Tiscali by
Web&Mail
I would like someone's advice on the proper steps to take against
Tiscali.
A web based contract for broadband began with a promise by Tiscali to
have me up and running with broadband for 07th July. I heard nothing.
In their web based order tracker pages they suggested a 2 week waiting
time above the date promised.
Early September I sent a web mail via their pages to ask why I was

Paying legacies by
Eric
Having just about gained probate over my late relative's affairs, I
now need to sort out some legacies that are mentioned in the will. One
of these is to a specific, named monastery of a religious order. The
monastery closed sometime ago and I have information that some of the
inhabitants moved to a monastery in a different part of the country. I
assume that the others were distributed to other...

Copyright damages by
G Hardy
We were at a local "factory outlet" store this afternoon, and (for a laugh)
spoke to the two people offering image reproduction services. The first was
a facility to print a photo (digital or reprint) onto canvas. The second was
a lady who produced a painting from a photo. Neither said they wouldn't
reproduce a copyright image from a professional wedding photographer*
although the painter...

Where there's a will... by
Theo Delight
.... is there a way around it?
I'm in the process of rewriting my will. As there's not likely to be
much involved and as it would be relatively simple - a few specific
bequests of certain items to appropriate museums and to certain
others, with the residue either going to one person or to be divided
equally by more than one person - it hardly seems worth it to have a
lawyer draw it up.
What...

What happens if the expert does not respond to questions under Part35 Questioning? by
Howie
Hi again everyone.
Hope you don't mind answering a quick question about questions to
experts:
I have written to an expert asking questions under CPR rule 35:
http://www.justice.gov.uk/civil/procrules_fin/contents/parts/part35.htm#rule35_6
However, to date, I have had no reply. If there is no forthcoming
reply before the case is heard, can I have the expert's original
report disregarded? The...

I have had no success in searching for the above Regulations on-line. So I
am going to assume they do not exist on-line, unless any kind person can
tell me otherwise, and kindly correct my assumption.

Lunacy? by
Theo Delight
Following the question of seemingly worthless titles raised in the
other newsgroup, I had a look at a site claiming to be selling one
acre plots of the moon. In their FAQ section (http://
me.moonestates.com/faq.php) I found the following gem:
6. What if someone else tries to sell me land on the Moon?
Should anyone else claim to be selling Celestial Property in the
United Kingdom, they are...

Separation, Kids and Relocating... by
Steve[_2_]
We've been separated now for nearly five years, we have five kids, four
with me, one with my ex. We both currently live near each other in the
North West.
She wants to move back to Scotland and take my daughter with her, which
is fine my me if it's what she wants, plus the schooling is so much
better there IMHO.
Anyway, I now have a very good sniff of a lucrative job in Germany, and
I'm...

Intrum Justitia / Britannia Music & Video (In Administration) by
John L
I am, or should I say was, a member of two of the Britannia Clubs.
Correspondence from the DVD and Music clubs dried up ages ago and their web
site went inactive sometime in the summer.
As far as I was aware I did not owe them anything, I had usually paid bills
online.
However, on Friday I came home and found a letter from debt collection
company Intrum Justicia claiming that I owed £18.88.

Accident claim to continue a little longer by
Steve Firth
I've posted here about the lengthy case following an accident when
someone drove into my car about four years ago. It took yet another
twist recently.
A date was set for a hearing and neither the defendant nor their
representative appeared. Another application was made for a default
judgement and this was awarded to me after the defendant failed to
respond.
Last week the defendant's solicitors...

Confidence Trickster - concerned about a relative (long) by
David Wright
Mother in law (lives on her own, is registered disabled, but is only 48 and
a confident, outgoing and independent person) has met a rather extrovert
couple in Tesco, who were carrying a burmese cat around in a bag.
Being the inquisitive type of person she is, she struck up a conversation
with the couple to ask about the cat - the couple apparently are homeless,
and living in a B&B, having...

YIPs experience anyone? by
Wm...
Has anyone here any experience about how YIPs work in practice?
http://www.respect.gov.uk/members/article.aspx?id=7810
Brief background: I have decided that not pressing criminal charges (for
now) against a 12 year old already on bail would be better for all
concerned. After meeting with the police, Mum and child YIPs came out
as the most sensible initial route (plus some stuff at school,...

Data Protection - Trading Standards and Unsubstantiated Complaints by
Nogood Boyo[_2_]
Sole Trader A lives and works (as a kitchen supplier) in the area of
Local Authority 1. Customer B lives and works in the area of Local
Authority 2. Some time ago B complained about A to Trading Standards
for LA2. A spoke to TS2 and thought he had convinced them that the
complaint was unfounded. B then got solicitors involved but A refuted
the complaint in detail and heard no more about...

Forced house auction by HM Revenue & Customs by
BigAl
Why does everything happen at once!?
2nd question of the day.
A and B split up. Not married but children all of school age.
B (being the mother) stays in mortgaged house with children. A pays towards
children's upkeep plus housing costs. No longer resides on the premises.
House in joint names.

Problem with landlord / small claims court by
Marco
My wife and I are having a dispute with the company which owns our
flat regarding a bill for repairs carried out several months ago. Soon
after the repairs we received a formal letter from them confirming
they would reimburse us, and asking for the receipts. We sent them
copies of these and heard nothing from them.
A few months later we called them and were told that the person we had
been...

Copyright and hotlinking - any case law or handy reference? by
Mark Goodge
I'm currently involved in a debate on a web forum about the rights and
wrongs of "hotlinking" images (that is, using an img tag in your own
website that references an image hosted on another site that is not
yours and is not under your control).
Can anyone give me any examples of cases where this has been found to
be, or not to be (as the case may be) an infringement of copyright,...

Intestacy - who is entitled? by
Robert[_2_]
I am endeavouring to administer the estate of a relative who died
intestate and I am trying to work out who the likely beneficiaries are.
The 'What to do if there is no will' page on the DirectGov site
http://preview.tinyurl.com/ywcfp4 gives a list of relatives who could
inherit but I wonder if someone can help explain the priorities.
In this case there a

Truanting kids : whos responsibility by
James[_2_]
I read some time back about a mother who went to jail as she couldn't get
her child to go to school.
I was wondering for example say you have a "regular" family mum and a dad,
married etc and one of the kids doesn't go to school and they prosecute the
parents and someone has to go to jail. How do they determine who goes ?
Also how long a period in jail would they receive.

Yes or No answer only by
Dave Baker[_2_]
Can a witness in the dock be compelled to only answer a question put to him
with "Yes" or "No" if he feels that neither is appropriate?
Even if counsel tries to force such a response would it require the judge to
impose such a condition on the witness or he risk being held in contempt or
can it simply not be done if the witness refuses to comply?
