Hi all, I hope that someone may offer some advice. I run a small attraction open to the public and last summer had an elderly lady who whilst walking behind her friends did not see a step in the garden and so fell breaking her wrist and shoulder. She is now claiming damages. At first our insurance was rolling over but we said no way, fight it as we are regularly inpected by HSE and have all...

Question
does tenant have right to access rear gate? by gordoncolton
Hi there, having lived on a large housing association estate in north london for some years now, most of the tenants and I have had a key to access the rear pedestrian gate on the northern part of the estate(which is also where my block of flats is);this gate gives us access to local shops and services which are much closer to where I live than the other entrance which is on the southern tip of...

Solicitors harrassing me? by diamond
I am about to sue my bank with regard to harrasment for a debt that I dispute. One letter from the banks solicitors trying to recover the 'debt' states I will be liable for their costs if it goes to court. As it is less than 5k I believe they are wrong and that they (being solicitors) know that. I can only assume that they are trying to harrass me into paying. Am I able to count this...

Data protection act and on-line forums by cp
I am a member of the moderating team of an on-line forum. And this question has just come up. Can a member of the forums use the data protection act to request copies of discussions that have taken place in a private moderators/staff only area of these forums? The forums are run by a company resisted under the DPA.

Would this be an 'unfair term' in a property lease agreement by News Admin
We have a 99 year lease on a flat and that lease states that whilst the task of maintaining common parts of the building shall be executed by the freeholder the costs thereof are to be borne by the lessees. It further states that should the ground rent (£10/year) remain unpaid then the freeholder has no obligation to maintain the common parts at all. We have no present disagreement but I am...

Dentists Comments by Martin
My NHS dentist has left to go private and the practice has assigned another dentist to me. My first appointment with the new dentist was for a "check up". His first comments were about the large fillings in my mouth. He particularly drew my attention to three teeth next to each other. He said if any one of these fillings came out he could not refill and I would need to have all three teeth...

Cash back and reasonable times by Michael Hoffman
In August I purchased a mobile phone from an online vendor. Subject to remaining on the same network tariff, they offered a series of cash back payments over the first year. I used this company for a similar deal over the previous year, and had no complaints--all payments were made on time, within 45 days. This year, in the terms I received with my invoice, it says, "We aim to process all...

Download a will by D.M. Procida
Is there some particular form that a will needs to be in? I'd like to download a very simple will ("All my property to be divided fairly and equally between Persons X, Y and Z") but obviously to avoid any potential issues. Any recommended online sources? Thanks, Daniele

When is a relative not a relative? by BobC
I, like a few on this group I guess, get called upon occassionally to sign friends' passport applications. There is a stipulation that you must not be "related" to the applicant. The question is, what is a relative, or how close do they be to have to be excluded? I can understand immediate family but what about, say distant cousins?

Prisoners 'voting rights by chrislex
Prisoners'voting rights in UK is a contentious issue after the 6 October 2005 judgment of the European Court in the Hirst v. UK case which decided that the convicted murderer in jail retained his rights to vote, whereas the government believes that convicted prisoners have cast aside privilege and entitlement to vote. Query how stands the matter at present when the issue is not resolved. In...

When does Debt Collection become harasssment? by Paul Cummins
Hi all I'm currently in dispute with a large USAian credit card issuer, over Penalty Charges. Not naming them, but they won't stay in my wallet for long. As a result of the dispute, they claim I am now in default, and are calling me to seek payment. The question is, how many calls is reasonable in a 24 hour period.

Faulty goods return policies. by Topref
I have been reading a forum on a motoring website where someone has bought two Tom Tom sat nav units, one of which is faulty. He purchased them from an on-line retailer. The retailer insists that the purchaser sends the unit back at his own expense with no prospect of a refund of that cost. The guy is asking if there is something under the Distance Selling Regulations (or similar) that would...

Inheritence Tax Question by Fat Freddy's Cat
Since none of my posts have appeared on the other thread, I have a question regarding the IHT... The OP stated - "House share - has been valued at £70K" Which immediately made me think "what share? 1/4, 1/2, whatever?" since I believe IHt is assessed on the value of the estate, not the share each individual gets (but that is my question, is this the case?)

Planned trespass and damage by a charity by H5N1freechicken
A group of researchers went to private land (and the underground mines contained within the land), drilled stone core samples from the owners disused mines then removed the spoils. The researchers knew that they needed the owners permissions to visit, and that one owner had required that he was present during any visit or activity, and asked the researchers to contact him with proposed dates for...
