Problem with hotel provider company, can I sue them ? by
tg[_2_]
I booked a hotel room from a well known internet room provider in July. I
received a confirmation email with all of the booking details. I did not pay
them anything as I had to pay the hotel on departure. Two days after
receiving the confirmation email I then booked my flights. Four weeks later
I received an email from the hotel company stating that "due to a technical
error" the room I had...

Asbestos dust to be spread over Cumbria by
Theo_Delight@yahoo.co.uk
http://news.bbc.co.uk/1/hi/england/cumbria/7019414.stm
Is this quite legal?
Doesn't asbestos waste have to be safely and strictly contained,
rather than letting it be blown about by wind after the demolition?

Is this blackmail? by
Bookworm
I am a Sales Agent that has just been virtually forced to resign from
an agency. ( they wish to give the customers I brought them to a paid
rep and thereby save paying my commission). There are regulations that
cover contracts for Sales Agents. I am able to claim Idemnity, (which,
according to the regulations, means the average of the last five years
commission paid for one year) or Compensation,...

Final Cost by
Ivar
Hi all.
A company is going to take me to court over £800 that they think I owe them.
If they win then I will obviously will be ordered to pay, and I suppose they
will ask for other costs from me.
Are there limits as to what other costs can be brought against me if I
loose? They may say that their legal team has charged £500 per hour and want
10 hours, or that the company has spent X...

Party Wall and DAS Insurance by
Chaudhry Nijjhar
Hi,
We are retired aged Asian couple. Myself 74 and wife 70 but we have a
troublesome neighbour who has started to encroach upon our land. Recently,
he applied for extension bordering our detached house fence. In his
drawings, he is showing gross encroachments and the drawing do not reflect
his boundaries but the Council says a person can apply for planning
permission on any one's land and...

Acting unreasonably in a small claim by
Roland Perry
A person is suing a company for subcontract work to the amount of a
little less than £5k, in a case now allocated to the small claims track..
The company being sued has issued a defence saying "you are suing the
wrong company", "the person who commissioned the work from you, in fact
had no right to ask you to send us the bill; even though we paid your
similar bill on his instructions the...

Do I have a right to repair or repalce our water supply? by
Addison
We live in a house that is part of an old estate. When the estate was
broken up the land between our home and the road was sold to a farmer.
Yesterday the water main between us and the road burst and the farmer
denied us access to repair the pipe leaving us without water. Rather
cleverly the water company was able to restore water to our home
without accessing their land.
I do not believe...

Data question by
May Merry
Hi,
Our small charity was awarded a grant to pay for a publicity mailing
to our members. We did the mailing and then put in the claim. The
grant awarding organisation is now asking for a complete copy the
mailing list as "evidence" to pay out the grant.
When we said this was not allowed under our data protection policy,
they said that just names and cities would be OK. I think that's
still...

Is it possible for the moderators to work out some sort of schedule for
moderation?
I have 2 messages still waiting to go through since before 11am on 20th
September (now yesterday morning). There is one poor person whose message
has been on the list, waiting, since 11:30 pm on 19th September (the day
before yesterday) - over 24 hours! I can see around 15 messages awaiting
moderation.

Disability discrimination and anxiety disorders by
Deano[_2_]
I have recently been diagnosed with Social Anxiety Disorder (a
"recognised medical condition"). Briefly this means that I suffer
reactions when asked to meet people and generally be around them
(meetings, 1-to-1's etc).
My job involves a lot of this sort of activity. I have asked if I can
step down a grade whilst I try to get to grips with this (I've had
cognitive behaviour therapy to try and...

Small Claims Track by
Ferger
I've recently issued a Small Claims Track action against an ebay seller who
flogged me a faulty working LCD TV and failed to come and collect. After
much ****ing around, I sent it back Parcelpost: They have never refunded,
don't answer phone, prevaricate occasionally by email.
I issued the action against the company that billed my credit card, at the
address they use for returns, and on the...

Offset mortgages and banks going bust by
google@woodall.me.uk
There are two different types of offset mortgage (that I'm aware of).
One (called the One account) works like a large overdraft facility on
a current account.
The other has a mortgage and also a savings account where the savings
are used to offset the the mortgage and so reduce the interest payable
on the mortgage.
Consider a person who has a 70k mortgage and also 70k of savings. In

Query about the laws of "trespass" by
Dark Angel[_2_]
I have a hobby in photography, and as such I find myself often straying from
the public footpath to photograph things of interest.
Now as I understand it, if you are caught on someones private land as long
as you agree to leave you can't be prosecuted (provided you werent caught
"breaking in" somewhere).
However as many of the photos on my website clearly give a record of me
being on...

Duty Free and advice from shop by
bealoid
Ann goes on a cruise. The ship has shops on board. Ann sees a nice watch,
costing more than £150 GBP.
Ann asks if she'll have to pay duty or taxes when she gets back to the UK.
She's told that she won't. She's not sure that's right, so she asks again,
making the question very clear. She's told, again, that she won't need to
pay duty.
Ann buys the watch.

Contract/SOGA - Incorrect Goods Supplied by
Traveller
Comments and views on this (real) scenario
- I ordered product X from an online retailer A for £Z
- I have been shipped product Y, which is of a different specification and
inferior to product X
- I expect that A will offer to refund my money and collect the goods
- What I *really* want is for A to supply me with product X at the agreed
price of £Z (and yes, they've already taken the money...

data protection in the US by
Chris Lawrence
As a UK individual I am looking to purchase an item from a US
distributor (www.ecost.com). They have advised me that in order to
process an international order they require the following:
1) We must have a copy (legible) of both sides of the credit card, this
may faxed or emailed. We must be able to read the numbers on the card.
2) We need a copy of your identification with a picture...

Detention vs arrest by
a@b.invalid
I'm having trouble finding a definitions of what, exactly, are meant by
the terms detention and arrest.
In theory arrest should be easy to identify, but in practical terms it
appears to be indistinguishable from detention (by a PCSO, store
detective or under stop-and-search powers) - both involve handcuffs and
physical force to prevent escape.
The only difference I can make out is that...

O2 mobile phone change of terms and conditions by
Simon Finnigan
Hi all,
I`m currently with O2 on contract, with 5-6 months left to run. They`ve
just decided to start charging for 0845, 0870 and 0800 numbers, rather than
allow them to come out of your inclusive minutes. I contacted them in
writing asking for the termination of my contract, and stating that I
consider their change in terms to place me at a significant disadvantage
(which is the term used...
