dodger
I'm aware that a will generally becomes a public record as a result of the grant of representation - I guess it's the probate registrars who physically place the original will in the public record office, or wherever. But... If the estate is so small that no grant is needed, and hence no visit to the probate registry is required - then is it the case that there's no reason why the will...

Owed Money by Alan Smith
My son worked for a plumbing company for 27 weeks. From his wages he was stopped £10 per week for what his employer claimed as a contingency fund in case of damages. He was told that £15 was taken from this fund due to a leak which had caused a small amount of damage to a ceiling. My son inspected the damage the next day & couldn't see any. His wages were put up from £200 per week to £250...

Funeral with out a funeral ? by Mr Nice
Someone I know is dying and says they do not want a funeral. All they want is to be burnt as soon as possible after death and no service or anything. When they die can I just ask the hospital to burn them ?

Employment Law? by Curious
Several individuals at the large company I am employed by, have been singled out to receive no annual pay increase. All the employees are faced with similar levels of individual work load, yet the company has cited as a reason 'inadequate performance'. When invited to back that up with facts and figures, the company goes very quiet. Basically a game of pick out a few to victimise and the...

Notice to Creditors by The Mod
Hi, I have several creditors for old credit cards from a few years ago, I no longer remember what cards they were or how much I owe. I didn’t keep any records or letters, etc. I am wondering what to do about this situation? I can’t contact random credit card issuers to ask them if I owe them anything, as when I tried they asked for account numbers, etc I don’t know and a couple told me they...

Method of payment by News[_2_]
I have a contract to buy goods which comes under distance selling regulations, and I wish to have maximum "payment" protection, as arises through credit card payment. Although in establishing the contract - goods offerd, price to pay - no restriction was stated on method of payment, the trader now (when the goods are now available)advises me that due to his costs in processing a credit card,...

Car accident what if we don't settle insurance? by tonyjeffs
My wife was involved in an accident. She is sure it was his fault - he cut in front of her at a roundabout. He rackons it was my wife's fault. She drove into him while he was trying to exit the roundabout. No damage at all to wife's car. Lots of damage to his. There are no witnesses so we can't prove which version is correct. The insurrers had suggested that we settle "50:50". We have...

Where to send letter before action? by google@woodall.me.uk[_2_]
I've reached the end of the line with trying to get a refund for a mail order item that I returned (by agreement) to a store. I have a signed receipt by the store assistant manager but because it's "not on the system" I cannot have a refund. (Note that the item that was delivered was not what I'd ordered. I was doing them a favour by returning it to the store. Originally I asked for the correct...

Hotel Reservation Cancelled - Loss of Bargain? by Barry Salter[_2_]
Hi folks, I'm not sure what my rights are with regards to this, so I thought I'd ask the experts: On the 26th of February, I made a reservation at a Hotel for the 26th of April. The cost of this was £162 for an "Executive" Room with 2 double beds (4 people), and included breakfast. The rate was described as Advance Purchase, so would be charged to my credit card prior to arrival.

Unhappy with quality of install of new bathroom by friendsofderek@googlemail.com
I bought a new kitchen and bathroom from B&Q and got them to fit both. The kitchen went in fine and the quality is top notch. The bathroom was plagued by B&Q failing to deliver bits on time and the quality of some of the work from their selected contractor isn't acceptable to me. I'm trying to get it resolved via the normal process but I'd like to find out what legal rights I have if this...

Noble Lowndes Annuities Ltd by espty
I have a retirement policy with this group who now seem to have been taken over as I am unable to trace them. As I am nearing retirement, I would like to collect any benefits owing to me. Would any-one know if this company still exists, or who has taken over them.

Copyright damages by G Hardy
A magazine uses my images to illustrate an article. They'd have to pay for stock imagery, but instead they can get bespoke images from me with the proviso that the I'm credited (and my website promoted) at the end of the article. I have a standard price for my images - Can I claim that money as damages if the magazine fails to credit me as stipulated in the licence for using the images? The...

School Books sponsorship scam by Del[_3_]
I got my first hit from the con artists trying to remind you how you agreed 6 months ago to sponsor school books, and now they are sending the bill. I sniffed the scam and they hung up when I asked if they had proof of this, but some Googling tells me they record the con call and I may have slipped too many yes's out whilst confused/before I heard the £249 figure that raised the...

Pricing on shop shelves vs on product by PM
In a supermarket yesterday I saw an end-of-aisle special offer display, amongst the items were half legs of lamb. The shelf labels/special offer flags say 1/3 off, now 4.66/kg not 6.99/kg. Several packs of New Zealand half legs have a special offer sticker and are priced at 4.66/kg. Several more, identical packs have no offer sticker and are priced at 6.99/kg, although they are in the same...

Phorm by a@b.invalid
Quite surprised this hasn't come up already. The technical and some of the mainstream press is reporting stories of some ISPs installing advertising technology on their networks. There is much misinformation on the subject on the web so I'll try to explain the system as I understand it. A third party installs gives some kit to the ISP. The ISP operates the kit but the third party controls...

I'm looking for advice here, suggestions and references welcome. Coveyancing charged only if sale goes through? by Ken
Is this true that there are solicitors, in this country, who will take on conveyancing on the basis of no fee if the sale aborts? Will they insist that the client uses them next time and will it really be NO charge or simply the amount owing is lumped on the eventual bill when a sale completes. And IF it is being offered is it for sellers as well as buyers. Ken

Pay for part-month by Martin Bonner
I am leaving my current employer, and my last contractual day will be Sunday 20th April, whereas my last day in the office is almost certain to be Friday 18th April. My calcution of pay is: I shall work 20 out of the 30 days in April, so I am due 20/30 of my April salary (which is 1/12 * 2/3 or 1/18 or 0.0556 of my annual salary). Their calculation of pay is:
