image copyright by Lefty
Hi could anybody advise me. A local newspaper owns the copyright for an image I used on my site, they instructed me to take the picture down from my site, I done this almost immediatly however another site was also displaying the same image. I photographed the image whilst browsing the other site, does this new photograph copyright belong to me?

Definition of insurance claim by Roland Perry
Last year we were having some work done on our house and the architect noticed a crack (in an internal but load-bearing) wall. He said he thought it was evidence of subsidence and we should call in our insurance company. They sent some people round who inspected the foundations and declared that it was *not* subsidence (but in effect "wear and tear"). So it wasn't covered by the insurance ....

Access to property by baileyb2003
Hi there, My ex and I separated just before Christmas 2006. To cut long story short, he was abusive and I had to leave in a hurry just taking our 5 month old son and dog with me and suitcase. I've been trying to get access to the ex-marital home (which is in his sole name) to retrieve our belongings. He spoke with my solicitor in February this year and instructed her to tell me to arrrange...

Exemption under Class C by wallace12345x@yahoo.co.uk
The Council Tax (Exempt Dwellings) Order 1992 S.I. Number 558 provides an exemption under Class C, so that a dwelling which is unoccupied and has been so for a period of less than 6 months since the last occupation day and which is substantially unfurnished and has been so throughout that period. After the Class C exemption expires (six months), a property is subject to a 50% charge until...

"was killed" vs "was murdered" by bealoid
There's a discussion on Wikipedia about when to use the phrase "was murdered" and when to say "was killed". I thought you might like the legal discussion. Imagine Fred is found and he's been shot in the head, from behind, from short range. Can I say that Fred has been murdered? Or would it be more sensible for me to say that Fred has been killed?

Nuisance Neighbours by skint
Hi all I am having problems with the neighbours who are making too much noise especially at night time when I am trying to get some shut eye. I'm not one to go to bed at 930pm but by 1145pm I'm expecting some hush from next door. The noise goes on until 3am sometimes 4am. I am unable to sleep and will no doubt lose my job due to poor timekeeping. This noise has ruined my life! I've complained to...

Another will/probate question by Pedt
Hi folks, My father died Christmas 2005 and named his solicitor as the executor of the will. Pretty straightforward will AFAICS, everything to mum except for the investments/bank account in his own name only that would be split two ways between me and my sister. House and rest of investments in joint names.

Traffic Signs Advice by Terry W.
Could anyone please explain the legal position regarding the white lines one sometimes sees at the edge of the road going across openings/crossovers ? I've looked in my copy of the Highway Code but there is no mention of them. I was about to park on one of these lines that was going across a disused entrance to a shopping centre (presumably it was for service vehicles originally) and a...

Executor - Probate by stephenG
I am one of two executors named in a will which leaves money in trust to 4 minors. I do not wish to be dealing with these beneficiaries when I am in my late 80s, and am considering revoking my powers. If I choose "powers reserved" will I have any financial liability, should the other executor fail in their duties? Any advice would be appreciated.

Document Storage? by Dave
Just a simply query. I'm aware of services such as Barclays safe. However wondered if anyone else here might be able to recommend a similar service? All I would like to store are important documents (birth cert. and such). Many thanks for any advice. Kind Regards,

Digital camera fault outside warrantee by Ben Micklem
I was just wanting other opinions on a problem: I have an expensive (£1299) digital SLR camera that has failed after 10,000 exposures and 17 months from purchase. The repair cost is £80. I don't feel I should have to pay, as the fault occurred without any mistreatment, and the camera is advertised as having a shutter tested to 100,000 exposures, which gives the impression the camera is built to...

Are directors liable? by diamond
If a company comits a 'criminal' offence, are the directors likely to end up with criminal records or is it only the 'company' that gets hauled through the courts? Incidentally, the 'company' is a UK bank and the 'offence' pretty small I'm presuming the local police wouldn't be interested, so do I have any options to pursue it?

Definition of "substantially similar" by beezer60
I have a contract coming up for renewal. It states that the new contract will be "substantally similar". The draft new contract is, in my view, substantially dissimilar. Is there a benchmark judges use to decide what "substantially similar" means? For example, does it mean that more than 50% of the terms and conditions should be the same? Or is one of those vague terms that solicitors write...

Individual Voluntary Arrangement (IVA) by Nick

Removal of Gas Water and Electricity services by Dave Fawthrop
I am buying an old access road to a Factory to turn it into garden, and distribute sections to the neighbours. It is far more complicated than that. :-( It is IMO far better to have the locals owning the land rather than an absentee landlord. A small amount of Fly Tipping has occurred. There are *redundant* Gas, Electricity and Water Services along the length of the road, once used by the...

Unenforcable clause in sales agent contract? by Beemer
My contract as an independent sales agent has ended. At the start of the relationship I signed an agreement which stated: "The Agent shall not during the continuance of this Agreement and for a period of one year after its termination (howsoever it shall terminate) market or promote nor assist or advise in the marketing or promotion of any products which would or could compete or in any way...

Late Payment of Commercial Debts (Interest) Act 1998 by GB
Late Payment of Commercial Debts (Interest) Act 1998 This applies to businesses, but I cannot find any clear definition of what a 'business' is for the purpose of this act. As an actuary, I frequently provide services to trustees of small pension schemes, often schemes with just 1 member in. Can somebody say whether the above act would apply to debts owed by such schemes?

Cosmetic surgery gone wrong! by drploppie@hotmail.co.uk
After years of suffering playground abuse due to my big conk, I decided to have it reduced about 6 years ago at the age of 28. Unfortunately I didn't shop around or take any recommendations, but opted for a clinic near to where I live. Early results of the surgery were ok, and I was reasonably pleased. However, since then my nose has shown increasing signs of being wonky, and the tip of my nose...
