Intent as an ingredient of crime by
GB
Opening my Saturday Times, I found two articles side by side of drivers
convicted of causing death by dangerous driving.
The first was a diabetic who got his blood/sugar balance wrong and blacked
out. 4 years 6 months for that.
The second was a lorry driver who has an undiagnosed sleep disorder and fell
asleep at the wheel. Sentence to be determined but he was told by the judge
to expect...

Can I claim my time in preparing a defence and counterclaim? by
Howie
Hi all.
As you probably know, I am defending a claim and it has involved
approx 50 hours work and preparation, plus a number of phone
calls and trips to witnesses etc.
Can I include notional amounts within my counterclaim for the
costs associated with this effort and time?
Is there a specific way to cost them or can I just decide what is
reasonable and back it up later if necessary?

Canoeist case by
Roland Perry
According to BBC:
"The first charge he faces is that on 16 May 2003 he
fraudulently obtained £25,000 from Unat Direct Insurance
Management Limited by deception, by falsely representing that he
had been killed in an accident on or about 21 March 2002."
But if you are playing dead, how can you represent anything at all
(falsely or truthfully). And wasn't it his...

Photographic Copyright by
TheOldFellow
I've been sent a scan of an old portrait photograph, and I'm trying to
help the owner to identify the sitter. She owns the photograph, but I
suspect that the copyright subsists with the photographer, or his/her
heirs in title, as it has a Keswick Photographer's stamp on the print.
Our suspicion is that the photo was taken some time before 1920, but
it's hard to be absolutely sure.
If I were to...

DPA and baptismal records by
gb
The National Secular Society has looked at how someone who has left a
religion can compel that religion
a) to amend its baptismal records (eg where a baby never consented to
belong to a religion),
b) to refrain from using the individual's past membership
statistically (eg to obtain public funds for faith schools). (http://
www.secularism.org.uk/debaptism.html).
So...I imagine the NCC would...

insurance query..laptop damage by
topgooner71[_2_]
Hi All.. wondered if anyone has had any dealings with claiming for
laptop damage on accidental cover. (household)
VERY annoyingly today i spilled a cup of coffee down the front of my
laptop. (and it is just 8 weeks old)
Laptop not working now, and started smoking a little (presume that
means it is very dead.)
Have looked through the small print in the insurance booklet, and it

Legal aid by
a@b.invalid
BBC Radio 4 have just run a programme on legal aid.
http://www.bbc.co.uk/radio4/unreliableevidence/pip/avg47/
In amongst the many statistics (about 19 minutes in) were the thresholds
at which legal aid in criminal cases is granted. I thought it worth
pointing out that the thresholds given (£12,000 and £21,000) contradict
the estimates made previously in this group.

Executor approval to release payment to beneficiaries by
Sarah[_2_]
I'm hoping someone here can give me some advice. My dad died 3 years ago,
and the vast majority of his estate went to my stepmother. However, there is
a small payment of around £5,000 each to go to me and my siblings. Everyone
is in agreement that the money is to go to myself and my siblings. My
brother as executor has given approval to release the funds.. My stepmother
won't respond to the...

setting up a trust by
John Dee
2 sons stand to inherit cash once I get probate, a condition of the will is
that it's put into a trust (each) until they reach 25 yrs, unless I wish to
use it for them (e.g. for their education) at my sole discretion).
Any pointers as to where I go for basic advice on how to set up a trust? Do
I really need to see a lawyer? (or an accountant?) or is there a DIY
solution?
Thanks for any...

Defendant fails to file papers by
Roland Perry
A county court case (small claims track) I'm helping a claimant with
rumbles on, and
yesterday was the 14-day deadline for filing documents and witness
statements.
We got our bundle in, but the defendant hasn't bothered, and I suspect
they thought we'd given up.
A really basic couple of questions:

Prison rules and benefits by
aaaaaaaaaa
A relative of mine has just been sent to a Liverpool prison.
Last month what with the Liverpool postal strike he managed to get 5 visits
instead of 4.
I have seen a notice somewhere in the prison that states that by law only
two visits lasting half an hour are allowed each month but they give 4
visits as normal practice.
This month they have give my relative only 3 visiting orders and said...

Lying in small claims hearing by
G Hardy
Is there an accepted way for one party to deal with a situation when the
other party lies through their teeth at a County Court hearing? We just
opposed an application to set-aside a judgement, unsuccessfully. The
claimant lied about their efforts to resolve the matter outside court, and
the DJ did not give us any opportunity to protest.
In reality, it was likely to be set aside anyway (the...

Inheritance/executorship question by
Henry Ross
I'd be grateful for comments on whether a crime has been committed here, and
what the next steps should be...
A grandparent dies and wills a considerable bequest in trust for their
grandchild's education. The trustee (the grandparent's only child, who is
also the executor) decides to spend the money on their house and so the
funds are no longer available for the grandchild.
Can the...

CPR complaint procedure by
G Hardy
Is there one? What's the first point of call?
Our claimant presented the DJ with a document today which was acted upon
(affected the outcome) without disclosure to us. Is there a collective
opinion on whether we should complain or just get hold of a copy of the
document?
