Wine stain by uk.rec.gardening
I went for a meal at my local hostlery this evening. With it I decided to have glass of red wine. As the barman was taking my payment he knocked the wine over me. Not only did I not get any apology, I also had to pay for my refill and, as I was wearing a cream coloured top, my clothes are stained, as is my underwear. It also meant I had to go home as I didn't want to spend the rest of...

Late Payment Act & Limitation Act by Andy Lord
Would interest and compensation due under the late payment legislation fall under section 5 (simple contract) or section 9 (statute) of the Limitation Act 1980? Thanks for any help. -- Andy

RESTRICTIVE COVENANTS (UK EMPLOYMENT LAW) by salesguy
IANAL I have had experience of these types of covenants due to the fact that for the last 7 years I have held a number of senior sales position, where they are quite common. I assume your notice period is 6 months - any restriction is unlikely to be upheld for a period longer than that which you have to give as notice. You say you are negotiating a deal to leave - redundancy or are you

Employment terms by Mike Brayshaw
A charity (of which I'm Treasurer) has offered a post to a new employee, which has been accepted. The written details specify the post as unpaid but with tied accommodation. However, in short, the interviewing panel (appointed by the charity trustees, but not including any) exceeded its powers in making a verbal offer of payment in addition to the accommodation. As I understand it, that...

Divorce, Partnerships & Chancery by Fesour
I am told that if a married couple who are partners in a business decide to divorce, the case goes straight to Family Division rather than first dissolving the partnership through Chancery, distributing the proceeds from the partnership and then going off to Family if there are other issues that need to be resolved. Is that right and if so, why not go down the Chancery route first?

RESTRICTIVE COVENANTS (UK EMPLOYMENT LAW) by Leaver
Hi Please can someone advise me...Is this worth the paper it is written on? I am negotiating a deal to leave the company I work for, and this part (it's also in my contract) forms part of a letter they have sent to me. Other bits such as confidential information I understand and will

possible split by kittykat
My husband and I have been married sixteen years and lived in rented flat until this year. we have had our own bank accounts for the last 12 years as he is good with his money and I am useless. I inherited some money last year and bought him a 15000 bike, and he has 11000 savings in bank where I put the rest of the money 58000 towards a house in joint names, even through we were not getting on...

Glasses lost during car crash by John
Hi, My car was hit from behind on a motorway, I span round, hit the crash barrier, bounced back into lane 1 and believe I was hit by another car, I then managed to steer what was left of my vehicle onto the hard shoulder. I was wearing my glasses before I was hit, but not by the time I got out of my car. The insurance company of the driver responsible for hitting me are refusing to pay out for...

RESTRICTIVE COVENANTS (UK EMPLOYMENT LAW) by salesguy
I don't believe he says he is resigning.... If he is negotiating his exit, agreeing to these clauses may allow him to leave immediately, rather than after 3/6/9/12 months. If he ignores it, and breaks them, he could find that court proceedings are issued against both him & new employer - breach of contract and inducement to breach contract.

Criminal damage/right of way. by pete
In my Ramblers Blue Book I have read that if a RoW is blocked by a gate or fence whatever I can remove the gate.fence even if I have to damage the gate/fence or lock in doing so. Normally I could be convicted of Criminal Damage but if I believe I am protecting a RoW from danger I have a perfect defence. However my Blue Book is now quite dated so does anyone know if this still is the situation...

Claiming back court fees? by Redwood
Can anyone tell me if my elderly dad is entitled to a refund of the £30 court fee? Back in December 06 he issued a claim in the courts against a local Council (small amount of money less than £100). He paid the £30 court fee and to cut a long story short the defendants eventually settled out of court and paid my dad an amount which also included £30 to cover the court fee that he had...

Indefinate Leave to Remain lost if we divorce? by Wisteria
I am an american citizen married to a UK citizen, and have lived in the UK more than once, this time for about 5 years, with indefinate leave to remain as his spouse. We have a child who was born here and had dual citizenship in the UK and the US. I want a divorce, but my life is here now, my child's life is here now, and we don't really have anywhere or anyone to go back to in the US, plus I...

Unmanned level crossings? by Theo_Delight@yahoo.co.uk
With the exceptions of the Chinnor and Princes Risborough Railway (SI 1994/1803) and other railways specified in similar Statutory Orders, it would seem that unmanned level crossings are illegal: http://snipr.com/1n3or Railway Clauses Act 1863 (c.92) 6. Company to erect lodge at point of crossing.

Data Protection Problem? by The Wanderer
Just had a letter personally addressed to me from MoreThan inviting me to insure my car with them. I'm presently insured with another company and the insurance is due for renewal on 11th June. MoreThan's letter doesn't specifically say anything about my insurance being due for renewal, but it's timing strikes me as *highly* suspicious. MoreThan is a subsidiary of Royal & Sun Alliance. I've...

copyright problem by bro bill
This sounds like a bit of a con, so any thoughts would be welcome. My son recently bought a CD album featuring a little known band off e-bay. A few days later someone purporting to be a solicitor e-mailed him saying it was a copy, and that he had acted illegally in purchasing it and must send ten pounds to him for the copyright as he was acting for the band. This person also said the seller...

hypothetical question - defamation of an anonymous person. by Patrick Gosling
Under what conditions might a person posting entirely anonymously to usenet newsgroups successfully sue another person for defamation (I apologise for being uncertain of my terminology - I'm using "defamation" as a catch all). Note that (as opposed to the case people usually think about), in this case it is the subject of the defamatory comment who is anonymous. My initial thought was that it...

pre hearing review by Bob
Hi all. A previous employer of mine owes me unpaid wages and holiday pay (That's my opinion, his is different). I am taking him to an employment tribunal which he will be contesting. I have now been notified of a pre hearing review. The purpose of which is to determine the validity and value of my claims. SO: what do you do at a pre hearing review? Will I have to make a presentation, ask and...

drink driving laws and penalties by lmeister
I have been looking into the history of drink driving laws and penalties and have read elsewhere that the offence only became a recordable offence, ie stored on the Police National Computer, sometime in the mid 1990's. I have searched the regulations re Recordable Convictions, however I can't get the 1985 SI online. I can find that failing to provide a breath test became a recordable offence in...

adverts on coins by bealoid
A local pub has some small round stickers printed with their name and address and some ad blurb. They stick these to one pound coins, and put those in the till, to give to people in the change. (They don't cover the Queen, if that makes any difference.) Are they breaking any law?
