Magistrates Court - case details by
Daytona
A case my parents are interested in as bystanders is coming to court
whilst they're away on holiday. What, if any, details would be
available to members of the public after the hearing ?

Yet more help with Money Claim Online please by
GB
I am chasing up old debts of my practice, and I filed a claim with money
claims online. It's a pretty straightforward case. We did the work and the
client did not pay the fee. No defence was put in, and I asked for summary
judgment, which was granted.
I contacted the defendant by telephone with a view to collecting the money
off him. He told me that he had filed a defence, but the court had...

Solicitor to remove name from house deeds by
Vkatek
I would appreciate advice anyone can offer. Currently I own a property
with two other people and all our names are on the deeds and the
mortgage. One person wants to come off the mortgage and deeds and we
are currently dealing with our mortgage provider to sort this out.
However we have to have a solicitor involved but I wondered if anyone
knew the exact procedure the solicitor has to undertake...

Proceeds of crime/fraud/theft by
Andrew Gabriel
ISTR there is some Act which makes it an offence for a company
to try billing a customer for transactions which are the result
of crime/fraud/theft or some such. Can anyone cite the Act please?
In this particular case, I'm thinking of mobile companies trying
to charge for unauthorised reverse charged premium SMS texts.

Unwanted phone call from Housing Association by
Nel
Yesterday my wife took a call from the Housing Association of home that we
rent. Basically they were asking questions regarding another tenant who
moved close by about 6 months ago.
The street is a lovely cul-de-sac and this tenant has moved in from a slum
area and has wasted no time in turning her house and garden into a sh*thole!
The house was a palace with the previous tenant, with landscaped...

Theft/assault by
daydream
My husband (who is not English) reported his bicycle stolen to the British Transport Police a few weeks ago. A week later he found it in the basement garden next door! The occupiers of this flat are notoriously bad - all with drug problems and known to the police. We have reported their behaviour a number of times, but nothing has ever been done. One of them has threatened my husband with his...

UK Polititical Party Manifesto - Legal Status? by
Patrick
Hi all,
I recently e-mailed The Electoral Commission to ask how a UK political
party's manifesto is viewed in legal terms. The response that I got
suggested that a manifesto has no formal legal status, although its content
would obviously be subject to general civil and criminal law.
Does anybody dissent from that position?
What I'm really asking is whether the contents of a manifesto are...

Puzzle regarding reminder concerning non-payment of outstanding bill for flat purchase by
Nick
Yesterday I had a letter as an attachment in an email from my solicitor
regarding the purchase of my flat 6 months ago:
"Further to my letter of 13 February requesting a cheque for £168.76 I have
not heard from you. Could you please send this cheque to me as soon as
possible."
I certainly didn't recall receiving such a letter. Most letters were sent to
me initially as email attachments.

Land unregistered despite being sold after compulsory registration by
Mike Arnold
I am not having much success yet in getting an answer from the Land Registry so wonder if someone here can help me?
A piece of land (part of a private road) was sold by a private individual to a Company in 1985. Although compulsory registration for the area started in 1952 the land remains unregistered.
Although there is (I believe) evidence that money changed hands in the purchase...

Local planning policy by
Farouq
My local authority has introduced a planning policy whereby specific
properties on a road have been designated as 'properties of
exceptional character'. These properties are now subject to planning
rules that make it impossible to do anything.
I have a number of questions that I hope some of you may be able to
answer:
1) Should they have consulted with the affected owners before
introducing the...

Student grants by
Daniel G
I would like to establish the exact legal position of means testing for student grants. When means testing is required prior to the payment of any state benefit it is always to establish the means of the benefit claimant, if they are adult. The responsible authority would not demand a means test on the aunt, uncle, mother or father of the claimant, as well as a means test on the adult claimant...

What powers do the magistrature have, really? by
Big Bill
I seem to recall reading that lots of people get jailed by magistrates
illegally. Only ignorance of the law by the, um, the jailees allows
this to happen. Does this ring any bells with anybody?

Canecelled Scheduled Airline booking by
Rodger
I recently booked a scheduled flight with Monarch. There was no
mention that it was a discounted flight, that particular restrictions
applied or that the ticket was non-refundable. I also read the Ts&Cs
and there was no mention of it not being refundable.
I have had to cancel the flight booking - Monarch have said that I can
sell the ticket to someone else or use it within (I think they...

Airline tickets refund policy by
Mark BR
I have been reading the refund policy for a number of airlines. I would have
felt that some of the budget airlines terms (but not necessarily those based
in the UK) would be illegal.
There are two common areas:
If you don't fly for your own reason - whatever that is - wouldn't the tax
always be refundable since this is not paid by the airline if you are not on
the plane.
