arrestable offences by
archytas[_2_]
Back in the old days, an arrestable offence was one that carried a
maximum sentence of 5 years or more (except for twoc). These days all
offences are arrestable. Does anyone know if the use of the term
arrestable offence in Housing Acts now means the latter?

White lines on roads by
Mark Goodge
It's not unusual, particularly in urban areas, for roads to have a
separate lane to the left of the carriageway for cycles and/or buses.
Such lanes are delineated with white lines. These lines have a
non-zero width.
The question is, are the lines considered part of the lane that they
delineate? Or, to put it another way, is the width of the
bus/cycle/whatever lane measured to the inside of the...

This is complicated. by
soddemall@gmx.com
I run a small business, and advertised a job (job centre plus), the
vacancy was for just a few hours as and when needed, max of 16 hours,
advertised as employed or self employed.
I preferred employed, but self employed people also held an
attraction, in any case after an interview process, i employed a
youngster who seemed very very keen, well turned out, etc (though
admittedley from a...

Cancelling or amending a codicil by
Stephen Mawson
Codicils to wills are numbered ("This is the third codicil to my Will
dated....") so that when the will goes to probate a codicil is not omitted
deliberately or by mistake. If there is a requirement to amend the effect of
the last (only) of several codicils, should that last codicil; (a) simply be
destroyed and replaced with a new codicil of the same number; or (b) be
destroyed and replaced...

Refunds on services by
Budweiser
Hi,
I run a small web design firm and have a number of clients who pay us a monthly retainer for ongoing improvements to their websites and search engine optimisation.
Each monthly payment gives them a number of hours in a 'pot' that can be dipped into as and when they need to - there's no expiry date.
Recently, one of our clients has asked for a refund of his hours for the last 3 months as...

Financial elder abuse by
goonergee
Would the following scenario be a breach of criminal or civil law?
Individual raises invalid power of attorney (i.e. power of attorney witness signed blank document). POA then used to gain access to elders bank account. Contents of account emptied over a period of time for purposes which were clearly not to the benefit of the elder. No accounts were maintained by the individual. Elder dies and...

Should We Sell His Stuff? by
NeedSomeHelp
A group of eight of us have been working for a wealthy gentleman - let's call him John. For the last 12 months we have worked (without a contract - handshake basis) and been paid monthly.
Now the work-site has changed hands (against John's wishes), and another group is coming in to take over the work. We have asked John for the salary he owes us for the work we did over the last six weeks, but...

maintenance by
BB
Hi
About two years ago my partner and I separated.
My son (now 18) sort of floated about between us but worse case scenario
would be he was deemed to live with his mother. My daughter (now 16) lives
with me but visits her mother regularly. The mother and I only live about 4
miles apart.
There has never been any maintenance given or asked for either way.

Restocking Fees - Returing Incorrect goods? by
bjblackmore
Hi,
I've been trying to find some details on restocking fees and the distance selling regulations. Last month I ordered some network equipment, but when it arrived it turned out I'd ordered the wrong size. I phoned the company I'd ordered from, and asked for the correct size items, and to return the incorrect items, (which had been opened, but it was only a cardboard box with a sliding lid, no...

Tenant fees by
a@b.invalid
Would someone point me in the direction of a guide to the law
surrounding fees charged by letting agents to tenants.
Some of the fees quoted seem to be greatly out of proportion to the
costs (e.g. £300 for a credit check).

Hi all,
Can someone clear this up for me, i know it's been discussed now and again

Train Ticket fine with court summons :s by
tortoise79
I was issued a train ticket fine in 2006 and told by the ticket
officer I may be exempt because I was able to show him lots of tickets
I'd bought previously. He said I'd receive written correspondance
about what would happen next, ie. if I had to pay a fine etc. I
received nothing for weeks so assumed I had no fine.
Now I have been asked to pay court fees and the fine, totalling £270
because...

Liability for affiliate links? by
GB
A lot of people invested in Icesave as a result of affiliate marketing
links. I searched old emails from MoneySavingExpert and I found this one
from September 2007:
"Next best clean accounts are ICICI 6.3%*, Sainsburys 6.25% and Icesave
6.2%* (which has the best rate guarantee). I've listed a few as I know many
people are currently worried about savings safety. In the extraordinarily...

TV quiz calls by
David J
When these pathetic TV quiz questions are transmitted, a voiceover
advises the end time for any replies. And the warning:
"After this time, calls will not be counted, but may be charged"
What's wrong with the TV stations automatically blocking the lines?
That way the calls will not be counted, and will not be charged.
IMV, the current practice seems to be verging on being illegal.

Dependent's entitlement to share of Estate by

This is a hypothetical question right now, but it could be a real
question in the near future.
Man A married woman B, and after a few years of marriage they
divorced. They had one child C. Child C was raised by the mother, who
has not re-married or cohabited since her divorce.
In court, man A was ordered to pay maintenance to both the mother and
child. The child's maintenance ceased at the end...

Unilateral modification of contract by
Theo Markettos
A and B agree a contract. At some later date A wishes to modify the
contract. What is the principle called that A aren't allowed to modify the
contract unilaterally without B's agreement? Is there a well-known case at
which this precedent was set?
A can inform B of the new terms and B is deemed to have accepted the
amendment if they do not object within a reasonable time. A may...
