Adjoining Semi may be split into two homes by Gio
Hi, can I ask if anyone has experience of a normal domestic adjoining house being split into two homes (Scotland) ? My initial thoughts having been initially told on the doorstep tonight by the neighbour were to dig my heels in and complain given it might create extra noise and devalue my own home. I assume it will have to go through planning and perhaps align with the deeds so I might be...

Minors being sued by Daniel G
I wonder whether someone can help me with a point of law. A firm of so-called civil recovery specialists has sent a letter to my 15 year old daughter demanding money, and threatening to take her to court if she does not pay. The sum is quite a substantial sum for a 15 year old girl not having any job or independent income. These people state in their letter that they can legally demand money from...

rights of "next of kin" under mental health act? by bealoid
What rights and responsibilities does a next of kin (as defined by the Mental Health act) have? I'm especially interested in any rights to visit the patient in a mainstream (not MH) hospital, at the request of the patient, outside normal visiting hours when the patient has been detained under section. (And is it any different if the patient hasn't been detained, but would be if they...

Knocked down by an elderly driver by D.M. Procida
This morning I was knocked off my bike by an elderly neighbour, who drove into my path and towards me from a side road. She saw me, but instead of braking got muddled and hit the wrong pedal (I heard the engine rev up, and she said so herself). Fortunately, it all happened at fairly low speed, and while I went bouncing onto my backside in a puddle on the pavement, and have a couple of new...

prescription by gsgs
if the doctor refuses to write a prescription, could I bring the case to court ? Where can I find such court decisions ? Are there certain drugs which have to be prescribed in certain circumstances or can each doctor freely decide ? What are the guidelines, previous decisions ?

Spent convictions?? by BB
Hi One of those pub discussions. If you have a criminal conviction does it ever come off your record? While we're about it there is only a certain time that you have to inform insurance companies of motoring offences but are they always with you on record? If you're "done" while being a minor it's said to come off at 16 but is this true or is it still in that litle folder? Cheers me dears BB

Employer responsibility for me when being driven by Mac[_2_]
Hi My job is basically a van driver. Occasionally I am required to act as a drivers mate for one of a pool of about 30 drivers. My problem is that I'm happy to drive myself but the driving standards of some of the drivers I am driven by is dangerous (too close to vehicle in front, using a mobile while driving etc). The company makes basic checks on its drivers when they employ but the...

County Court Judgement & Warrant by Neil
I've recently been successful in a MCOL action. Judgement was awarded in my favour on 22.01.08. I'm fairly sure that the debtor is on his last legs financially and want to get the bailiff in asap before there isnt anything to go at. Is there a minimum period after judgement that I must allow the debtor ? Many thanks

My ex who I have shared parental responsibility with and according to my solicitor shared residence has applied for mediation via his solicitors and they have just contacted me asking me to go in for a meeting with them. I would be very grateful for some advice on my legal position regarding a miserable and depressing situation I find myself in with a builder, who is now threatening to take me to court over unpaid monies! I asked the builder to quote for a major building project on my house, involving knocking down walls between a number of rooms, building new stud walls, plastering and decorating rooms,...

If a person is convicted before a jury of say 3 crimes of say handling and given three custodial sentences of 12 months for each crime, how can that persons appearance before a) the magistrates court be taken out of the record b) the Crown Court be taken out of the records c) the Appeal Court be taken out of the records so no evidence exist of any of the 3 convictions. Hi All This is a consumer question. I to a local key cutting firm specialising in car keys. I needed a new battery for my vauxhall omega 1996 model key fob. The key fob is separate from the key and is used to open / close the central locking and turn on / off the alarm at the same time. I was told that you couldn't replace the battery but had to buy a new fob - for £150. As you couldn't...

EU Law Preliminary Reference by Himani
An academic question to do with Preliminary reference: Could someone please explain this If a court (e.g.) the county court refuses to apply an EU regulation. Does that mean that the county court sees it as an Invalid regulation ? Or simply that -although the regulation may be valid, it does not apply to a case. If you need the brief details of the case, please let me know.

Redundant or not? by adamwatson@sogetthis.com
The company I work for is closing the office where I and my colleagues work and wants to move us all to an office 30 miles away (1 to 2 hours away, depending on traffic). Our contracts say,"Your normal place of work is XXX. You may be required to work elsewhere." I thought that means I may have to visit customers. HR say it means they can move the office and not pay any relocation...
