Move in and foudnd a water leak! by
Gary
Hi,
I just completed on my new home yesterday and when i entered the
property there was a sizable leak from the hot water cylinder in the
loft.
The water has soaked the wood in the loft, made slight damage to artex
ceiling and wall and soaked the upstairs landing carpet. Not something
i expected to be fixing first thing on entering the property.

Planning permission outside development plan boundaries by
teddysnips@hotmail.com
My brother and I inherited a field on the edge of our village. It
falls outside the boundaries of the local development plan, and we've
been told that we won't get planning permission to develop it.
Fair enough. However, my brother is on a back-to-basics jag, and
would like to turn the field (55 acres of prime arable land) into a
working farm, to try to achieve some self-suffiency etc. Would...

Getting paid - stopping equipment working by
Robin Gray
We are a small firm supplying and installing computer servers and desktops.
Normally we get approx 50% of invoice value up front and the remainder on
installation or shortly after. All our quotations, order forms and invoices
contain a prominent retention of title until paid in full statement. We
have had a couple of instances recently where customers have not paid on
time - in a current...

Council Enforcement - commercial premises? by
A.Lee
I'm self-employed, doing minor building and maintenance works.
I work from home (i.e. do not have a factory unit/office).
Today I had a call from the local Council asking me if they could
inspect my garden as they have had a complaint that I am keeping piles
of trade waste (old fence panels/building waste) in my garden, and they
suspect me of running a commercial operation from my...

Absence of evidence as evidence by
News Admin
An Italian friend wrote to me earlier today asking how the British
police would deal with an absence of evidence as proof of a crime.
The thing we were talking about was the murder of Meredith Kercher where
it appears only one fingerprint has been found from Amanda Knox in the
flat where she lived. BBC reports seem to support this.
The question my friend asked was (paraphrased): "With all...

Exclusion from 'after school club'. by
G Hardy
A local parent does not pay his childcare bill in advance, as required by
the TS&Cs of the after school club. This means that instead of paying for
the _place_ at the care facility, he's able to only pay for the _sessions_
his children actually attend. So (for example) he'll book a place every
Monday, but when Grandma can look after the kids, he refuses to pay when
she's got them.
OFSTED...

Garage Door - What Should I Do ? by
Martin
Recently had an up and over door and frame installed which replaced a 20
year wooden door and frame which had started to rot.
On the day of installation I asked the installers to leave a 1cm gap at the
base of the frame because of drainage issues, they said OK without further
comment.
Rain is now entering the frame and I have asked the salesman / junior
surveyor if the Company could plug the...

Limitation Point by
Tommo
This thread should perhaps be called 'Ping Andrew McGee' but the views
of others are welcome.
Here is a not so hypothetical situation:
Company A sells goods to B; B in turn sells them to C. C alleges
defects.
C issues Court proceedings just a matter of days shy of the 6 year
limitation period, but holds back on serving the proceedings

Tenancy Problems - Long by
JTGuy
Any landlord/tenant experts in? Mind if I go into a few details?
Apologies for the long post.
Just suppose that a residential tenancy for a house was established in
1985 under a verbal agreement - no written contract. It seems this makes
it a 'regulated tenancy', covered by the Rent Act 1977. This means the
tenant is well protected against eviction, and has a fairly modest,
registered rent,...

Problems Getting Rental Deposit Returned (long) by
Chris Jobson
Apologies for the length of this post, but it seemed better to tell the full
story.
We rented a house 3 years ago on a normal AST. Rental was done through an
agency but landlord lived next door and was quite friendly. About a year
into the tenancy landlord moved out to travel abroad and subsequently sold
his house. Soon afterwards the agency told us the landlord wanted to take
over...

Lands Tribunal Form R by

Form R is available from the Lands Tribunal in PDF format, with the request
that it is filled in 'preferably typed'. However, the PDF cannot be typed
into, and there is no Word document version. How do you legal eagles get
round these sorts of minor hurdles?

Issue with court hearing by
petemc
Just yesterday I had a hearing with a judge about a small claims issue
I've got going. The short story is that a company hired me to
photograph the interior of apartments with a wide angle lens. I did,
and provided them with the images. My client joined me on the day and
was happy. They were happy with the work and after asking to be paid
for 2 months and being told I would be they turned...

Dear All
Thinking about putting an offer in on a property, but whether I do

What if a juror does this? by
Roger Dewhurst
What happens if one or more of the jurors at Scott Watson's trial write to
the Attorney General and/or the Crown Solicitor thus:
"I was a juror at the trial of Scott Watson. At the trial I was not
permitted to read a transcript of the evidence. Having now read a
transcript of the evidence, in its entirety, I say that I now consider Scott
Watson innocent of murder beyond all reasonable doubt...

British or not that is the question? by
morganMPC@googlemail.com
Thanks to all that answered my last question.
Now here is a real puzzle for you.
I was born in South Africa in 1954, my parents were out there working
from 1953-1957 and both of them are British, South Africa was at that
time a British colony. Three years later they returned to good old UK.
I was sent to school in this country, received my national insurance
card when I was sixteen, swore...

eBay's responsibility for and attitude towards fraud by
D.M. Procida
It seems to me that eBay does everything to make fraud possible and easy
(because it makes life easier and cheaper for eBay, not because they
welcome fraud).
I found a listing today which I am pretty certain was fraudulent:
http://cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&item=220161872864
The seller was vague and evasive when I spoke to her on the phone,
particularly when I asked why the...

Tax Receipts by
Elephar[_2_]
A friend runs a business and in pursuit of which he needs NNTP access.
He pays a monthly fee to a US based company and pays by way of credit
card.
He needs a receipt for tax purposes but the company refuses to issue one.
He asks, is this in accordance with doing business in the UK or does UK
law insist that companies issue receipts?
