medical report by suffix
Is my employer supposed to write to me at the same time as they write to my doctor to obtain a medical report ? I expresed a wish to see it when they wrote to me to obtain pemission to write to my doctor. At a meeting, I asked that I was allowed 21 days to see the report but as they did not write to me to say they had wrote to my doctor for the report, they seemed to dismiss this and said they...

Sexual Assault query by The Todal
A woman in her 20s is sexually assaulted whilst drunk. She can barely remember what happened as she was almost unconscious, but there were two witnesses who were very indignant and put a stop to it. The assailant was a man much older than the victim, who had been drinking with them all and appeared friendly up until the point when he committed the assault. There is an additional factor...

"Fluid" boundary query by Broadback
At the bottom of my garden is a pool. My deeds state that my boundary finishes at the waters edge, my neighbour's state his finishes in the middle of the water. Now having been in the property for a little of 7 years the pools is silting up and weeds have now taken over, all that remains in dry weather is the stream that flows through. It seems to me that, in not too many years, the pool...

Any disadvantage in buying the freehold for my house? by susie2007@operamail.com
I was reading here http://northernireland.shelter.org.uk/advice/advice-3777.cfm that I can buy the freehold on my house which I own outright. It's a semi-detached house, not a flat. It's not expensive to purchase the freehold, and I know there are many centuries left on it.

Can I force a witness to appear in order to devend a civil action? by Howie
Hello all. I am about to defend a civil action for breach of contract. In the contract, there is mention of a set of architectural drawings which, I contend, were innacurate. Is it possible to force the architect to appear in court when the case is heard, in order that I can ask him some questions about these innacuracies?

Is there any legal liability attached to an Employment Tribunals which issues a perverse judgement? by glutinous
Is there any legal liability for a Tribunal panel (of three members) which issues a judgement which is demonstrably perverse i.e. seriously at odds with the evidence and the law? For instance, if this causes one of the parties loss, and is intended to do so, can this be considered 'Conspiracy to Defraud' or Fraud, or any other such ? I'm assuming these people have some sort of immunity which...

Laws governing relationships between barristers (acting for claimant/respondent) and Employment Tribunal chairmen? by glutinous
An underlying principle of an Employment Tribunal is that it should ensure the parties are on an equal footing, and that a party can choose (or may have little choice other than) to represent themselves as a layman. I suggest it is employers, particularly those with many employees, who are more likely to called to Tribunals than any individual employee. The employer, and moreover presumably...

Bankruptcy, is this right? by Bob Hardwell[_2_]
A friend of my daughter's was declared bankrupt in May of this year but my daughter has told me that her friend is spending money like water and has even booked and paid for a holiday next year after she is discharged in May 2008. My daughter asked her friend how she managed to have so much spare money and was told that although she had been made bankrupt, no one had ever contacted her and...

"Particular Formality" by cappri@gmail.com
Looking at the unfair terms in contract regulations ( http://www.opsi.gov.uk/si/si1999/19992083.htm ) Schedule 2 (1) (n) of The Regulations says a term which may be regarded as unfair, has the object or effect of limiting the seller's or supplier's obligation to respect commitments undertaken by his agents or making his commitments subject to compliance with a "particular formality";

Managing agents unfair renewal contact by Nick Lamb
I live in a block of 21 flats, last year we employed a new managing agent to take on the running of our shared free hold company. We have just received a renewal contract for next year and there are several areas of concern, some of which I would question if they are legal practice. One such point regards our reserve funds (fairly healthy in excess of 25k). he states that interest earned on...

Refund when contract not signed by G Hardy
We've got a customer who wants her booking fee of £500 returned, as her wedding has been cancelled. The way we schedule payments is a 33% booking fee at the time we're booked, 33% payable three months before the wedding and the balance due on or before the wedding day. We call it a "non-refundable booking fee" because we understand that in many circumstances, the refund of a "deposit" can be...

Parking law query - CPZ bays by Richard J.[_2_]
I'm trying to understand the legal requirements for marking out residents' parking bays in a Controlled Parking Zone, and in particular where a double transverse line (at right-angles to the kerb) is needed, as shown at http://www.opsi.gov.uk/SI/si2002/023113bm.gif . On one side of my road in London there is a long series of bays interspersed with yellow-line loading gaps. (A to B on the...

What is the legal position regarding a law firm which breaks the law? by glutinous
Can anyone explain to me the legal position regarding a law firm which (for example): can be shown to have advised their client to ignore/break law(s) in order to conceal matters of public health & safety? exploits their familiar relationship with an Employment Tribunal to induce the ET to ignore ET Rules of Procedure? If the employer has been harassing an employee who made a protected

Council Provision of Childcare by Ferger
Straighforward questions, but I'm struggling to find a source online that can answer them. In essence: Can a council, in provision of after-school childcare, make a profit from the provision? I have no idea whether there are constraints in the way that councils recover costs for this kind of social provision.... Can they charge different rates for eg parents in receipt of child tax...

Damages of more than the claimant's loss in tort by Derek__M
I'd appreciate people's views on this: I'm looking into a case for a friend who was "caught" selling an event ticket on ebay. She was selling it on behalf of someone else so she is not party to the contract. But tickets apparently had small print on them stating that they should not be sold and, further, that they remained the property of the event holder at all times. The event holder is...
