Charging for incompleted work by D.M. Procida
We agreed to do some web development work for a client, and they agreed to and accepted our (both written, and explained in person) proposal for how the work should proceed. After a significant amount of work was done, the client decided they weren't happy with the way things were progressing, and pulled out. The reason work did not progress nearly as quickly as it should was that the client...

Lodger's agreement (long) by lodger73
At the beginning of October I have signed a lodger's agreement and paid 8 weeks rent deposit. I have respected all the lodging house rules, but the landlord has made my life and the ones of my fellow housemates really difficult. Fist we had builders in the house for almost a month, but after that it was fine. Now after an attempted visit from Health Environment Officers from the council (there...

Companion at Dismissal Appeal by BigAl
Under Schedule 2 to the Employment Act a worker has the right to have a companion at disciplinary hearings and dismissal appeals. This person can be a co-worker or a trade union representative. However, in the case I'm helping out on, the person appealing the dismissal was the sole direct employee and had no union involvement at all. For various reasons I know pretty much everything that...

Quad bike death woman by Daytona
I can't help feeling that the poor woman who collided with the child has been treated appalingly. Not only has she had to suffer the incident itself, but she has then had her name blackened due to being arrested on suspicion of causing death by careless driving while under the influence of drink or drugs and released on bail. The fact that the police now say that no charges will be brought...

Builder got parking fine :-( by sk8terg1rl
Hi everyone, A builder who came to my place to give a quote for some painting & roofing work got a £60 parking fine. The painting work is covered by insurance. From a legal standpoint, there is no question of guilt as they parked in a pay-and-display area without buying a ticket. I feel I must take some responsibility as I did tell them if they are quick and we keep an eye on their van, there...

Defendant's bankruptcy (additional) by Howie
(Civil action for financial compensation and loss). So it looks like one of the two defendants in this case is going to declare bankruptcy before the case is heard. What is the procedure? Should they inform the claimant and the court? If so, How will the case proceed?

Broker Fee by janemcdoe@hotmail.co.uk
Hi It would be great if someone can help :-( I arranged a loan for a client and it was agreed at the outset that I would be paid for this by the client. The fee was to be either by way of a commission/remuneration to be "discussed". It was never discussed. What do i do now, as no actual rate or fee amount was ever agreed. If I invoice the client what is reasonable, is

Recording of conversation as evidence by G Hardy
Can a recording of a conversation - telephone or otherwise - made without the other party's knowledge or consent be used as evidence in court? Is it legal to obtain evidence in such a way? Both parties need to be aware of the recording in advance in order for it to be admissible as evidence. If neither party is aware the conversation is being recorded, it's illegal. Either party can...

Partnership switch by KlausTowers@gmail.com
Hi, A friend of mine started a partnership and got into a trouble with a competitor at an early stage. Initially, the competitor threatened with legal action but later stopped responding to enquiries aimed at settling the matter. This leaves my friends business potentially exposed to a future law suite (possibly after his business picks up and there is more value in his business to sue over)....

Civil action and defendant's bankruptcy. by Howie
Hi. I have a theoretical question regarding bankruptcy at the same time as a civil action. I am wondering.. If a case has gone past the stage of the return of both allocaton questionaires, and the defendant becomes bankrupt before the hearing, will any resulting award agains the defendant be included in the bankruptcy - effectively making it impossible for the claimant to receive the award?

Builders Dispute by poseyflump[_2_]
I am in disputes with a builder for defective and incomplete works. As the dispute has been ongoing for 2 years and to avoid my own bankruptcy I felt forced to sell my home (the property in question). I could not realistically afford to pay a mortgage for a property i could not live in as well as rent an alternative. I have been advised that since I sold the house, I passed on the liability. ...
