Hi could anybody advise me.
A local newspaper owns the copyright for an image I used on my site,
they instructed me to take the picture down from my site, I done this
almost immediatly however another site was also displaying the same
image.
I photographed the image whilst browsing the other site, does this new
photograph copyright belong to me?

Last year we were having some work done on our house and the architect
noticed a crack (in an internal but load-bearing) wall. He said he
thought it was evidence of subsidence and we should call in our
insurance company.
They sent some people round who inspected the foundations and declared
that it was *not* subsidence (but in effect "wear and tear"). So it

There's a discussion on Wikipedia about when to use the phrase "was
murdered" and when to say "was killed". I thought you might like the
legal discussion.
Imagine Fred is found and he's been shot in the head, from behind,
from short range.
Can I say that Fred has been murdered? Or would it be more sensible
for me to say that Fred has been killed?

Nuisance Neighbours by

Hi all
I am having problems with the neighbours who are making too much noise
especially at night time when I am trying to get some shut eye.
I'm not one to go to bed at 930pm but by 1145pm I'm expecting some
hush from next door. The noise goes on until 3am sometimes 4am. I am
unable to sleep and will no doubt lose my job due to poor timekeeping.
This noise has ruined my life!

I live in a house that was originally 2 plots of land,the council put a covenant on the land that stated that the land could only be used for recreational purposes.The garden is too large for me to cope with and as I have four sons I was wondering how I could have this covenant removed .

Hi folks,
My father died Christmas 2005 and named his solicitor as the executor of
the will.
Pretty straightforward will AFAICS, everything to mum except for the
investments/bank account in his own name only that would be split two
ways between me and my sister. House and rest of investments in joint

I am one of two executors named in a will which leaves money in trust to 4 minors. I do not wish to be dealing with these beneficiaries when I am in my late 80s, and am considering revoking my powers. If I choose "powers reserved" will I have any financial liability, should the other executor fail in their duties?

I have an expensive (£1299) digital SLR camera that has failed after 10,000
exposures and 17 months from purchase. The repair cost is £80. I don't feel
I should have to pay, as the fault occurred without any mistreatment, and
the camera is advertised as having a shutter tested to 100,000 exposures,
which gives the impression the camera is built to...

If a company comits a 'criminal' offence, are the directors likely to
end up with criminal records or is it only the 'company' that gets
hauled through the courts?
Incidentally, the 'company' is a UK bank and the 'offence' pretty
small I'm presuming the local police wouldn't be interested, so do I

I have a contract coming up for renewal. It states that the new contract
will be "substantally similar". The draft new contract is, in my view,
substantially dissimilar. Is there a benchmark judges use to decide what
"substantially similar" means? For example, does it mean that more than 50%
of the terms and conditions should be the same? Or is one of those vague
terms that solicitors write...

I am buying an old access road to a Factory to turn it into garden, and
distribute sections to the neighbours. It is far more complicated than
that. :-( It is IMO far better to have the locals owning the land rather

This applies to businesses, but I cannot find any clear definition of what a
'business' is for the purpose of this act. As an actuary, I frequently
provide services to trustees of small pension schemes, often schemes with
just 1 member in. Can somebody say whether the above act would apply to
debts owed by such schemes?
