Checking for obstacles around the car before driving off by
Les Desser
I have a question of a a drivers duty/liability to check round his
vehicle before getting in and driving off.
For example, if one gets straight into the driving seat and does not
notice a bicycle left by a child in front of the bonnet, is the driver
liable for the damage as he should have checked?
Or, more seriously, if it is a child playing in front of the car and the
driver cannot see him...

Mentally I'll Rape Victim Makes False Allegations by
Turk182
Advice anyone please. A girl in her 20's has been raped, of that
there is no doubt. The offender was a repeat offender and treated the
young woman dreadfully.
However, and this is the twist, the young lady concerned is now making
false allegations about her rape counsellor. The police have said
that what she alleges he did is not illegal, and the young lady says
she does not want anything...

Is selling a legal over the counter drug as an illegal drug a crime?
My query is prompted by this article
http://news.bbc.co.uk/1/hi/world/americas/6459301.stm
pseudoephedrine (which would presumably be used for "cutting" the
illegal drug element to a trace) is not illegal, it appears in many over
the counter cold and flu and allergy medicines freely available in the
UK as well as those...

"Reasonable Length of time" for a computer? by
mark@justgofaster.com
My father in law purchased a PC from PC World for £700 in May 2004. It
is now not working (he lives in Scotland). Before I take it back, I
wanted to know what the defnition of a 'reasonable length of time'
would be for a computer. Is this defined anywhere, or does anyone have
experience of how this has been defined in practice?
Thanks

Inheritance claim - how to? by
Mr Magyster
Hello there,
I would like to lay a claim to an inheritance on my own rather than to
pay a lawyer. Is that doable at all? The case seems relatively obvious
as I am the only child. Anything you can suggest? Is there a ready to
fill templete somewhere on line that you are aware of. Would anybody
point me in the right direction.
Would really appreciate this.
Thanks a lot

Marriage Abroad by
bealoid
What are the potential problems with someone getting married abroad?
What's the difference between a marriage that's registered here with
one that's merely recorded here?

Arranging liability insurance for web site by
James
Several small parish councils (civil, not ecclesiastical) in England are
cooperating to run a web site for local news, small ads, business publicity
etc. They are considering taking out liability insurance. Will they need
one insurance policy for the site, or should they add the insurance to the
policies of each of the separate parish councils? Thanks for any advice.

I said go ahead with 1 of each. Heard nothing for over a week so over a

Legal Maternity Rights for Employees by
Mr. Smith
Hi All,
I would be grateful if someone could shed some light on the legal rights for
a pregnant lady when she wants to leave her employment to look after the
baby when it is born.
Bascially, I am after some clarification on how much SMP the employer needs
to pay and also the legal requirement on the annual leave rights.
The story so far is that the lady in question has worked for her employer

Returns on Internet Purchases Proof of Collection by
Ken
I guess like a lot of people I am increasingly buying items on the internet
and sometimes needing to return the product. Usually this is without a
problem except last August when we had a headboard from Next which took 6
months to resolve.
We returned in accordance with their procedures but even after 5 months they
insisted they were not in receipt of it but as act of goodwill were prepared...

Olympics - tortious claim? by
GB
Say some self-appointed Olympics bid committee recklessly states that the
Olympics will cost 2.4 billion to host, and as a result 'London' commits to
hosting the 2012 olympics. It then turns out (unsurprisingly in my view)
that that figure is only 25% of the true cost, and of course it may well be
higher by the time we actually get to 2012. Does said committee owe a duty
of care to the rest...

Providing maintenance to disabled wife after divorce by
David Wright
What liability is there on a married man to continue to support,
financially, his disabled wife after they divorce, assuming all other debts
and liabilities are discharged? The disability to the wife, which is
unpleasant rather than incapacitating, occured 6 years ago, 23 years into
the marriage.
The married man is being advised that he will need to provide the wife with
maintenance after they...

vdu regulations and free eye tests by
Colin Wilson
If a company has an obligation to offer employees a free eye test
because of their use of VDUs, is the company able to impose
restrictions on where that eye test occurs?
IANAL
An additional question to this might be how often should this be
offered, and should the company initiate arranging tests themselves
- or is it only if a member of staff requests one that they need to
do anything ?

Breach of contract (assured shorthold tenancy) by
Ben
Hi,
In need of some advice....
We (3 housemates including me) took out a joint tenancy for a house
last August. To cut a long story short, the place was filthy when we
moved in - took months to get fire alarms fitted (and even then, we
had to get the council involved), we got broken into 3 times due to
weak security (no proper security external doors, no window locks -
single glazed, no...
