Right of way access by
rjre
This was also posted on uk.rec.walking and was suggested to be posted
on here.
My wife and I recently bought a house knowing that the local angling
club had access to their lake via the corner of our driveway. We were
informed by the vendors and agents that this was a "gentlemans
agreement" for pedestrian access with occasional vehicle access for
maintenance with prior arrangement. Nothing...

Royal Mail & undelivered mail by
Invisible Man
Royal Mail apparently will be charging fees for understamped large
greeting cards this festive season.
If addressees refuse to pay and there is no return address what happens
to any valuable contents?

Requiring evidence of name change by
bealoid
Anyone can change their name at anytime, so long as they don't have the
intent to defraud. All they need to do is start using their new name.
What do these people do if they find a service provider who wont change a
name until either a deed poll or marriage certificate is produced?
Could data protection laws be used to force a change? "My details on your
system are incorrect, please amend...

District Judge Error - what can I do? by
ethel
Today I went to court against a major bank, requesting that they be
ordered to comply with a DPA SAR and pay me damages.
The judge misinterpreted my claim to mean that I wanted compensation
only - even though my Particulars of Claim clearly stated "The
Claimant seeks an order that the Defendant do comply with the
claimants subject access request".
I told the judge that the case was requesting...

Administration of drugs in the home by
Him & Her
Really long story cut as short as possible.
Today we have had to sign a letter / statement confirming that
should we use the cylinder of entonox in our home without medical
supervision, it is against medical advice and could lead to
complications and possibly even death.
Whilst we have always been aware of the risks associated with
it's use for this particular family member we feel they...

Out Of Court Agreement by
Kontaminator
What's the best course of action in offering/resolving a legal dispute
outside of the courts. By this I mean, getting the company trying to
take me to court to agree not to take such action in an official capacity?
I walked out of job, they claim I owe them for the 'extra' money they
had to pay out for a contractor to cover my 'statutory notice' period.
They owe me unpaid holiday, unpaid...

DDOS Attack - A crime? by
Neil Monk
Hi,
If a sever is falling victim to a DDOS attach (a blatent DDOS attack, no
question about it!), is this a crime, and if so under what Act(s)?
How would one go about reporting such a crime? Would the local plod take it
on, pass it on to NHTCU or should the server owner gfo directly to NHTCU
(and if so how)??

Two defendants: How will an award be split? by
Howie
Hi all.
(Civil case). I understand that if an award is made in favour of
a claimant and there are two defendants, both of them are equally
and fully liable for payment of the award. However, lets say that
they are awarded time to pay and that, - after a few months, one
of them becomes bankrupt and therefore never has to pay his
'share'. Does the other one have this extra amount added to...

Pro Bono Expert Witness by
GB
I do occasionally do pro bono work as an expert witness, where I think
there's a need. There's a recent case that has just come up which I am
considering doing on a pro bono basis, but where I am pretty sure that the
claimant is going to win his case, in which case the defendants can meet his
costs.
What I would really like to do is get my fees paid if the claimant wins, but
without the...

Abbey - Delay in closure of deceased account - options? by
AlanF
Morning all
My late father had an ISA with the Abbey.
Have sent copy of Grant of Probate (sealed) along with copy of Death
Certificate (certified) with a request signed by all executors that the
account be closed and a cheque be issued payable to the executors jointly..
I received an acknowledgement approximately a month ago that all was in
order with the documentation (which was returned)...

List of ASBOs served? by

Is there a list of ASBOs served on people, and what conditions were
imposed?
I'm thinking about a local chap where 'they' were trying to get one
imposed, but then I went away for a fortnight and forgot to look it up.

Police, stop and search, again! by
a@b.invalid
This month's "Photography Monthly" contains a letter triggered by
liberal, police harassment sensibilities. Encounters such as this are
being reported more frequently of late. I'm hoping that the more well
informed members of the group can reassure me all is well. The letter reads:
"During a lull at an airshow I pointed my lens in the direction of a
teenage girl's bottom whose shorts were...

Questions to experts: Is this correct? by
Howie
Hi all. Wonder if you can help me with this one?
I have a claim against me for breach of contract. The contract is
specifically mentioned in the PoC and the basis of the contract
itself is to follow architect drawings (as stated in that
contract).
Also, in the PoC, there is a surveyor's report (submitted with
the claim documents themselves).
Following the guidance notes for CPR35, I have sent...

Hi guy's
I'm remain a 1/3rd share holder in a company I resigned as director 10 weeks

Extradition by
a@b.invalid
Yet another obscure question.
The issue of extradition to the US has come to the fore again recently,
with the news of the please bargain in the US and the appeal to their
Lordships.
A quick skim of the legislation leads to the following phrase:
"may be arrested and returned to that state"

Move in and foudnd a water leak! by
Gary
Hi,
I just completed on my new home yesterday and when i entered the
property there was a sizable leak from the hot water cylinder in the
loft.
The water has soaked the wood in the loft, made slight damage to artex
ceiling and wall and soaked the upstairs landing carpet. Not something
i expected to be fixing first thing on entering the property.
