Damages of more than the claimant's loss in tort by Derek__M
I'd appreciate people's views on this: I'm looking into a case for a friend who was "caught" selling an event ticket on ebay. She was selling it on behalf of someone else so she is not party to the contract. But tickets apparently had small print on them stating that they should not be sold and, further, that they remained the property of the event holder at all times. The event holder is...

Land Law and adverse possession by albertroland2005@yahoo.co.uk
I know someone who has purchased a house. The seller said that they have been looking after one of the sheds adjoining a communal yard even though he knows it actually belongs to his neighbour. He signed an affidavit saying he had looked after the shed for the past 5 years and then said if the purchaser were to continue using the shed for the next 7 years then providing he isn't challenged and is...

Passport countersignatories number by kinoblemeister@googlemail.com
Hi Guys, Does anyone know when this rule came into play-that countersignatories on passport applications must supply their own passport number? Also does anyone have an 'older' passport form from 2005/2006 that they could scan section 10 (countersignatory section) into and upload it to see if it was a requirement then? All the best,

Agency Termination by richardhayes123@hotmail.co.uk
Hello I hope someone can help me on here. I am tied to an agency to sell a certain product. I have fallen out with this agency big time, and they have terminated my agreement, but before they did they suspended me in order to "investigate" the situation. The terms of the contract state that any termination period is 3 months. This they have adhered to, but at the same time have maintained the...

David Lloyds membership by James
I seem to have gotten myself into a bit of a pickle with membership at a David Lloyds fitness club. I was interested in joining, and booked a time to go and see a sales advisor on 31st July on my way home from work. When I got there the advisor showed me around then spent some time explaining memberships. I was tired, and said I wanted to go home to think about it and discuss it with my...

Double vs Single and no notice yellow lines by Paul D.Smith
Can someone explain what the difference is between "Double Yellow Lines" and "Single Yellow Lines where there is no notice to indicate a period of time during which retrictions apply". I can't find any so I'm wondering why the two both exist? It seems like single yellows and no notice might be a way to catch unwary motorists who are careful not to park on double yellows! Paul DS

Party Wall Act and highway excavations by utilities by robert@invalid.invalid
The Party Wall Act mentions excavations below foundation level within 3m of an existing wall. Do the provisions of the Act apply to such excavations carried out by Utility Companies and Highway Authorities in the road adjoining the front wall of a street fronting terraced house. Or do these companies have rights which over-ride the PWA ? Thanks

Photography in Shopping Arcade by A
I was recently stopped from videoing a performance in a new shopping arcade. The security guard touched my shoulders and stated that there was a no photography policy and asked me to stop. I stated it was for private use only but that made no difference. There were no signs stating photography was not allowed, the arcade leaflets did not state any restrictions and the staff could not provide me...

Solicitor has destroyed my papers!! by albertroland2005@yahoo.co.uk
I got divorced over 30 years ago and the matter was dealt with by my solicitor. I went to see him as I need to contact my ex-spouse. My solicitor says he cannot help because he has destroyed all documents over 15 years old. Is this acceptable practice? I appreciate that documents and files cannot be kept forever but I would have expected microfilming/scanning at very least!

Car hire failure by the Omrud
This is in early stages and I'm hoping a satisfactory solution will be reached, but I'd be interested in comments. Sorry for the length though. I booked a hire car from a rental agency (or broker?) based in Ireland, to be collected from a named office in France at an agreed time and date - mid afternoon on a Sunday. The opening hours of that office were stated and covered my requirement. ...

Solicitor Exchanging Without Authority by boringbastardpeter@hotmail.co.uk
Hi Group I was buying some appartments, and i had mortgage offers on them, however, there was a condition in all of the offers that they were subject to an audit valuation. (basically an independant check on the valuations) Before this additional valuation took place the solicitor under pressure from the developer could not get in touch with me and instead took authority to exhange from the...

Does this breach sub judice ? by Daytona
I'm trying to understand sub judice as I believe that I may have heard something which qualifies. If whilst commentating on someone who's been charged with an offence, a respected and expert media presentor/commentator makes a comment such as "no jury's going to find him guilty on that one" to an audience of millions, does it put any trial in doubt, to what extent, and why ? Thanks

Is email "in writing" by pugwash
I tried to terminate a contract. Under their Ts&Cs this had to be in writing or by telephone. Their telephone system cut me off after going through their auto-attendant options so I checked their web site and sent the termination by email to the email address on their "contact us" page. They replied saying they don't accept termination by email. I thought email was legally "in writing" - or am...

We have lived together the whole time but now we have now both met someone else and want to move on with our lives. Neither of us have/want anything from the other person.

Small claims document deadlines? by Litigator
Hi, am currently suing for a website that was completed but not paid for. Client is claiming that the site was never completed to their satisfaction. They had access to the site after it was finished and downloaded same, have made very marginal changes (slight variation in colour shade, plus one or two very minor changes) and are currently trading online with it. They had seven days (in the...

How do I reply to the PoC in this case? by Howie
Hello everyonel. Hope you can help here.. Without wishing to go into the case itself, I have recently been served documents by an ex-client for breach of contract and, in replying, I have a couple of problems to work around: 1/ There is no copy of the contract attached to the PoC, despite the first paragraph, which states: "By a contract made 28th November 2006 between the parties (the
