Would interest and compensation due under the late payment legislation
fall under section 5 (simple contract) or section 9 (statute) of the
Limitation Act 1980?

I have had experience of these types of covenants due to the fact that for
the last 7 years I have held a number of senior sales position, where they
are quite common.
I assume your notice period is 6 months - any restriction is unlikely to be
upheld for a period longer than that which you have to give as notice.

Divorce, Partnerships & Chancery by

I am told that if a married couple who are partners in a business decide to divorce, the case goes straight to Family Division rather than first dissolving the partnership through Chancery, distributing the proceeds from the partnership and then going off to Family if there are other issues that need to be resolved. Is that right and if so, why not go down the Chancery route first?

I don't believe he says he is resigning....
If he is negotiating his exit, agreeing to these clauses may allow him to
leave immediately, rather than after 3/6/9/12 months.
If he ignores it, and breaks them, he could find that court proceedings
are issued against both him & new employer - breach of contract and
inducement to breach contract.

In my Ramblers Blue Book I have read that if a RoW is blocked by a
gate or fence whatever I can remove the gate.fence even if I have to
damage the gate/fence or lock in doing so. Normally I could be
convicted of Criminal Damage but if I believe I am protecting a RoW
from danger I have a perfect defence. However my Blue Book is now
quite dated so does anyone know if this still is the situation...

Can anyone tell me if my elderly dad is entitled to a refund of the £30
court fee?
Back in December 06 he issued a claim in the courts against a local Council
(small amount of money less than £100). He paid the £30 court fee and to cut
a long story short the defendants eventually settled out of court and paid
