Children with different surname by
Squeaks
I am getting married next month and will be taking my Husband's name.
My children both have their father's name (my ex husband)which I would
like them to keep. Will it cause problems travelling with children
with a different surname to me on the passport? If so, is there any
way around this ie hyphonating the name so they have my surname and
their father's surname? What are the legal implications...

upkeep of shared unmade road by
jk989898@googlemail.com
To access my house I share a mile of unmade road (& public bridleway)
with one neighbouring property.
For several years I have politely tried to get agreement to repair the
road and share costs.
Every attempt has been thwarted by unco-operative stances and excuses.
Now my neighbour is in the process of divorce & again is not
interested in contributing - even though such work will...

When a debt is in dispute by
Cullen Skink[_2_]
If a debt collection agency contacts you and you write back saying you
dispute the debt or amount can they legally continue to send letters
demanding the money or do they have to go back to the company they are
acting on behalf of and tell them the debt is in dispute and they can go no
further until the dispute is settled?
As you can guess this is in relation to my previous thread about a...

I want to pay cash! by
caroline
Hi everyone. I am getting ****ed off that I can't hardly buy anything with
cash or cheque anymore. I can't see why I should need a credit card to
reserve a hotel room or to hire a car.
Are there any pressure groups that I can join that are campaiging for the
right to be able to buy something without the need for a credit card?

Small Claims, part admission - is it a trap? by
Jonathan[_2_]
I filed a claim against a mobile phone company for failing to refund
six months of line rental fees as part of a "cash back" promotion.
They have responded to the court saying my cash back claim was valid
but that they forgot to send the cheque (three reminders from me by
recorded delivery not withstanding).
However, they say they dispute the amount I have claimed. The rental
fee was £35 a month...

Normally resident by
Nick Odell
I know that in order to claim that you don't live in the UK you may only visit
the UK for x days per year: stay for x+1 and the revenue can claim you as a UK
taxpayer. But what about the other way round? Does one forfeit ones right to the
benefits and responsibilities (and taxes!) of being a UK resident if one stays
away too long.
My son's gap year looks as if it might turn into a gap decade. He...

adverse possession query by
jk989898@googlemail.com
Can a person who has placed pallets of building materials on another
person's land and then left it for 'years' have any reasonable chance
of claiming the land (under the building materials) by adverse
possession or any other means?
The landowner (i.e. me) is aware of the situation and has verbally
granted permission in the past on a 'for the time being' basis,
however as the years go by one's...

Woodland Boundary Problem by
ww
Hi,
My mother owns a small piece of woodland. A neighbour owns a small woodyard on
the eastern side and a house and paddock on the southern side. He asked if he
could take a short cut home though the woodland sometimes and we said yes.
Recently we were surprised to see he has put up a wooden stile on the boundary,
(it's our fence).
He has asked several times in the past if we want to sell the...

Lost Holiday! by
Ivar
Hi all.
I started working (employed) for a company (full time) last may. I was told
I had 29 days holiday per year, including the bank holidays etc. Last
November I took 7 days of annual leave + the bank holidays. Last week I
enquired about how much annual leave I had left. It was then that I was told
the annual leave year goes by the calander year, not the finiancal year and
that all the...

Threat from digruntled photographer by
Squeaks
Hi,
I recently had a quote from a company for a DVD recording of my
wedding. The original quote was extortionate so I said no. He then
offered to do it for a lot less, and I said yes by e mail. He said I
would need to send a deposit to secure the booking.
In the meantime, a family friend has offered to do the DVD for even
less. Not wanting to look a gift horse in the mouth, or upset the
family...

small claims court: collecting payment by
Fred
Hello,
I had some trouble with a removal firm. Unfortunately I had to go to
the small claim's court to sort it out. I won but a couple of months
later they still have not paid up.
What can I do? I think there are three ways to get your money:
1. bailiffs
2. an order on their bank
3. deduction from their wages

Faulty Computer Goods by
Bookworm
I purchased an external DVD Writer for my computer. There was software
provided by the manufacturer in the box. I tried to load this software
into my computer and it caused such serious errors to the computers
system to the extent I have to take the computer to an expert to be
repaired. The cost will be about £69.00.
After consulting the manufacturers help line (in line with the vendors
returns...

Minimum Wage Query by

My daughter is currently undergoing her pre-reg year for her optometry
qualification having already completed her BSc. She is currently
earning a training salary of £10,000 a year and the company insisted
that she sign a 2 year contract where they have the option to employ
her for a second year (after successful completion of her General
Optical Council exams) at a salary of £30,000. If she...

Fake ID culpability by
bob4097@googlemail.com
If an underage drinker uses a very good fake ID in a pub, is the
landlord still going to get in trouble? If not, who gets the rap, the
kid (16) or the parents? What will be the likely outcome considering
the kid has been brought home by the police before, drunk (the kid,
not the police), after trying to run off without paying a taxi fare?

Refund or Credit Note? by
Humbug
Last week, I found this device
http://www.maplin.co.uk/Module.aspx?ModuleNo=221173&C=Maplin&U=SearchTop&T=emprex&doy=12m2
on Maplin's website, and went to their shop in Colindale to buy one,
as it seemed to be just what I needed.
After three days' use I found that it is actually quite a poor
product.
I took it back with all packaging intact. There was no
shrink-wrapping, or even nasty little...

Notice periods by
G Hardy
One of my relatives runs a beauty salon and employs her staff (as opposed to
them "renting seats", which is the norm for that industry). The employment
contract states one week notice period for both employee and employer.
One of her employees handed in their notice this week but offered three
weeks notice. She doesn't want the employee to work their notice, but also
she doesn't want to pay...

Cancelling an insurance policy. What makes a cancellation 'legal'. by
Mike Barnard
Hi all.
I sold a motorbike on the 16th of November last year. I wrote
cancelling the insurance policy and enclosing the certificate of
insurance on the 21st. However, they took a payment from my account on
the 28th.
Having spoken to them, they say they have recieved the certificate but
didn't know why, that I should only cancel the policy through their
online system and therefore the policy is...

CRB Check - time span of records accessed. by
John[_10_]
Would records as early as 1972 (pre-common use of computers) be accessed in
a CRB Check?
I am looking at applying for a part-time job in my retirement from a HR
management post, which asks about records - and as I can see no relevance
and prefer not to rake up the past. The incident was a minor one which
resulted in a £60 fine. I also lost my job as a result but was later
re-instated as I...
